The Ministry of Public Security's Investigation Police Agency has just completed the conclusion and proposed to prosecute the accused Tran Qui Thanh (born 1953), Chairman of Tan Hiep Phat Trading and Service Company Limited, and his two daughters Tran Uyen Phuong (born 1981) and Tran Ngoc Bich (1984) for the crime of "Abuse of trust to appropriate property".
The father and son of Tan Hiep Phat's owners were accused of appropriating up to 767 billion VND through lending interest-free mortgages on projects and dozens of land plots, then "using fraudulent tricks, taking control, and creating reasons not to return the assets.
However, Mr. Tran Qui Thanh did not admit to lending but only admitted to buying and selling assets with asset owners according to the provisions of law. Tran Qui Thanh's actions constituted the crime of "Abuse of trust to appropriate property" as prescribed in Clause 4, Article 175 of the 2015 Penal Code with the role of mastermind and leader.

At the investigation agency, despite having sufficient documents and evidence proving the criminal acts of Tran Qui Thanh and his accomplices, the former Chairman of Tan Hiep Phat remained stubborn, did not confess honestly, and did not clearly recognize his own illegal acts.
According to the investigation agency, the defendant committed the crime for the first time, is a business owner who has contributed a lot to economic and social development, creating jobs for thousands of workers, but has taken advantage of the provisions on lending and transfer contracts in the Civil Code to commit crimes many times with sophisticated and cunning tricks to appropriate assets of especially great value, causing outrage in society.
Therefore, it is necessary to deal with it with a strict sentence before the law for education, deterrence and general prevention.
Similarly, Tran Uyen Phuong and Tran Ngoc Bich were accused of assisting Mr. Tran Qui Thanh. Both were stubborn and did not confess honestly. However, considering that the two defendants violated the law following the instructions of Tran Qui Thanh, it should be considered when sentencing.
