4 ways to know if a piece of land is subject to planning or not

(Dan Tri) - There are 4 ways to know if a piece of land is in the planning or not, including looking up information on the red book, contacting the Department of Natural Resources and Environment, land office and using online tools.


Land in planning will have some rights restricted to land users. Therefore, it is very important to check whether the land is in planning or not before buying.

Clause 36, Article 3 of the 2024 Land Law stipulates: "Land use planning is the allocation and zoning of land according to the space of use for the goals of socio-economic development, national defense, security, environmental protection and climate change adaptation based on land potential and land use needs of sectors and fields for each socio-economic region and administrative unit within a specified period of time".

From that, it can be understood that planned land is the land area under planning, planning to implement projects, roads, other public works or reclaimed for defense and security purposes. Land plots in this case will mainly be reclaimed according to the provisions of law.

Currently there are 4 ways to know if land is in planning or not.

The first is to check the planning information on the red book. According to Article 11 of Circular No. 23/2014 of the Ministry of Natural Resources and Environment, planning information will be recorded directly in the Notes section of the red book, which clearly shows the land (area in m2) under which planning, whether compensation will be given when the land is recovered, as well as the name of the project according to the planning.

The second is to contact the competent authority to request planning information. People can go directly to the Department of Natural Resources and Environment of the district where the land is located to ask specifically about planning information. Based on the real estate information provided by the people, the competent officer will look up the planning map and answer them whether the land is located in any planning area or not.

This is a safe and highly accurate way to check land planning, but it will take time and effort as well as have to wait when the demand for checking land planning increases.

Third is to request land planning information at the Land Registration Office. People can exploit the land information system provided by the State by requesting forms and paying fees. In case of refusal to provide land information, the Land Registration Office will respond in writing and state the reasons.

For example, to look up Hanoi planning information, people can access the Planning and Land Use Planning Portal of the Hanoi Department of Natural Resources and Environment. At this portal, land use planning will be updated in detail for each district, along with current status maps and planning maps for people to easily follow. However, this form of search has not been widely developed in many localities.

In addition, many units now provide online planning lookup applications suitable for people who know how to use technology. Another traditional way is to directly survey and ask people living in the area where the land is located.
