Land Law takes effect soon to meet the expectations of people and businesses

At the conference to disseminate and implement a number of laws and resolutions of the 15th National Assembly on July 30, Minister of Natural Resources and Environment Dang Quoc Khanh emphasized that immediately after the Land Law was passed by the National Assembly, the Government and the Prime Minister directed ministries, branches and localities to urgently focus on developing detailed regulations and guidelines for the implementation of the Law.

Mr. Khanh stated that allowing the Land Law to take effect earlier will resolve and remove the shortcomings and limitations pointed out during the review of the implementation of the 2013 Land Law, meeting the expectations and wishes of localities, businesses and people.

According to Minister Dang Quoc Khanh, the documents detailing and guiding the implementation of the Land Law take effect at the same time as the Land Law takes effect.

Of the total 260 articles of the Land Law, 97 articles assign the Government, Prime Minister, Ministers, People's Councils, and People's Committees of provinces and centrally run cities to detail and guide the implementation of the Law.

The Minister said that the Law will be effective immediately upon implementation, especially in terms of land users' rights such as: compensation, support and resettlement policies when the State reclaims land; land policies for ethnic minorities; land policies for Vietnamese people residing abroad who are Vietnamese citizens;

Land finance and land price policies; allowing land users to use land for multiple purposes; promoting decentralization, decentralization, reforming administrative procedures, cutting down on intermediaries in land management and use, reducing compliance costs in accessing land...

Regarding land prices , the 2024 Land Law stipulates that the land price list is built annually and the first land price list is approved by the Provincial People's Council and applied from January 1, 2026, and the land price list is adjusted, amended, and supplemented from January 1 of the following year.

Based on the guidance documents of the Government and the Ministry of Natural Resources and Environment, localities need to prepare early and allocate resources to organize the development of land price lists approaching market land prices according to the new provisions of the Law.

The Land Price List issued by the Provincial People's Committee in accordance with the provisions of the Land Law No. 45/2013/QH13 shall continue to be applied until December 31, 2025; if necessary, the Provincial People's Committee shall decide to adjust the land price list to suit the actual situation of land prices in the locality.

Regarding specific land prices, the 2024 Land Law has decentralized the authority to decide on specific land prices to the Chairman of the People's Committee at the provincial and district levels.

Therefore, localities need to promote training on land prices for district-level officials; at the same time, arrange staff and resources for district-level People's Committee Chairmen to effectively perform the task of deciding on specific land prices according to assigned authority.

Regarding land allocation, land lease, and permission to change land use purposes, the 2024 Land Law has delegated all authority to approve the change of land use purposes for rice cultivation land, protective forest land, special-use forest land, and production forest land that is natural forest to the People's Council at the provincial level.

This aims to create initiative for local authorities in allocating land funds for socio-economic development, while enhancing the responsibility of local authorities in land management in the area.

Regarding land registration, issuance of Certificates of land use rights and ownership of assets attached to land, the 2024 Land Law has assigned the Provincial People's Committee to regulate other types of documents on land use rights issued before October 15, 1993 to suit local realities to overcome difficulties and obstacles in the issuance of Certificates in the past.
