CIRCULAR
GUIDELINES FOR MANAGEMENT OF FOREIGN INFORMATION ACTIVITIES OF PROVINCES AND CENTRAL-GOVERNED CITIES
Pursuant to Decree No. 132/2013/ND-CP dated October 16, 2013 of the Government stipulating the functions, tasks, powers and organizational structure of the Ministry of Information and Communications; Pursuant to Decree No. 72/2015/ND-CP dated September 7, 2015 of the Government on the management of foreign information activities; Pursuant to Decision No. 25/2013/QD-TTg dated May 4, 2013 of the Prime Minister promulgating the Regulation on speaking and providing information to the press; Pursuant to the proposal of the Director of the Department of Foreign Information, the Minister of Information and Communications issues a Circular guiding the management of foreign information activities of provinces and centrally run cities. Chapter IGENERAL PROVISIONS
Article 1. Scope of regulation This Circular provides guidance on the management and implementation of foreign information activities of provinces and centrally run cities. Article 2. Subjects of application This Circular applies to the People's Committees of provinces and centrally run cities (hereinafter referred to as provincial-level People's Committees), specialized agencies under provincial-level People's Committees; People's Committees of districts, towns, and provincial cities (hereinafter referred to as district-level People's Committees); organizations and individuals participating in foreign information activities. Article 3. Contents of the foreign information activity plan Provincial-level People's Committees shall base on the planning, programs, and plans of the Government; the socio-economic development goals and orientations of the province or city; documents guiding foreign information work of the Ministry of Information and Communications to develop long-term, medium-term, and annual foreign information work plans, including the following main tasks: 1. Assigning organizations or individuals to be responsible for implementing foreign information activities. 2. Developing and promulgating legal documents, directives, and operating foreign information activities. 3. Organizing training and professional development for officials at the department level and above and subjects participating in foreign information activities annually on the following key contents: a) Implementing state management documents on foreign information; b) Methods and skills of foreign information work; c) Skills in speaking and providing information to the press; d) International situation and foreign affairs activities of the Party and State; dd) International integration situation of Vietnam and of provinces and cities; e) Situation of the struggle to protect sovereignty over seas, islands, and national territorial borders; g) Disseminate knowledge, raise awareness of human rights; propagate achievements in ensuring human rights of Vietnam and of provinces and cities; h) Relations between Vietnam and countries sharing borders (for provinces with borders). 4. Develop projects, plans, and foreign information activities to carry out the following key tasks: a) Information on the Party's guidelines and policies, the State's policies and laws; b) Information on the international situation and foreign affairs activities of the Party and State, the international integration situation of the province and city; c) Promote the image of the province and city, the tourism potential, trade promotion, and foreign investment attraction of the province and city; d) Provide information on issues related to the province and city that are of interest to foreign public opinion; explain, clarify, and combat false information that affects the reputation and image of the province and city; d) Propagating the protection of the sovereignty of the sea and islands and territorial borders of the Fatherland; e) Other tasks as required by the province or city. Article 4. Funding for foreign information activities Funding for foreign information activities of provinces and centrally-run cities comes from local budgets and other legally mobilized sources. Annually, based on the requirements and tasks of foreign information, the Provincial People's Committee shall allocate local budgets for implementation in accordance with current regulations. Article 5. Providing information to promote the image of the province and city Information to promote the image of the province and city is provided through the following methods: 1. Foreign affairs activities of the provincial People's Committee. 2. Portal/Website of the provincial People's Committee, specialized agencies under the provincial People's Committee; District People's Committee, in Vietnamese and foreign languages. 3. Data system to promote the image of the province and city . 4. Publications in Vietnamese and foreign languages. 5. Foreign information system at international border gates by road, sea, air, and rail. 6. Press products of domestic mass media. 7. Products of foreign news agencies, newspapers, and media. 8. Media products disseminated via the internet. 9. Activities of contact and cooperation with foreign press agencies. 10. Communication activities of major events held in the province, city and abroad. 11. Other methods of foreign information activities as prescribed by law. Article 6. Providing explanatory and clarifying information 1. Explanatory and clarifying information are documents, materials, records, and arguments that aim to explain, clarify, and combat false information that affects the reputation and image of the province or city. 2. The provincial People's Committee organizes the monitoring and synthesis of domestic and foreign press opinions on the situation of the province or city. When the provincial People's Committee discovers or receives false information, documents, or reports that affect the reputation and image of the province or city, it is responsible for notifying the Ministry of Information and Communications and relevant agencies to serve the management work. 3. Provincial People's Committees shall proactively implement information and propaganda measures to protect and enhance the prestige and image of provinces and cities through the following forms: a) Issue press releases to explain and clarify false information; spokespersons of provincial People's Committees, specialized agencies under provincial People's Committees; district People's Committees, speak and provide information to the press in the province or city; b) Send representative leaders or spokespersons to attend press conferences organized by the Central Propaganda Department in coordination with the Ministry of Information and Communications and the Vietnam Journalists Association to provide information to explain and clarify to press agencies when requested by the Ministry of Information and Communications; c) Post explanatory and clarifying information on the portal/website of provincial People's Committees, specialized agencies under provincial People's Committees; district People's Committees; Media products of news agencies, newspapers and other media, in Vietnamese and foreign languages; d) Providing information for news agencies and newspapers to explain, clarify and combat false information; e) Organizing the provision of information to forces participating in foreign information activities and compatriots in border areas, including the following contents: Explaining and clarifying false information; cooperative and friendly relations between Vietnam and countries sharing a border. 4. Information containing state secrets must comply with the provisions of the law on protecting state secrets. Article 7. Image promotion data system of provinces and cities 1. The image promotion data system of provinces and cities is a digitized data system in Vietnamese and foreign languages, introducing the province and city in various fields, providing to the international community and Vietnamese people at home and abroad. 2. The image promotion data system of provinces and cities is the official source of information about the province and city. 3. The image promotion data system of provinces and cities is integrated into the national database of foreign information. 4. Specialized agencies under the provincial People's Committee; District People's Committee; news agencies and newspapers in the province and city are responsible for providing information and data to promote the image of the province and city. Article 8. Support and cooperation with foreign news agencies, press, media, and reporters The provincial People's Committee assigns the specialized agency under the provincial People's Committee to preside over: 1. Develop regulations according to current regulations, creating conditions for foreign news agencies, press, media, and reporters to operate in the province and city. 2. Develop a cooperation mechanism with foreign news agencies, press, media, and reporters to produce media products to introduce and promote the image of the province and city on mass media abroad. Chapter IIIMANAGEMENT OF FOREIGN INFORMATION ACTIVITIES
Article 9. Responsibilities of the Provincial People's Committee 1. Implement the Party and State's policies and guidelines on foreign information work in the province and city. 2. Issue legal documents and documents directing and operating foreign information activities. 3. Approve programs, projects, plans, long-term, medium-term, and annual foreign information activities of the province and city. 4. Direct specialized agencies under the Provincial People's Committee; District People's Committee, arrange staff in charge of foreign information work. 5. Provide official information about the province and city according to its functions, tasks, and powers to news agencies, the press, the international community, and overseas Vietnamese. 6. Develop a foreign information system at international border gates by road, sea, air, and rail (for provinces with international border gates by road, sea, air, and rail). 7. Coordinate with the Ministry of Foreign Affairs, the Ministry of Information and Communications, and relevant agencies to develop plans and organize foreign information activities abroad; report to the Ministry of Foreign Affairs before organizing activities and notify the Ministry of Information and Communications to coordinate the implementation of foreign information activities. 8. Secure information within the scope of management of the Provincial People's Committee according to regulations on information security; be responsible for conducting inspections, examinations, handling violations, and resolving complaints and denunciations in foreign information activities in the province or city. 9. Summarize, summarize, and evaluate foreign information activities within the scope of management; Annually send the External Information Activity Plan to the Ministry of Information and Communications before March 1, the plan content according to the form at Appendix No. 01 of this Circular; send the Summary Report on external information work to the Ministry of Information and Communications before December 10, the report content follows the form at Appendix No. 02 of this Circular. When the Ministry of Information and Communications makes an urgent request, the Provincial People's Committee shall send a report to the Ministry of Information and Communications and relevant agencies. Article 10. Responsibilities of the Department of Information and Communications 1. Advise and assist the Provincial People's Committee in state management of foreign information. 2. Develop regulations and rules on foreign information activities in the province and city. 3. Take the lead and coordinate with specialized agencies under the Provincial People's Committee; District People's Committee to perform the following key tasks: a) Develop programs, projects, plans, long-term, medium-term, annual foreign information activities of the province and city as prescribed in Article 3 of this Circular; organize the implementation of programs, projects, plans, long-term, medium-term, annual foreign information activities after being approved by the Provincial People's Committee; b) Guide specialized agencies under the Provincial People's Committee; District People's Committee, arrange staff in charge of foreign information work; c) Urge, guide, inspect, and examine the foreign information work of the province, city; propose rewards for organizations and individuals with achievements in foreign information work according to authority. 4. Preside over and organize the appraisal of programs, projects, plans, long-term, medium-term, annual foreign information activities of specialized agencies under the Provincial People's Committee; District People's Committee; approve (according to authority) or submit to the Provincial People's Committee for approval programs, projects, plans, foreign information activities; Monitor and urge the progress of implementing programs, projects, plans and foreign information activities after approval. 5. Coordinate in developing regulations to facilitate news agencies, newspapers, media, and foreign reporters operating in the province and city; develop cooperation mechanisms with news agencies, newspapers, media, and foreign reporters to produce communication products to introduce and promote the image of the province and city on mass media abroad. 6. Coordinate with the Provincial Propaganda Department, City Party Committee, specialized agencies under the Provincial People's Committee, advise the Provincial People's Committee to organize regular and ad hoc press conferences, provide foreign information to news agencies, newspapers, interested organizations and individuals. 7. Preside over and coordinate with specialized agencies under the Provincial People's Committee; District People's Committee and functional forces to organize training and professional development according to regulations in Clause 3, Article 3 of this Circular. 8. Preside over and coordinate with specialized agencies under the provincial People's Committee; District People's Committee, advise the provincial People's Committee to develop documents, materials, records, arguments to explain, clarify, and combat false information affecting the reputation and image of the province and city. 9. Preside over and coordinate with specialized agencies under the provincial People's Committee to build, manage, exploit and use the data system to promote the image of the province and city; implement legal provisions on protecting state secrets for the data system storage process. 10. Preside over and coordinate with specialized agencies under the provincial People's Committee and functional forces to develop annual plans and budgets to compile content to provide for the foreign information system at international border gates by road, sea, air, and rail, and submit to the provincial People's Committee for approval. 11. Implement the provisions of law on protecting state secrets in foreign information work. 12. Preside over and coordinate with specialized agencies under the provincial People's Committee; District People's Committee, propose the Ministry of Information and Communications or the Provincial People's Committee to reward organizations and individuals with achievements in foreign information work according to their authority. 13. Preside over and coordinate with the Inspectorate of the Ministry of Information and Communications, specialized agencies under the provincial People's Committee; District People's Committee, to conduct inspections, examinations, handle violations and resolve complaints and denunciations in foreign information activities in the province and city according to regulations. Chapter IV Article 11. Implementation 1. The provincial People's Committee is responsible for directing specialized agencies under the provincial People's Committee; district People's Committees under the province to implement the Circular. 2. The Department of External Information is responsible for urging, monitoring and inspecting the implementation of the Circular, periodically reporting the results to the Minister of Information and Communications. Article 12. Effective date This Circular takes effect from December 2, 2016.
