From August 15, two laws will come into effect, including: Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam; Law amending the Law on People's Public Security.
Law on Exit and Entry: Add information on “Place of Birth”, increase visa validity
The Law amends and supplements a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, adding other documents as prescribed in international treaties to which the Socialist Republic of Vietnam is a member, as one of the exit and entry documents.
The Law has added information about “place of birth” on entry and exit documents and added the provision “Other information prescribed by the Government” to ensure flexibility and suitability to the reality in each period.
After amendment and supplementation, the information on the entry and exit documents includes: Portrait photo; Surname, middle name and given name; Gender; Place of birth, date of birth; Nationality; Symbol, entry and exit document number, issuing agency, date of issue and expiry date; personal identification number or identity card number; Position and title for diplomatic passports and official passports in accordance with foreign affairs requirements; Other information as prescribed by the Government.
In addition, the Law on Exit and Entry of Vietnamese Citizens removes the requirement that the passport must have a remaining validity of 6 months or more to be eligible for exit to facilitate citizens when leaving the country.
The law also increases the duration of e-visas from 30 days to no more than 90 days, valid for single or multiple entries, and stipulates that visa durations are calculated by days for visas with a duration of less than 1 year to ensure consistency; increases the temporary stay duration from 15 days to 45 days for citizens of countries that Vietnam unilaterally exempts from visas and are considered for visa issuance and temporary stay extension according to other provisions of the law.
Law on People's Public Security: Regulations on 6 positions with the highest rank
The Law amending and supplementing a number of articles of the Law on People's Public Security stipulates that officers considered for promotion from colonel to major general must have at least 3 years of service remaining; in cases where they do not have 3 years of service remaining, upon request, the President shall decide.
The Law specifically stipulates 6 positions with the highest rank of general in the People's Public Security, including: 1 position with the highest rank of senior general; 5 positions with the highest rank of major general; stipulates that the regimental commander in units under the ministry, Hanoi City Police, Ho Chi Minh City Police, head of the Department of Personnel Organization, Party work and political work, and head of the city police under Hanoi City Police and Ho Chi Minh City Police have the highest rank of colonel.
The Law stipulates the maximum service age of non-commissioned officers and People's Public Security officers.
Specifically, non-commissioned officers are 47 years old (previously 45 years old); lieutenants are 55 years old (previously 53 years old); majors and lieutenant colonels: men 57 years old, women 55 years old (previously 55 years old, women 53 years old); lieutenant colonels: men 60 years old, women 58 years old (previously 58 years old, women 55 years old); colonels: men 62 years old, women 60 years old (previously 60 years old, women 55 years old); generals: men 62 years old, women 60 years old (previously 60 years old).
People's Public Security officers who are professors, associate professors, doctors, and senior experts are allowed to extend their service age to over 62 years old for men and over 60 years old for women according to Government regulations (the old regulations are over 60 years old for men and over 55 years old for women).
