After years of living together and having to take on a lot of housework, the Chinese woman felt she deserved some compensation.


In 2011, a woman named Ho from Zhengzhou, Henan, China met and married a man named Wang. However, after living together and having children, the big differences between the two in terms of personality, work style, and educational philosophy became increasingly obvious. Because of this, family conflicts continued, and quarrels became a daily occurrence for Ms. Ho and her husband.

In October 2022, after a heated argument, Ms. Ho had no choice but to move out of the house she was living in, and they began living separately from then on. In December 2024, Ms. Ho filed for divorce at the Zhongyuan District Court, Zhengzhou City.

In addition to requesting an end to the marriage, custody of their daughter, and division of joint assets, Ms. Ho also asked her husband to pay 50,000 yuan (about 176 million VND) in compensation for her housework over the years.

Ms. Ho said that in her married life, she had to take on a lot of family work, including taking care of the children and doing housework, but her husband did not fulfill his responsibilities and obligations. She requested compensation because she felt that her efforts should be recognized accordingly.

During the trial, the judge found that the relationship between the two parties was beyond repair, so he organized a mediation to negotiate issues such as property division and child support. During the mediation, both parties expressed their feelings about the marriage and their opinions. The judge expressed sympathy and recognition for the efforts that the plaintiff, Ms. Ho, had put into her family over many years.

However, Ms. Ho's husband disagreed and said that the compensation she offered was too high. The judge explained to the defendant - Mr. Vuong, about the importance of housework for family stability and children's development.

At the same time, the court also emphasized that the responsibilities and obligations of both spouses in the marriage relationship are equal. According to the law, Ms. Ho's efforts must be compensated accordingly, even higher than 50,000 yuan (about 176 million VND).

Regarding property division and child support, the judge makes reasonable suggestions based on the law and takes into account the actual circumstances of both parties, such as their economic income, living conditions and the wishes of their children.

After a period of debate, the two sides finally reached a settlement agreement. Accordingly, the daughter of the two will be raised by Ms. Ho and Mr. Vuong will be responsible for paying monthly child support. In addition, the real estate and vehicles belong to Mr. Vuong. Based on Ms. Ho's request, the court ruled that Mr. Vuong must pay Ms. Ho a one-time economic compensation of 250,000 yuan (more than 880 million VND), which also includes reasonable compensation for the housework she has done for many years.

According to the Civil Code of China, Article 1088 clearly states: A husband or wife who has to shoulder many obligations such as raising children, caring for the elderly, helping each other in work, when divorcing, has the right to request compensation from the other party. The specific measures are agreed upon by both parties, if no agreement is reached, the People's Court will make a judgment.

The judge reminded that, in fact, "housework" is not lighter or easier than outside work. But for a long time, this type of work has often been overlooked or considered mandatory. With the improvement of the "housework compensation in divorce" clause in the Chinese Civil Code, the value of housework has been clarified, and the contribution of houseworkers to marriage and family has been affirmed.

The law states that the party who shouldered more housework would be entitled to corresponding economic compensation. This is beneficial to encouraging family members to participate in housework, promoting mutual respect between husband and wife, playing an active role in balancing the economic interests of husband and wife, eliminating discrimination, and maintaining family harmony and stability.
