In a collection of opinions sent to the National Assembly Standing Committee (NASC), the Petition Committee reflected the concerns of voters and people that recently child abuse continues to occur in many localities such as Gia Lai, Hung Yen, Phu Tho and especially the child abuse case that is attracting public attention at the Rose Shelter in District 12, Ho Chi Minh City.
Accordingly, the Petition Committee recommends that the Ministry of Public Security strictly handle acts of child abuse and promptly bring cases related to child abuse to trial. The Ministry of Labor, War Invalids and Social Affairs (MOLISA) should strengthen inspection, examination and review of child care and nurturing facilities, ensuring compliance with regulations on establishment, organization, operation, dissolution and management of social assistance facilities and other legal regulations on alternative care and nurturing of children in special circumstances.
At the same time, promptly and strictly handle facilities that operate without registration, without a license, or that do not ensure conditions for child care and nurturing according to the provisions of law and instructions of competent authorities.
Child abuse continues to occur in many localities, this is a problem that has been going on for many years. Previously, child abuse cases were mainly caused by relatives, acquaintances, family members or people with personal conflicts, but now children are abused and violated right in child care facilities and social assistance facilities.
After the child abuse case at the Rose Shelter in District 12, Ho Chi Minh City, the Ministry of Public Security said it had issued an official dispatch directing 63 local police departments to coordinate with the Department of Labor, Invalids and Social Affairs to urgently review and grasp the situation of social assistance facilities, child care facilities both public and non-public, and charitable and spontaneous child care facilities in the area.
According to Deputy Minister of Public Security Le Quoc Hung, the number of licensed public and non-public social protection facilities nationwide is currently 425. However, this number is still very small compared to reality. There are many spontaneous facilities, religious and worship facilities that take care of children on a charity basis, and a large number of unlicensed facilities.
“Localities have not yet grasped and have no mechanism to control and inspect these facilities. Therefore, it is recommended that the Ministry of Labor, Invalids and Social Affairs preside over and coordinate with local ministries and branches to conduct a general survey and review of these facilities to grasp, organize inspections, control, and prevent acts of violence and child abuse,” Mr. Hung raised the issue.
Deputy Minister of Labor, Invalids and Social Affairs Nguyen Van Hoi informed that the case of Hoa Hong Shelter is child abuse, related to the factor of taking advantage of humanitarian charity. This is a case related to management work, operating at over 100% capacity but inspection and examination have not handled it, lax management.
Mr. Hoi said that through this incident, the Ministry will strengthen inspection and review work nationwide. In particular, the commune level must strengthen inspection and review at the grassroots level, the district level must strengthen inspection and review work at the district level, and the provincial level as well. Any facility that does not have an operating license must stop. Any facility that does not meet all the criteria and conditions must urgently complete it to enhance the capacity to care for children. At the same time, it is recommended to increase the application of technology in the regular and continuous monitoring of child care at facilities and shelters.
According to Mr. Bui Hoai Son - Standing Member of the National Assembly's Committee on Culture and Education, the above incident shows some legal gaps in child protection, especially in social protection facilities. Therefore, it is necessary to build a more specific legal framework for the activities of charitable organizations, ensuring that all charitable activities related to children comply with the law and do not take advantage of charity for personal gain.
Mr. Son also said that it is necessary to establish quality standards for sponsoring facilities. All charitable facilities related to children must comply with strict regulations on material conditions, personnel and management. These regulations need to be regularly inspected to avoid abuse and violence. In particular, charitable organizations must clearly disclose their revenues and expenditures, and be subject to inspection and supervision.
Ms. Bui Thi An, member of the 13th National Assembly, said that it is absolutely necessary to prohibit child abuse in social protection facilities. "If acts of violence and abuse still occur in charity facilities and children's shelters... this issue must be dealt with thoroughly," Ms. An said.
According to Ms. An, when licensing social protection facilities, we must fully check the material and spiritual conditions and recruit teachers. Regular inspections must be carried out every 3 or 6 months. We have a Law on Child Protection, so we must review all child protection facilities nationwide, both public and private, to see which ones do not meet the conditions. Regular inspections must be carried out to see the actual situation of each facility so that adjustments can be made. Only then can children develop normally. The activities of social protection and charity facilities for children must be made public and transparent.
At the meeting of the Standing Committee of the National Assembly, Ms. Le Thi Nga - Chairwoman of the National Assembly's Judicial Committee said that the child abuse case at the Hoa Hong Shelter in Ho Chi Minh City and some other localities showed that the situation of child abuse is still complicated. The 14th National Assembly had a supreme supervision on child abuse and issued a very detailed resolution. But until now, this situation still occurs.
From there, Ms. Nga proposed that the Standing Committee of the National Assembly assign the National Assembly's Committee on Culture and Education to re-monitor the National Assembly's Resolution on monitoring the situation of child abuse to report to the National Assembly.
Statistics from the Ministry of Public Security in the first 8 months of 2024 show that nationwide, 1,198 cases with 1,419 defendants were investigated and prosecuted related to acts of child abuse and violence. Of which, the group of acts of child abuse accounted for more than 92%, the rest were child abuse. Localities with many cases of child abuse and violence were Hanoi, Thai Binh, Hoa Binh, Binh Thuan, Ho Chi Minh City, Dong Nai, Can Tho, Lam Dong.
