In 2024, how much will be the fine for late transfer of red book?

Current regulations clearly state that the penalty for late transfer of real estate ownership includes the penalty for late transfer of red book ownership and the penalty for late submission of tax declaration documents.

Regarding the penalty for late transfer of the red book, according to Clause 3, Article 133 of the 2024 Land Law, within no more than 30 days from the date of notarization of the contract for sale and transfer of real estate, the land user must transfer the red book.

Meanwhile, according to Clause 1 and Clause 2, Article 17 of Decree 91/2019/ND-CP, the fine for the act of delaying the first land change registration is up to 2 million VND; Delaying the transfer of the red book for land with a red book is up to 10 million VND.

In addition to being administratively sanctioned, land users are also forced to register land changes.

Thus, within 30 days from the date of notarization and certification of the contract for sale and transfer of real estate, people are required to transfer the name of the red book at the Land Registration Office. During this period, if the transfer is not made, the land user will be fined up to 10 million VND.

Policy - In 2024, how much will be the fine for late transfer of red book?

When transferring the red book, if not done within the time limit prescribed by law, people may be fined.

In addition, when transferring the Red Book, the land user must also fulfill the obligation to pay taxes, including personal income tax and registration fees. In case of late submission of tax declaration, the land user will be fined up to 25 million VND.

Article 13 of Decree 125/2020/ND-CP stipulates: Late payment of 1 - 30 days will be fined from 2 - 5 million VND; Late payment of 31 - 60 days will be fined from 5 - 8 million VND; Late payment of 61 - 90 days/over 91 days but no tax is payable will be fined from 8 - 15 million VND; Late payment of 90 days will be fined from 15 - 25 million VND.

According to Clause 5, Article 44 of the Law on Tax Administration 2019, the deadline for submitting tax declarations is no later than 10 days from the date the tax liability arises.

Thus, within 30 days from the date of notarization of the real estate transfer or sale contract, people are required to carry out the registration procedure for name change and submit personal income tax declaration within 10 days from the date of tax liability arising.

Regarding the subject of penalty for late transfer of red book title, according to Clause 4, Article 5 of Decree 91/2019/ND-CP, the buyer/donor will be penalized when performing the transfer or donation without or late registration of changes.

The Land Registration Office or the Branch of the Land Registration Office is the competent authority to carry out land change registration. The time limit for land change registration is no more than 10 working days from the date the dossier is recognized as valid.

Thus, after notarizing and certifying the contract for transferring or donating real estate, within the prescribed time limit, people must declare taxes, fees and submit the transfer documents, otherwise they will be fined at the corresponding levels mentioned above.
