The Civil Aviation Authority of Vietnam is seeking comments on the Circular amending and supplementing a number of articles of Circular No. 24/2021 of the Ministry of Transport regulating the management and maintenance of aviation works.
The notable point in the new draft Circular is the amendment and supplementation of regulations related to the responsibilities of the Civil Aviation Authority of Vietnam and the Ministry of Construction in the management and maintenance of aviation works.
According to the draft of the new Circular, the Ministry of Construction will be responsible for approving maintenance plans for aviation works invested and managed by the State (Illustration photo).
According to the draft, in the management and maintenance of aviation works, for newly constructed, renovated, and upgraded aviation works invested by the Ministry of Construction, the Ministry of Construction is responsible for approving the maintenance process of the works.
In establishing, approving and adjusting maintenance plans for aviation infrastructure works invested and managed by the State, based on the technical condition of the works, the person assigned to manage, use and exploit this aviation work shall coordinate with the Civil Aviation Authority of Vietnam to survey and make a record to determine the current status of signs of deterioration and damage of the works or equipment installed in the works.
Based on the technical status of the project, information on the scale and structure of the project, history of project maintenance, other information and data, technical standards, maintenance procedures, norms, regulations on priorities and Minutes confirming the current status of signs of deterioration, damage to the project or equipment installed in the project, the person assigned to manage, use and exploit the aviation project invested and managed by the State shall organize a review, summarize the volume and make a maintenance plan for the aviation infrastructure project, submit it to the Ministry of Construction before October 15 every year, and send it to the Civil Aviation Authority of Vietnam.
The Civil Aviation Authority of Vietnam shall report to the Ministry of Construction the results of the review of maintenance plans prepared by the person assigned to manage, use and exploit aviation works invested and managed by the State before October 30 every year.
The Ministry of Construction shall approve the maintenance plan for aviation works invested and managed by the State before November 15 every year.
In case of need to adjust or supplement the approved maintenance plan or repair works outside the approved maintenance plan, or need additional funding, the person assigned to manage, use and exploit the aviation works shall summarize the needs and send them to the Civil Aviation Authority of Vietnam.
Within 7 working days, the Civil Aviation Authority of Vietnam shall report to the Ministry of Construction the results of the review of the needs and the contents of the adjustment and supplementation of the maintenance plan. The Ministry of Construction shall organize the review and approval of the adjustment and supplementation of the maintenance plan for aviation works invested and managed by the State.
Regarding the responsibility of managing and maintaining aviation works, the Civil Aviation Authority of Vietnam will inspect, survey, and coordinate with those assigned to manage, use, and exploit aviation works invested and managed by the State to determine the current status of signs of deterioration and damage to the works or equipment installed in the works.
At the same time, inspect, monitor, and handle according to authority or recommend competent state agencies to handle organizations and individuals violating the management and maintenance of aviation works.
The Civil Aviation Authority of Vietnam performs the tasks of a specialized agency on construction for the maintenance of aviation infrastructure and the contents under the responsibility of the specialized State management agency of aviation related to the management and maintenance of aviation works according to the provisions of law.
