More than 20 years and the project is still not completed
It is known that the urban land fund improvement project for Ho Chi Minh City is the first clean land fund creation project in the city with the aim of auctioning land use rights, handing over land use rights to investors with the capacity to quickly implement the city's investment projects according to the approved planning. Thereby, socializing the attraction of investment capital to serve the city's development needs, creating momentum to promote urbanization, forming residential areas, commercial service areas, public works, public utilities, etc. However, the implementation process has encountered many difficulties, shortcomings, and violations related to land acquisition, compensation, resettlement support for people in the project and in the management and use of project land after acquisition.
Specifically, according to the Ho Chi Minh City Inspectorate, the project is behind schedule compared to the approved schedule (investment schedule is 1999 - 2000), and up to now, compensation, support, and land recovery have not been completed when there are still 38 cases that do not agree to receive compensation and support; 22 cases have not agreed to hand over the site. The project implementation units have not yet fully implemented the investment items approved by the Ho Chi Minh City People's Committee.

The implementation of the policy of additional support for purchasing apartments under the direction of the Ho Chi Minh City People's Committee has been delayed because the company assigned as the investor, Dong Mekong Company, has been slow to complete the construction investment, affecting the legitimate rights of people whose land has been recovered (now more than 20 years). This has the potential to cause complaints and denunciations from the people, and a fundamental and feasible solution is needed to resolve it. The responsibility belongs to the Department of Transport, the Management Board of Investment and Construction Projects for Transport Works, and other related organizations and individuals.
The adjustment and change of land use coefficient, reduction of low-rise housing index from 14.2 ha to 13.3 ha and increase of high-rise building construction area to 9.8 ha (increase of 4.2 ha), change of function from low-rise to high-rise, increase of commercial service land area, educational land. There are 3 land plots changing function from low-rise to high-rise... The above transfer has caused Nha Be district to have no residential land fund (clean land) to use as the initial plan when auctioning.
According to the HCMC Inspectorate, almost all of the land recovered in the project has been granted land use certificates to investors by the Department of Natural Resources and Environment. However, up to now, some places have not completed the site clearance and land recovery work, and have not completed the adjustment and recovery of land use certificates of the households that were cleared.
Land management by Nha Be District People's Committee and investors is still loose, leading to the situation where people and units have not yet handed over or re-encroached for use...
Construction without permit, against planning
At the land plot on the left side of Nguyen Huu Tho Street, the relevant State management agencies and project investors including Phu Long Company, Phu Hoang Anh Company, An Tay Company, HD Real Company, Kien A Galleria Company have many shortcomings and violations in the process of land management and use such as subdividing the area not in accordance with the approved planning, granting licenses not in accordance with the planning, encroaching on canals, using for the wrong purpose, building without a license, using land for the wrong purpose, violating the water corridor. In particular, at some land plots, although the land has been allocated for many years, the investors have not yet invested in construction, leaving the land vacant, causing waste, wasting land resources...
On the land on the right side of Nguyen Huu Tho Street, there were also some similar shortcomings and violations, but to date there are still cases that have not been handled according to the provisions of law.
In the implementation of financial obligations for the auction winning money of the land plot on the left side of Nguyen Huu Tho Street (44.4 ha), the consortium of 3 units and Phu Long Company paid the auction winning money behind schedule compared to regulations. After that, these enterprises have not yet fulfilled their financial obligations (registration tax, VAT, corporate income tax) to the State related to this activity. The enterprises' additional payment was also delayed...
Phu Loc Real Estate Investment Joint Stock Company and Nha Be Real Estate Investment Joint Stock Company are the project investors in subdivisions 13 and 16 and have not fulfilled their financial obligations.
From the above violations, the Ho Chi Minh City Inspectorate recommends that the Chairman of the Ho Chi Minh City People's Committee direct relevant departments such as the Management Board of Traffic Construction Investment Projects, Nha Be District People's Committee, Department of Finance, Department of Natural Resources and Environment, Department of Transport, Department of Planning and Architecture, Department of Construction, and Ho Chi Minh City Tax Department to promptly remedy shortcomings and violations in accordance with the provisions of law. At the same time, resolve the rights of people whose agricultural land was recovered in the project to avoid the emergence of mass and complicated complaints.
