Quang Nam builds policies to support surplus labor

Add support policy

Nong Son and Que Son are subject to the arrangement of administrative units (Us) at the district level in the period of 2023 - 2025. Giving comments during the process of drafting and completing the draft resolution, the provincial professional sector and the leaders of the two above localities all said: Submitting to the Provincial People's Council to promulgate a support policy for redundant labor contracts (LCs) due to the arrangement of administrative units at the district and commune levels in the period of 2023 - 2025 at the 26th Session is very timely. Thereby, it contributes to ensuring that redundant subjects when arranging administrative units according to policies and regulations all have support policies.

Previously, at the 19th Session at the end of 2023, the Provincial People's Council (term X) also issued Resolution 37 stipulating support policies for redundant commune-level cadres, civil servants, public employees (CBCCVC), and non-professional workers when arranging commune-level administrative units in the period of 2023 - 2025.

The Provincial People's Committee continues to submit to the Provincial People's Council for consideration, adding policies for labor contract subjects is very necessary, creating favorable conditions to speed up the arrangement of surplus personnel in administrative units subject to arrangement.

Mr. Tran Phuong - Deputy Head of the Department of Internal Affairs of Nong Son district said that the total number of labor contract subjects in the district's agencies and units according to Decree No. 111/2022 of the Government (except for the education sector) as of now is 16 people. The district leaders agree with the provisions of the draft resolution on support levels for redundant labor contract subjects when arranging administrative units.

"This policy is very humane, demonstrating the local government's concern for labor contract subjects at agencies and units after the arrangement of administrative units in the province in the period of 2023 - 2025" - Mr. Phuong said.

Based on the review results, the Provincial People's Committee expects that 47 people will benefit from the policy after being approved by the Provincial People's Council, with a total support budget of nearly 2.2 billion VND. Regarding the support policy, according to the proposal of the Provincial People's Committee, it is divided into two groups.

In particular, the group of subjects retiring before the age, in addition to the regime and policies enjoyed according to the provisions of Decree No. 29/2023 of the Government, people working under the labor contract regime subject to the resolution of the Provincial People's Council are supported one time with 70% of the funds enjoyed according to the provisions of Decree No. 29 but not less than 50 million VND.

For the group of subjects who quit their jobs immediately, in addition to the regime and policies enjoyed according to the provisions of Decree No. 29/2023 of the Government, people working under the labor contract regime who are subject to the resolution of the Provincial People's Council are supported one time with 80% of the funds enjoyed according to the provisions of Decree No. 29 but not less than 50 million VND.

Notably, in this group, labor contracts are not subject to the Central Government's policy. The Provincial People's Committee proposed a one-time support level according to the working time with compulsory social insurance payment (if not continuous and have not received one-time social insurance benefits, it will be accumulated).

Specifically, those with less than 5 years of work experience will receive 30 million VND/case; those with 5 years to less than 10 years will receive 40 million VND/case; and those with 10 years or more will receive 50 million VND/case.

Motivate workers

The process and procedures for drafting and completing the draft resolution were strictly carried out, with consultation with agencies and units, and consultation with ministries and the Provincial Party Committee Standing Committee before submitting it to the Provincial People's Council.

Assessing the impact of the policy, according to the Department of Home Affairs, for the redundant staff of commune-level public employees and non-professional workers when arranging district-level and commune-level administrative units in Quang Nam province, the Provincial People's Council has issued support policy regulations in Resolution No. 37 dated December 29, 2023. However, the support regime for labor contracts (especially indefinite-term labor contracts) when arranging district-level administrative units has not been regulated.

To develop a policy that ensures regulations, effectiveness and suitability for beneficiaries, the Department of Home Affairs surveyed the number of labor contracts at administrative units subject to arrangement (a total of 203 support and service contracts; 133 professional contracts).

From there, identify specific subjects with the goal of resolving the regime for redundant labor contracts when arranging administrative units, contributing to stabilizing and ensuring the regime for employees at agencies and units after the arrangement in Quang Nam province in the period of 2023 - 2025.

The beneficiaries of the policy are those working under an indefinite-term labor contract performing professional and technical jobs in the list of specialized job positions and shared professional job positions in public service units that are redundant due to organizational restructuring or human resource restructuring of the unit when arranging district-level administrative units in the period of 2023 - 2025, who are eligible for early retirement and immediate resignation according to the provisions of Decree No. 29/2023 of the Government.

People working under indefinite-term support and service labor contracts; support and service labor contracts with a definite term that, before the time of signing the indefinite-term contract, were signed with an indefinite-term contract according to Decree No. 68/2000 of the Government on implementing the contract regime for certain types of work in state administrative agencies and public service units or Decree No. 161/2018 of the Government amending and supplementing a number of regulations on recruitment of civil servants and public employees, promotion of civil servants, promotion of public employees and implementation of the contract regime for certain types of work in state administrative agencies and public service units that are redundant when arranging district-level administrative units in the period of 2023 - 2025.

These subjects are approved by competent authorities to take leave within 3 months from the effective date of the Resolution on the arrangement of administrative units at district and commune levels in Quang Nam province of the National Assembly Standing Committee.

Ms. Tran Thi Kim Hoa - Director of the Department of Home Affairs said that Quang Nam has additional support policies for the above-mentioned subjects who meet the prescribed conditions to encourage and motivate employees to reduce their payroll and quit their jobs. Thereby contributing to stabilizing and perfecting the organizational structure and staff, ensuring the labor regime at agencies and units after the reorganization of administrative units.
