Responsibilities and solutions of the Ministry of Justice in institution building

Speaking at the question-and-answer session on internal affairs and justice, National Assembly Chairman Vuong Dinh Hue said that this area is the responsibility of the Minister of Home Affairs, Minister of Justice, Minister of Public Security... Deputy Prime Minister Tran Luu Quang will also participate in speaking at the end of the session or directly answer the issues of interest to National Assembly deputies.

Delegate Nguyen Huu Thong - Deputy Head of the National Assembly Delegation of Binh Thuan province questioned the Minister of Justice.

Questioning the Minister of Justice, delegate Nguyen Huu Thong - Deputy Head of the National Assembly Delegation of Binh Thuan province said that according to the report, there are still 13/129 documents detailing the laws and decrees that have come into legal effect during this term but specific documents have not been issued yet. Some documents, according to the assessment, are of poor quality, have been revised, supplemented or are not suitable for practice after a short time of issuance and still have shortcomings and problems.

Faced with the above situation, delegate Nguyen Huu Thong asked the Minister of Justice to clarify the Ministry’s responsibility in building this institution and the direction of solutions in the coming time. The delegate also sent this question to the Prime Minister.

Responding to questions from delegate Nguyen Huu Thong, Minister of Justice Le Thanh Long admitted that the backlog of detailed guidance documents has existed for many years but has not been completely resolved. In particular, in 2023, 12 documents have not been issued for laws, ordinances, and resolutions that have come into legal effect, a decrease of 18 documents compared to 2020, an increase of 4 documents compared to 2021 and equal to 2022. Subjective reasons are still the main cause, including the lack of initiative, lack of effort, and lack of foresight of the subjects submitting the documents for promulgation.

Regarding objective reasons, Minister of Justice Le Thanh Long said that some legal documents require a large number of detailed regulations, some documents are difficult...

Regarding responsibility, the Ministry of Justice is responsible for advising the Government in assessing, reviewing and urging the inspection of implementation. In case of delay by ministries and branches, the Ministry of Justice is responsible.

The Minister of Justice proposed solutions, including solutions that have been implemented so far, that is, the Minister and Head of the sector are directly responsible for the work of drafting legal documents. In the drafting stage, in addition to fully implementing the procedures prescribed by law on promulgating legal documents, ministries and sectors need to continue to make efforts to clearly define the contents of regulations in detailed regulations. Similarly, in the process of examining and evaluating documents, it is also recommended that agencies coordinate closely with each other. For unclear issues, it is not recommended to include them in policies; limit the content of detailed regulations with similar content to be regulated in one document.

The Minister also said that the Politburo also issued regulations on controlling power in inspection work, handling complaints and denunciations, and in the near future, the work of drafting documents will be a channel along with the supervision of the National Assembly.
