REGULATIONS ON POSTING AND BROADCASTING FOREIGN INFORMATION CONTENT IN THE PRESS
Pursuant to the Press Law dated April 5, 2016; Pursuant to Decree No. 72/2013/ND-CP dated July 15, 2013 of the Government on management, provision and use of Internet services and online information and Decree No. 27/2018/ND-CP dated March 1, 2018 of the Government amending and supplementing a number of articles of Decree No. 72/2013/ND-CP dated July 15, 2013 on management, provision and use of Internet services and online information; Pursuant to Decree No. 72/2015/ND-CP dated September 7, 2015 of the Government on management of foreign information activities; Pursuant to Decree No. 09/2017/ND-CP dated February 9, 2017 of the Government detailing the speaking and providing information to the press by State administrative agencies; Pursuant to Decree No. 17/2017/ND-CP dated February 17, 2017 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Information and Communications; At the request of the Director of the Department of External Information, the Minister of Information and Communications issues a Circular regulating the posting and broadcasting of external information content in the press. Chapter IGENERAL PROVISIONS
Article 1. Scope of regulation This Circular regulates the content of foreign information in the press; the posting and broadcasting of foreign information in the press; the rights and responsibilities of press agencies, and the responsibilities of relevant organizations and individuals in posting and broadcasting foreign information in the press. Article 2. Subjects of application This Circular applies to press agencies, press management agencies; Department of Information and Communications; agencies, organizations and individuals related to the activities of posting and broadcasting foreign information content in the press. Article 3. Interpretation of terms In this Circular, the following terms are construed as follows: 1. Foreign press means printed newspapers, electronic newspapers, foreign radio and television channels approved by the Prime Minister in the Foreign Press Plans. 2. Press that publishes and broadcasts foreign information content means printed newspapers, electronic newspapers, radio and television channels, excluding foreign press specified in Clause 1 of this Article. Article 4. Contents of foreign information in the press Contents of foreign information in the press include official information about Vietnam, information promoting the image of Vietnam, information about the world situation in Vietnam and information explaining and clarifying regulations in Clause 1, Articles 7, 8, 9, 10 of Decree No. 72/2015/ND-CP dated September 7, 2015 of the Government on management of foreign information activities. Article 5. Principles for publishing and broadcasting foreign information content in the press 1. Publishing and broadcasting information content that is in line with the Party's guidelines and policies, the State's policies and laws, and in line with the interests of the country and the Vietnamese people. 2. Not publishing or broadcasting information content that negatively affects the position and image of Vietnam; harms foreign relations and international cooperation between Vietnam and other countries; incites violence, propagates wars of aggression, and causes hatred between nations and peoples of other countries. Chapter IIREQUIREMENTS FOR POSTING AND BROADCASTING FOREIGN INFORMATION CONTENT IN THE PRESS
Article 6. Regarding foreign press 1. Regarding information on important issues of Vietnam and the world: After receiving the viewpoints of the Vietnamese State provided by competent authorities, posting and broadcasting shall be carried out as follows: a) Posting and broadcasting location: Front page for printed newspapers; home page for electronic newspapers; news bulletin for foreign radio and television channels; b) Time of posting and broadcasting: No later than 02 hours for electronic newspapers; 05 hours for electronic newspapers that must be translated; 24 hours for printed newspapers; broadcast in the next news bulletin for foreign radio and television channels. 2. Regarding explanatory and clarifying information: Post and broadcast in an easily accessible location, at the earliest time. 3. Regarding other foreign information contents specified in Article 4 of this Circular: Posting and broadcasting at the same time of day. 4. Languages expressed in Vietnamese and foreign languages: a) Increase the number of news, articles, and programs produced in foreign languages (without going through the translation process) to be posted and broadcast in the press; b) Proactively increase the number of languages expressed in foreign languages to serve foreign information audiences in different countries, focusing on developing languages in key areas of foreign information in each period. Article 7. For the press publishing and broadcasting foreign information content When publishing and broadcasting foreign information content, it is encouraged to: 1. Publish and broadcast promptly, in easily accessible locations. 2. Publish and broadcast information on the views of the Vietnamese State on domestic and international issues at the earliest time or upon request of competent State agencies. 3. Publish and broadcast news, articles and programs with foreign information content in foreign languages or with subtitles in foreign languages to promote the effectiveness of foreign information. 4. Local radio and television stations: a) Organize the rebroadcasting of foreign information content that has been broadcast on national radio and television based on agreements between press agencies on the need for publishing and broadcasting; b) Provide local information content for publishing and broadcasting in foreign press to promote the local image to the world. Chapter IIIRIGHTS AND RESPONSIBILITIES OF RELATED UNITS
Article 8. Rights and responsibilities of the foreign press 1. Rights of the foreign press: a) To be given priority by the State to order the publication and broadcasting of foreign information content in the press; b) To be given favorable conditions by the State to publish and broadcast foreign information content in the Vietnamese press and on foreign media. 2. Responsibilities of the foreign press: a) To establish special pages, columns (for printed newspapers, electronic newspapers), groups of programs, topics (for radio and television channels) on foreign information content; b) To ensure that there are reporters and editors to monitor foreign information; c) To coordinate and share news, articles, and programs invested by the State with press agencies, organizations, and media at home and abroad; d) To proactively publish and broadcast news, articles, and radio and television programs promoting the image of Vietnam on foreign media and newspapers of Vietnamese people abroad; d) Encourage the selection of news, articles, radio and television programs on foreign information to post and broadcast on social networks, ensuring intellectual property rights and principles of management, provision and use of information on the network according to the provisions of law; e) Summarize, propose rewards, report on the results of implementing foreign information content in the press, send to the Ministry of Information and Communications before November 30 every year or upon request (according to the form prescribed in Appendix issued with this Circular). Article 9. Rights and responsibilities of the press in publishing and broadcasting foreign information content 1. Rights of the press in publishing and broadcasting foreign information content: a) To be ordered by the State to publish and broadcast foreign information content in the press; b) To be facilitated by the State to publish and broadcast foreign information content in the Vietnamese press. 2. Responsibilities of the press in publishing and broadcasting foreign information content: a) To provide positive information about the country and people of Vietnam in all fields; b) To encourage the opening of special pages, columns and topics to enhance the effectiveness of foreign information and protect the sovereignty of the sea, islands, borders and national territories; c) To assign reporters and editors to monitor foreign information; d) To organize summaries, propose rewards and report on the results of publishing foreign information content in the press when requested. Article 10. Responsibilities of press management agencies 1. Direct and promote press agencies to publish and broadcast foreign information content in the press according to the provisions of this Circular. 2. Provide financial support (if any) for the press to publish and broadcast foreign information content. Article 11. Responsibilities of the Department of Information and Communications 1. Direct and inspect the posting and broadcasting of foreign information content in local newspapers. 2. Summarize and report the results of implementing the provisions of this Circular to the Ministry of Information and Communications upon request. Article 12. Responsibilities of units under the Ministry of Information and Communications 1. The Department of External Information is responsible for: a) Monitoring the implementation of the provisions of this Circular; presiding over and coordinating with units under the Ministry of Information and Communications to inspect the implementation of the provisions of this Circular; synthesizing the results and reporting to the Minister of Information and Communications; b) Assessing the effectiveness of publishing and broadcasting foreign information content of press agencies; c) Providing information, organizing training and fostering professional skills on foreign information; d) Coordinating with relevant agencies to develop mechanisms and policies to support the development of foreign press. 2. The Department of Press is responsible for coordinating and monitoring the implementation of the provisions of this Circular for print and electronic press agencies. 3. The Department of Radio, Television and Electronic Information is responsible for coordinating and monitoring the implementation of the provisions of this Circular for radio and television stations. Chapter IVTERMS OF IMPLEMENTATION
Article 13. Responsibility for implementation The Chief of Office, Director of the Department of Foreign Information, Heads of relevant agencies and units under the Ministry of Information and Communications; Director of the Department of Information and Communications, Leaders of press agencies and relevant agencies, organizations and individuals are responsible for implementing this Circular. Article 14. Effective date 1. This Circular takes effect from June 21, 2019. 2.
