Which forces are authorized to stop vehicles for administrative checks?

In addition to the Road Traffic Police, according to the provisions of Circular 65/2012/TT-BCA issued by the Ministry of Public Security on October 30, 2012 and Circular 45/2012/TT-BCA issued by the Ministry of Public Security on July 27, 2012, there are a number of other forces that also have the authority to stop vehicles in circulation to control and handle violations of road traffic laws.

Pursuant to Decree No. 27/2010/ND-CP signed and issued by the Government on March 24, 2010, it is stipulated that: Forces that can be mobilized to coordinate with the Traffic Police to patrol and control order and road traffic safety when necessary include: Commune, ward, and town police and other police forces (including: Order Police, Mobile Police (CSCĐ), Rapid Response Police, Security Police, and Administrative Police for Social Order and Safety).

However, mobilization must be carried out by decision or mobilization plan, clearly stating the force, quantity to be mobilized, time, location of mobilization, responsibilities, and specific tasks of traffic police, other police and commune police participating in coordinating patrols and controlling traffic order and safety.

When the mobilization period stated in the decision or mobilization plan expires without a new mobilization document from the competent authority, other police forces and commune police will end their mobilized tasks and switch to performing regular tasks.

When there is no traffic police accompanying them, other police forces and commune police patrolling and controlling road traffic order and safety must conduct patrols and control road traffic order and safety according to plans approved by competent authorities; if administrative violations in the field of road traffic are discovered, they shall be entitled to impose administrative penalties for violations under their jurisdiction.

In case of exceeding the authority to impose penalties, a record of administrative violations must be drawn up and reported to the competent authority for settlement. In addition, in Hanoi and Ho Chi Minh City, there is also an interdisciplinary working group 141, including: CSCĐ, CSTS, and CSHS, established with the main task of patrolling, controlling, and conducting administrative inspections to prevent and stop subjects from taking advantage of traffic routes to commit crimes.

Thus, the following forces have the authority to stop vehicles and handle violations:

- Traffic police wear badges (green cards) and have a Certificate of Police Patrol and Road Traffic Control (red cards);

- Public order police, Mobile police (CSCĐ), Rapid response police, Security police, Administrative police for social order and safety, and Commune, ward and town police - Only when mobilized to coordinate with road traffic police according to a plan approved by a competent authority;

- Traffic inspectors - in cases where the violation falls under their jurisdiction.

- In Hanoi and Ho Chi Minh City alone, there is an interdisciplinary working group 141.
