ON MANAGEMENT OF FOREIGN INFORMATION ACTIVITIES
Pursuant to the 2013 Constitution of the Socialist Republic of Vietnam ; Pursuant to the Law on Organization of the Government dated December 25, 2001; Pursuant to the Law on Representative Agencies of the Socialist Republic of Vietnam Abroad dated June 18, 2009; Pursuant to the proposal of the Minister of Information and Communications, the Government promulgates a Decree on the management of foreign information activities. Chapter I Article 1. Scope of regulation This Decree provides for the management of foreign information activities; responsibilities of ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally run cities (hereinafter referred to as provincial-level People's Committees) in the management and implementation of foreign information activities. Article 2. Subjects of application This Decree applies to ministries, ministerial-level agencies, government agencies, provincial People's Committees; agencies and organizations participating in foreign information activities. Article 3. Principles of foreign information activities 1. Comply with the Party's policies and guidelines, the State's laws, international treaties to which the Socialist Republic of Vietnam is a member; comply with the laws and customs of the host country. 2. Ensure that it does not affect national security, social order and safety, prestige, image, diplomatic relations, and international cooperation of Vietnam; protect state secrets. 3. Do not incite people to oppose the Socialist Republic of Vietnam, destroy the national solidarity bloc; do not incite violence, propagate wars of aggression, or cause hatred between ethnic groups and peoples of countries. 4. Ensure accurate and timely information in accordance with the foreign information and propaganda orientation of the Party and State in each period as well as approved foreign information programs and plans; Do not publish false, distorted, or slanderous information aimed at insulting the honor of organizations or the honor and dignity of citizens. Article 4. State management of foreign information 1. The Government shall unify the state management of foreign information activities. a) The Ministry of Information and Communications shall preside over and coordinate with the Ministry of Foreign Affairs and other ministries, ministerial-level agencies, government agencies, provincial People's Committees, and relevant agencies to carry out state management of foreign information. b) The Ministry of Foreign Affairs shall preside over and coordinate with other ministries, ministerial-level agencies, government agencies, and relevant provincial People's Committees to carry out foreign information activities abroad. c) Ministries and branches shall be responsible for managing and organizing the implementation of foreign information activities within the scope and fields of assigned state management. d) Provincial People's Committees shall carry out state management of foreign information activities in their localities. 2. Contents of state management of foreign information: a) Develop and submit to competent authorities for promulgation or promulgate under authority legal documents, strategies, planning, plans, and programs on foreign information activities. b) Organize and manage scientific research on foreign information; train, foster, and provide professional training for forces participating in foreign information activities. c) Manage, guide, and proactively provide information to Vietnamese news and press agencies; proactively provide information to foreign news and press agencies; provide information to overseas Vietnamese and the international community; provide information on the world situation to Vietnam. d) Cooperate internationally on foreign information activities; e) Inspect, examine, handle violations, and resolve complaints and denunciations in foreign information activities according to the provisions of law. e) Summarize and conclude foreign information activities; Propose rewards and disciplines for agencies, organizations and individuals participating in foreign information activities. Article 5. Funding for external information activities Funding for external information activities of ministries, ministerial-level agencies, government agencies, and provincial People's Committees is guaranteed from the state budget according to the current state budget decentralization and other legal financial sources. Annually, based on the external information activity plan of ministries, ministerial-level agencies, government agencies, and provincial People's Committees assigned by competent authorities, agencies and units shall prepare an estimate of implementation costs, synthesize it into the budget estimate of their agencies and units and send it to the financial agency for submission to competent authorities for consideration and decision in accordance with the provisions of the State Budget Law . Chapter IIFOREIGN INFORMATION ACTIVITIES
Article 6. Foreign information Foreign information includes official information about Vietnam, information promoting Vietnam's image and information about the world situation in Vietnam. Article 7. Provision of official information about Vietnam 1. Official information about Vietnam is information about the Party's guidelines and policies, the State's policies and laws; information about the situation in Vietnam in various fields; information about Vietnam's history and other information. 2. Official information about Vietnam is proactively provided by ministries, ministerial-level agencies, government agencies, and provincial People's Committees according to their functions, tasks, and powers to the international community and overseas Vietnamese. 3. Official information about Vietnam is provided in the following forms: a) Official statements at international events, forums, international press conferences, and domestic press conferences. b) Official statements by state management agencies. c) Foreign affairs activities of state management agencies. d) Foreign affairs activities, statements, organization of events, posting of information on electronic information pages, and other activities of Vietnamese representative agencies abroad. d) Press programs and products of press agencies under the Government, including Vietnam News Agency, Vietnam Television, and Voice of Vietnam. e) Posted on the Government's Electronic Information Portal, foreign information websites, Electronic Information Portals of Ministries, ministerial-level agencies, Government agencies, and provincial People's Committees. g) Publications in Vietnamese and foreign languages of state agencies. 4. The provision of official information about Vietnam in all forms must comply with current legal provisions. Article 8. Providing information to promote the image of Vietnam 1. Information to promote the image of Vietnam is information about the country, people, history and culture of the Vietnamese people. 2. Information to promote the image of Vietnam is provided by agencies, organizations and individuals to the international community and Vietnamese people abroad. 3. Information to promote the image of Vietnam is provided in the following forms: a) Publications in Vietnamese and foreign languages. b) Events organized in Vietnam and abroad. c) Press products of mass media. d) Events organized by Vietnamese Cultural Centers abroad. e) Products of foreign news agencies, newspapers and media companies. e) Foreign affairs and international cooperation activities of agencies, organizations and individuals. 4. Providing information promoting Vietnam's image in any form must comply with the laws of Vietnam and the laws of the host country. Article 9. Providing information on the world situation to Vietnam 1. Information on the world situation to Vietnam is information on the world situation in various fields, information on relations between Vietnam and other countries and other information aimed at promoting political, social, cultural, defense and security relations between Vietnam and other countries; serving the country's economic development; promoting Vietnam's international integration process. 2. Information on the world situation to Vietnam is collected, compiled and provided by the Ministry of Foreign Affairs, ministries, ministerial-level agencies, Vietnamese representative agencies abroad, other Vietnamese agencies and organizations abroad, news agencies and press agencies under the Government (Vietnam News Agency, Vietnam Television, Voice of Vietnam), in accordance with their functions, tasks and powers as prescribed by law, to competent agencies, the press and the Vietnamese people. 3. Information on the world situation into Vietnam is provided by the agencies and organizations mentioned in Clause 2 of this Article in the following forms: a) Through spokespersons. b) Posted on electronic information portals and websites. c) At regular press conferences and press briefings. d) Through mass media. 4. The provision of information on the world situation into Vietnam is carried out in accordance with current legal regulations related to the forms mentioned in Clause 3 of this Article. Article 10. Providing information for explanation and clarification 1. Information for explanation and clarification are documents, materials, records, and arguments to explain and clarify false information about Vietnam in various fields. 2. Ministries, ministerial-level agencies, government agencies, provincial People's Committees, and relevant agencies, when receiving false information, documents, and reports affecting the reputation and image of Vietnam from organizations and individuals at home and abroad, are responsible for proactively providing documents, materials, records, and arguments to explain and clarify; and implementing necessary information and propaganda measures to protect and enhance the reputation and image of Vietnam. 3. The Ministry of Information and Communications, the Ministry of Public Security, the Ministry of Foreign Affairs and relevant ministries and agencies, in accordance with their functions, tasks and powers as prescribed by law , are responsible for synthesizing foreign press opinion to detect false information about Vietnam, notifying relevant ministries and agencies to proactively provide explanatory and clarifying information, and simultaneously sending it to the Ministry of Information and Communications for monitoring, synthesizing and reporting to the Prime Minister. Article 11. Foreign affairs website 1. The foreign affairs website is responsible for providing official information and promotional information about Vietnam via the Internet. 2. The Ministry of Information and Communications shall preside over and coordinate with relevant ministries and agencies responsible for managing and operating the foreign affairs website; ensuring that all information is updated to meet the requirements of foreign affairs information tasks. Article 12. Foreign information database 1. The foreign information database is a digitized data system, integrated from the data systems of ministries, ministerial-level agencies, and provincial-level People's Committees to serve foreign information tasks. 2. The foreign information database is a source of official information about Vietnam for domestic and foreign mass media, serving the work of looking up, learning, and researching about Vietnam. 3. The Ministry of Information and Communications shall preside over and coordinate with ministries, ministerial-level agencies, government agencies, provincial-level People's Committees, and relevant agencies to build, manage, and exploit the foreign information database. 4. Ministries, ministerial-level agencies, Government agencies, provincial People's Committees, Vietnamese representative agencies abroad, Vietnamese news agencies and press agencies are responsible for providing information to build and complete the database on foreign information. Article 13. Foreign information publications 1. Foreign information publications are published products in Vietnamese and foreign languages to provide official information about Vietnam and promote the image of Vietnam to the international community and overseas Vietnamese. 2. The Ministry of Information and Communications shall preside over and coordinate with the Ministry of Foreign Affairs, ministries, ministerial-level agencies, government agencies, provincial People's Committees and relevant agencies to develop plans for publishing and distributing foreign information publications in a number of specific fields. Article 14. Events organized abroad 1. Events organized abroad include Vietnam Day abroad and other events organized by ministries, ministerial-level agencies, government agencies, and provincial People's Committees to promote the country, people, history, and culture of the Vietnamese nation, strengthen friendship and relations with other countries, mobilize investment, tourism, trade exchange, and expand cooperation. 2. The Prime Minister shall stipulate the organization of Vietnam Day abroad. 3. Vietnamese representative agencies abroad, permanent offices of Vietnamese news and press agencies abroad, and Vietnamese Cultural Centers abroad shall be responsible for coordinating and supporting ministries, ministerial-level agencies, government agencies, and provincial People's Committees in organizing events in host countries. 4. The agency in charge of organizing events abroad is responsible for coordinating with the Ministry of Foreign Affairs, the Ministry of Information and Communications and relevant agencies to develop plans and implement them. 5. Ministries, ministerial-level agencies, government agencies, and provincial People's Committees are responsible for reporting the results of organizing events abroad according to regulations and sending them to the Ministry of Information and Communications for synthesis and reporting. Article 15. Support and cooperation activities with foreign news agencies, newspapers, media companies and reporters to promote Vietnam abroad 1. Foreign news agencies, newspapers, media companies and reporters are supported and facilitated in writing news, articles, producing programs and publishing products to introduce Vietnam in foreign media and mass media. 2. The Ministry of Information and Communications shall preside over and coordinate with relevant agencies to develop mechanisms and policies to implement the support and cooperation specified in Clause 1 of this Article. 3. Information and press activities of foreign news agencies, newspapers, and media companies in Vietnam must comply with the provisions of Decree No. 88/2012/ND-CP dated October 23, 2012 regulating the activities, information, and press of foreign press, foreign representative agencies, and foreign organizations in Vietnam and related legal documents. Article 16. Vietnamese representative agencies abroad 1. Vietnamese representative agencies abroad are responsible for providing information on the situation in the host country, bilateral relations and other information to Vietnam to competent agencies as prescribed in the Articles 5, 6, 7, 9 of the Law on Representative Agencies of the Socialist Republic of Vietnam Abroad. 2. Vietnamese representative agencies abroad are responsible for providing information about Vietnam to introduce and promote the image of Vietnam through the representative agencies' websites, press conferences, interviews and other activities. The Ministry of Foreign Affairs directs and guides Vietnamese representative agencies abroad to perform the above tasks. 3. The Ministry of Foreign Affairs directs Vietnamese representative agencies abroad to build websites in English and native languages; update information about Vietnam from the foreign information database system. Article 17. Resident offices of Vietnamese news and press agencies abroad 1. Resident offices of Vietnamese news and press agencies abroad (hereinafter referred to as press resident offices) provide information on the situation in the host country to press agencies under the Government in Vietnam. 2. Press resident offices perform the following tasks: a) Coordinate with relevant ministries and agencies to introduce and promote the image of the country, people, history and culture of the Vietnamese people; provide information on the socio-economic situation, policies and guidelines of the Party, policies and laws of the State of Vietnam. b) Coordinate and implement international cooperation programs in the field of information and press. 3. Vietnamese news and press agencies direct their press resident offices to provide information and participate in activities serving foreign information tasks at the request of the Ministry of Information and Communications; Periodically and suddenly report to the Ministry of Information and Communications and the Ministry of Foreign Affairs on the foreign information activities of their permanent agencies. Chapter IIIRESPONSIBILITY FOR MANAGING FOREIGN INFORMATION ACTIVITIES
Article 18. Ministry of Information and Communications 1. Take the lead and coordinate with relevant agencies to develop and guide the implementation of legal documents , strategies, planning, plans, and programs on foreign information. 2. Provide guidance on foreign information content for domestic news agencies and press agencies. 3. Take the lead and coordinate with relevant agencies to implement international cooperation in foreign information activities. 4. Take the lead and coordinate with relevant agencies to inspect and evaluate the effectiveness of foreign information work of ministries, ministerial-level agencies, government agencies, provincial People's Committees, press and publishing agencies, both domestically and internationally. 5. Develop a mechanism for exchanging, coordinating, providing, and sharing information between state agencies and press agencies. 6. Develop and implement a plan to train and improve skills and expertise in foreign information for officials in charge of foreign information work at ministries, ministerial-level agencies, government agencies, provincial People's Committees, press and publishing agencies, editors and translators. 7. Inspect, examine, handle violations and resolve complaints and denunciations in foreign information activities according to the provisions of law . 8. Develop and submit to the Government reports on foreign information activities; provide guidance on the content and timing of data collection for reports. 9. Summarize and conclude foreign information activities; reward and discipline agencies, organizations and individuals participating in foreign information activities. Article 19. Ministry of Foreign Affairs 1. Presides over and coordinates with relevant ministries, ministerial-level agencies, government agencies, and provincial People's Committees in implementing foreign information activities abroad; coordinates with the Ministry of Information and Communications in managing foreign information activities abroad. 2. Expresses Vietnam's official views and stances on international issues; organizes international press conferences; prepares for interviews with State leaders and the Ministry of Foreign Affairs for foreign reporters. 3. Coordinates with relevant ministries and agencies in guiding domestic press to report on foreign affairs activities of State leaders and the Ministry of Foreign Affairs and coordinates in guiding reporting on international situations and domestic news related to foreign affairs. 4. Monitors, researches, and synthesizes foreign press opinion to serve foreign information. 5. Instructs and provides information to foreign press; provides information to the Vietnamese community abroad and the international community; provide world news to Vietnamese people. Article 20. Ministry of Culture, Sports and Tourism 1. The Ministry of Culture, Sports and Tourism shall preside over and coordinate with the Ministry of Information and Communications and relevant agencies to provide information and introduce and promote Vietnamese culture and tourism. 2. Preside over and coordinate with the Ministry of Foreign Affairs, the Ministry of Information and Communications and relevant ministries and agencies in organizing events abroad in the areas under its management. 3. Direct Vietnamese Cultural Centers abroad to carry out foreign information work in the area, effectively use and create conditions for relevant agencies to use Vietnamese Cultural Centers abroad to serve foreign information activities. Article 21. Ministry of Public Security 1. Take the lead and coordinate with the Ministry of Information and Communications to guide and inspect the implementation of the confidentiality regime in foreign information activities of organizations and individuals at home and abroad, in order to ensure that foreign information activities comply with the provisions of this Decree . 2. Monitor and synthesize information related to foreign security to propose policies and measures to explain and clarify false information about Vietnam. 3. Ensure security and safety for foreign information activities in accordance with the orientation of the Party and State; detect and combat activities of hostile forces that take advantage of foreign information to oppose Vietnam. 4. Take the lead and coordinate with the Ministry of Information and Communications and relevant ministries and agencies to organize specialized foreign information activities, through specific channels and measures, contributing to ensuring the interests and national security of Vietnam. Article 22. Ministry of Finance 1. Take charge of and coordinate with the Ministry of Information and Communications to appraise the annual budget estimates for foreign information activities and submit them to competent authorities for approval. 2. Ensure funding sources in the state budget to implement programs, plans, projects and foreign information activities approved by the Government and the Prime Minister. 3. Take charge of and coordinate with relevant agencies to develop documents on mechanisms, policies and funding norms for foreign information activities. Article 23. The Ministry of Home Affairs shall coordinate with the Ministry of Information and Communications and the Ministry of Foreign Affairs to issue documents guiding the improvement of the organization of the state management apparatus for foreign information; guide ministries, ministerial-level agencies, government agencies, and provincial People's Committees to arrange staff in charge of foreign information work. Article 24. Ministries, ministerial-level agencies, government agencies, and provincial-level People's Committees 1. Organize the provision of information to help people understand Vietnam's international integration process, the opportunities, risks, and challenges in the integration process; organize training and fostering of foreign information skills for officials in charge of foreign information work. 2. Direct the development and implementation of action programs and foreign information work plans of their agencies and localities. 3. Annually develop a foreign information activity plan and budget estimate for the unit, synthesize it into the unit's budget estimate, and send it to the financial agency at the same level for synthesis and submission to competent authorities for consideration and decision. 4. Update information, build a data system about their ministries, branches, and localities, integrate it into the foreign information database system to promote Vietnam's image abroad. 5. Coordinate with the Ministry of Information and Communications to carry out international cooperation activities in foreign information activities. 6. Summarize, summarize, and evaluate the effectiveness of foreign information activities within the scope of management, send reports to the Ministry of Information and Communications or make ad hoc reports upon request for synthesis and reporting to the Government. 7. Assign organizations or individuals to be in charge of implementing foreign information activities. 8. Secure information within their management scope according to regulations on information security; be responsible for organizing inspections, examinations, handling violations, and resolving complaints and denunciations in foreign information activities within the management scope. 9. Ministries, ministerial-level agencies, Government agencies, provincial-level People's Committees, news agencies, and Vietnamese press are responsible for periodically or ad hoc reporting on foreign information activities within the management scope of their agencies and localities. Chapter IV Article 25. Effective date 1. This Decree takes effect from October 22, 2015. 2. Decision No. 79/2010/QD-TTg dated November 30, 2010 of the Prime Minister ceases to be effective from the effective date of this Decree. Article 26. Responsibility for guidance and implementation 1. The Ministry of Information and Communications is responsible for guiding and urging the implementation of this Decree as assigned by the Government. 2. Ministers, Heads of ministerial-level agencies, Heads of Government agencies, Chairmen of People's Committees of provinces and centrally run cities are responsible for implementing this Decree./Recipient: - Party Secretary; ; - National Financial Supervisor; - Social Policy Bank - Vietnam Development Bank; - Central Committee of Vietnam Fatherland Front; | TM.
