Build a house and then "transform" it into a project
Recently, Nguoi Dua Tin received some feedback from the people about a vacant land of nearly 1 hectare where more than 100 townhouses have been built and advertised and sold by brokers as the Thanh Do 1 - The Sol Residence project, attracting the attention of many people.
The nearly 1 hectare vacant land has been used to build more than 100 townhouses and has been advertised and sold by brokers as the Thanh Do 1 - The Sol Residence project, attracting the interest of many people.
According to the reporter's research, on social networks and websites, the Thanh Do 1 - The Sol Residence project is advertised by brokers as being located at the frontage of Thanh Xuan 38 Street, Thanh Xuan Ward, District 12, Ho Chi Minh City, with a "project" scale of up to 1 hectare and a construction density of 40%.
With 106 townhouses built with 1 ground floor, 1 mezzanine, 2 floors and 1 attic (area ranging from 50 - 92m2). The rows of houses are built next to each other, between 2 rows of houses is a traffic road covered with asphalt.
Through verification and records at the project, it was found that the above project was actually the investor "donating land" to build roads and dividing the land into more than 100 smaller plots, then building more than 100 high-rise buildings for sale under the self-proclaimed name of Thanh Do 1 - The Sol Residence project.
According to residents of TX 38 Street, the land donated for traffic roads does not serve the national interest or the interests of the people in Thanh Xuan Ward. “These roads are actually internal roads in this area of more than 100 houses. If they serve, they are only for the investors to build and sell houses and only for those who buy the project to use,” said a resident.
There is no project Thanh Do 1 – The Sol Residence
Providing information to reporters, the leader of District 12 People's Committee affirmed: "Currently, in Thanh Xuan ward, there is no housing project called Thanh Do 1 - The Sol Residence townhouse project, because the competent authority has approved the investment policy."
There is no housing project called Thanh Do 1 townhouse project - The Sol Residence in District 12.
According to the People's Committee of District 12, the People's Committee of the district agreed on a plan to invest in technical infrastructure on the above land to separate the plot with the formation of traffic roads and stipulate the minimum area for land division. Accordingly, land users will carry out procedures for land division and build houses on each separate plot of land.
In addition, recently, the People's Committee of District 12 has also issued Plan No. 8516/KH-UBND dated August 20, 2019 on implementing solutions to enhance the effectiveness and efficiency of State management of construction order in the district.
Accordingly, the People's Committee of District 12 regularly directs the People's Committee of Thanh Xuan Ward to coordinate with the District 12 Inspection Team to increase patrols and inspections of construction works. In case of detecting construction works with signs of violations, violations must be promptly prevented and handled.
"In the coming time, the People's Committee of District 12 will strictly handle and discipline officials and civil servants who are lax in management, show signs of covering up and assisting in violations of construction order according to the nature and level of the violation," the leader of the People's Committee of District 12 emphasized.
Although the People's Committee of District 12 has clearly stated that there is no housing project named Thanh Do 1 - The Sol Residence in the area. However, according to the reporter's records, many real estate brokers and electronic websites continue to advertise and sell housing projects named Thanh Do 1 - The Sol Residence.
In addition, public opinion is currently very concerned that in Thanh Xuan ward, there are still signs that can make customers mistakenly believe that Thanh Do 1 - The Sol Residence project has been approved by the competent authority.
The fact that the project is not real and has not been licensed by the authorities to be implemented makes the public have the right to question whether the land introduced as Thanh Do 1 - The Sol Residence project with a construction scale of 106 townhouses will have difficulty ensuring living conditions in terms of electricity, water, fire prevention and fighting, environmental sanitation, etc.
From a legal perspective, according to lawyers, to avoid risks when buying real estate, especially buying "ghost projects", buyers need to pay attention to learn about related legal issues to help ensure their rights.
Specifically, buyers need to learn carefully about the project investor and should find and choose large, reputable, transparent investors to invest in. At the same time, investors are required to provide complete legal documents of the project. When buying a property, buyers need to consider the transparency of the project's information and the actual status of the project.
According to the law, all investors must publicly disclose project information on their website or at the project management office, or at the transaction floor, so when signing a home purchase contract, buyers need to carefully consider project information.
Buyers also need to carefully check the terms of the real estate purchase contract before signing, specifically checking the subject of the contract; terms of house handover; quality commitment, terms of compensation responsibility of the investor in case of violation...
“Ghost projects” are not a new phenomenon. Therefore, state management agencies also need to promptly take measures to strictly handle violations in land management and closely monitor brokerage activities.
Regarding this issue, Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association, said that in addition to publicizing information about projects for people to easily access and understand, local authorities need to apply strong measures such as administrative enforcement, even prosecuting individuals who intentionally commit acts of deceiving customers.
"People need to be alert, carefully research the legal status of the project as well as the real estate business, and find out more information from newspapers, local authorities, and find out information from nearby residents. In case of detecting signs of fraud, people must promptly report to the authorities or file a lawsuit to protect their rights," Mr. Le Hoang Chau emphasized.
The Messenger will continue to inform.
