General Secretary To Lam requested a change in thinking about law-making in the direction of both ensuring state management requirements and encouraging creativity, liberating all productive forces, and unlocking all resources.
At a press conference held by the Government Office on the afternoon of November 9, Deputy Minister of Justice Dang Hoang Oanh said that the thinking of law-making under the new direction of the General Secretary, Chairman of the National Assembly, and Prime Minister is to innovate the thinking of law-making, with the spirit of resolutely abandoning the thinking of banning if you can't manage it.
“The law only regulates issues under the authority of the National Assembly, absolutely does not codify the provisions of Decrees and Circulars which are legal documents under the authority of the Government and ministries and branches, and does not regulate in the law the contents of administrative procedures, procedures, and records.”
According to Ms. Oanh, in his opening speech at the 8th session of the National Assembly, General Secretary To Lam requested to continue to strongly innovate legislative work, transform the thinking of law-making towards both ensuring state management requirements and encouraging creativity, liberating all productive forces, and tapping all resources for development.
Based on the guiding ideology of General Secretary To Lam, the National Assembly Chairman and the Prime Minister have also promptly issued directive documents to each ministry, branch, locality, agency and organization for implementation.
Specifically, the Chairman of the National Assembly issued Document No. 15 dated October 29, 2024 on innovation in thinking in law-making. The Prime Minister issued Document No. 868 dated October 25, 2024 on promoting the building and completion of institutions to meet the requirements of national development in the new era in the spirit of the direction of General Secretary To Lam at the opening session of the 8th session of the National Assembly.
The Deputy Minister of Justice said that in the coming time, in order to further improve and enhance the quality of law-making, and at the same time prevent corruption and group interests, the Government is resolutely focusing on directing and thoroughly implementing the ideological orientations of General Secretary To Lam in law-making; raising awareness of innovative thinking in law-making and focusing on controlling power, preventing negative corruption and group interests in law-making.
Citing reality, Ms. Oanh said that in the recent review of legal documents, there were many problems in the provisions of the law. However, many problems were related to processes, procedures, order, documents... which are contents and areas that can be found in the legal documents of the Government.
The goal of the laws is to protect the legitimate rights and interests of individuals and organizations, maintain and ensure social order and safety, promote socio-economic development, ensure social justice and equality, and adapt to social development. The laws must be transparent and accessible, systematic and rigorous, contributing to building a progressive, harmonious and developed society.
According to the Deputy Minister of Justice, the Government has directed strongly to amend the Law on Promulgation of Legal Documents, with new policies creating breakthroughs in law-making work.
Accordingly, the new law will supplement a number of control principles in the development and implementation of legal documents; narrow and clearly define the authority to promulgate legal documents.
Along with that, it is necessary to continue to innovate and perfect the process of drafting legal documents professionally, scientifically and promptly; clearly define and strengthen the role and authority of the subjects participating in drafting and promulgating legal documents, at the same time continue to perfect a number of regulations on law enforcement organization, closely linking the drafting with the enforcement of legal documents; strengthen inspection and supervision of handling of illegal legal documents; ensure resources to innovate the allocation mechanism, effectively use funds for drafting and enforcing laws.
“New orientation of the Law on Promulgation of Legal Documents. This law will comprehensively amend and innovate the process of drafting legal documents, starting from the stage of establishing a program for drafting legal documents to the stage of proposing the drafting of legal documents, drafting legal documents, appraising and then examining legal documents,” said Deputy Minister of Justice Dang Hoang Oanh./.
