At the Workshop to collect comments on the Draft Decree of the Government on industrial promotion organized by the Department of Industry and Trade of localities, Ministry of Industry and Trade on the afternoon of September 19, based on many years of experience in implementing industrial promotion work, localities contributed many important opinions.

Lots of new content, leading the economic development trend
Presenting the preliminary contents of the Draft Decree amending and supplementing Decree No. 45/2012/ND-CP of the Government on industrial promotion (Draft Decree), Ms. Dinh Thi Huyen Linh - Head of the Department of Industrial Promotion Management, Department of Industry and Trade of localities - informed that, according to the comments of localities, the Draft Decree expands the scope and subjects of application. However, the Drafting Committee wishes to closely follow the direction of the Central Executive Committee of the Party in Resolution No. 19-NQ/TW, dated June 16, 2022 on agriculture, farmers, and rural areas until 2030, with a vision to 2045.

Accordingly, the Draft Decree amends and supplements Clause 2, Article 1. Specifically, the subjects of application are organizations and individuals directly investing in production and providing services for industrial and handicraft production, including: Small and medium enterprises, cooperatives, cooperative groups, business households established and operating in accordance with the provisions of law (hereinafter referred to as rural industrial establishments); industrial production establishments applying cleaner production models, sustainable production and consumption; enterprises, cooperatives, organizations investing in the construction of technical infrastructure of industrial clusters and craft village industrial clusters.
“ Artisans and skilled workers in the field of handicrafts are additional beneficiaries of industrial promotion policies because of their special role in preserving and developing traditional crafts, ” said Ms. Dinh Thi Huyen Linh.
The Draft Decree also amends Clause 1, Article 2 as follows: The national industrial promotion program is a collection of contents and tasks on national and local industrial promotion activities in each period (5 years or 10 years) organized and approved by the Ministry of Industry and Trade in accordance with the medium-term and long-term development plan of the industry with the aim of encouraging the development of industry and handicrafts nationwide.

Add Clause 5a, 5b to Article 2 as follows: Sustainable production and consumption is the application of solutions based on the product life cycle approach, promoting linkages in stages from resource exploitation, fuel, raw materials to production, distribution, consumption and disposal, focusing on repair, maintenance and upkeep, reuse and recycling in stages of the product life cycle; attaching importance to innovation, creativity, application of environmentally friendly technology, improving equipment and management processes to promote green economy, circular economy and sustainable development.
“ This is new content, closely following the Party and State’s policy in promoting green and sustainable production. Therefore, this is also very important content ,” Ms. Dinh Thi Huyen Linh added.
At the same time, digital transformation is a very important development strategy. Enterprises need to digitally transform all activities, but this content requires a lot of resources. To support rural industrial enterprises, the Drafting Committee also added content on digital transformation: "Digital transformation in industrial promotion activities is the support for the application of products and solutions applying advanced technology, digital technology to change traditional management, production and business models to create new opportunities, products, revenue and value in industrial production - small-scale industry" in the Draft Decree.
The Draft Decree also adds new contents, such as: Encouraging and supporting cleaner production, sustainable production and consumption to improve the efficiency of using natural resources, raw materials and fuels associated with environmental protection, promoting green economy, circular economy and sustainable development.
Add content to support the construction of technical demonstration models; application of advanced machinery, scientific and technical advances in industrial and handicraft production; construction of models on applying cleaner production, sustainable production and consumption; support the application of information technology, development of solutions, software, digital transformation in production and business activities...
In addition, the Draft Decree adjusts and supplements a number of contents related to industrial clusters; purchasing equipment, working vehicles, and cars for the management agency of the industrial promotion program and public service units performing industrial promotion tasks under Articles 7 and 8 of this Decree...; list of industries and occupations that benefit from industrial promotion policies; development of rural industrial products...
Many practical contributions
Considering that the issuance of the Decree supplementing and amending Decree No. 45 at this time is very necessary, Mr. Dang Viet Phuong - Deputy Director of Phu Tho Department of Industry and Trade - suggested that from 2025, the Minister of Industry and Trade will be approved by the National Industrial Promotion Program, so on the local side, will the Department of Industry and Trade be approved by the Local Industrial Promotion Program? Currently, the Local Industrial Promotion Program must be approved by the People's Committee or People's Council.
“ An important point, the Ministry of Industry and Trade approved the National Industrial Promotion Program, but does the Ministry of Finance have the funding and how to solve this problem? ”, the leader of the Phu Tho Department of Industry and Trade wondered.

Mr. Dang Viet Phuong also said that in the context of deep economic integration, support programs are easily caught up in anti-subsidy regulations. Therefore, the local Department of Industry and Trade should consult the Department of Trade Defense to remove potentially accused words in the Draft Decree.
Regarding the organizational apparatus for implementing industrial promotion tasks, Mr. Nguyen Van Dac - Director of the Department of Industry and Trade of Son La - expressed that the organization for implementing industrial promotion tasks in Son La has been transferred to the Provincial People's Committee. The Draft Decree does not have any regulations on this subject, if promulgated, Son La will have difficulty arranging to implement industrial promotion work.
Clause 7, Article 1 stipulates policies to support industrial clusters and relocate polluting establishments to industrial clusters. Decree No. 32/2024/ND-CP on Management of Industrial Cluster Development (Decree No. 32) has been issued, which stipulates support contents in industrial clusters and stipulates that the support level shall not exceed 30% of infrastructure investment.
“ The question is whether Clause 7, Article 1 of the Draft Decree is included in the provisions of Decree No. 32 or not, which needs to be clarified, ” Mr. Nguyen Van Dac suggested.

Mr. Pham Khac Nam - Deputy Director of the Department of Industry and Trade of Bac Ninh also suggested that the word "rural" should be removed from the phrase "rural industrial establishments" because the Draft Decree does not limit the area. Moreover, many important technology enterprises such as supporting industrial enterprises are located in industrial parks, cities, wards and districts. If the rural industrial establishments are kept as such, it will no longer be appropriate.
At Point c, Clause 7, Article 4, it is stipulated that only supporting the relocation of establishments in craft villages in industrial clusters is provided, but it should be added that relocation out of planned industrial clusters would be more consistent with Decree No. 32.

In his concluding remarks at the Workshop, Mr. Ngo Quang Trung stated that the new Draft Decree is at a preliminary level, and was developed by the drafting unit based on the recommendations of the units at the event summarizing 10 years of implementing Decree No. 45. After receiving comments at the Workshop, the Department continued to collect written comments from localities.
“ The content of the Draft Decree focuses on amending and supplementing major contents that can be implemented immediately, creating a breakthrough for the implementation of industrial promotion work in the coming time. Unnecessary contents will not be amended within the scope of this Draft Decree ,” Mr. Ngo Quang Trung emphasized.
