The Import-Export Department (Ministry of Industry and Trade) said it will organize to consult ministries, branches, associations, enterprises as well as related organizations and individuals to study and give opinions on the content of the Draft Circular amending and supplementing a number of articles of Circular No. 05/2018/TT-BCT dated April 3, 2018 of the Minister of Industry and Trade regulating the origin of goods.
According to the Import-Export Department, the World Customs Organization (WCO) has converted the Harmonized Commodity Description and Coding System (HS) from HS Version 2017 to HS Version 2022.
On June 8, 2022, the Ministry of Finance issued Circular No. 31/2022/TT-BTC promulgating the list of Vietnamese export and import goods according to HS Version 2022.
Accordingly, the Ministry of Industry and Trade will convert commodity codes from HS Version 2017 to HS Version 2022 in Appendix I (List of Specific Rules for Commodities) issued with Circular No. 05/2018/TT-BCT dated April 3, 2018 regulating the origin of goods and stipulating the criteria for origin of non-preferential goods to conform to international practices and domestic regulations.
In addition, to implement Resolution No. 100/NQ-CP dated October 6, 2017 of the Government on simplifying administrative procedures and citizen papers related to population management under the management scope of the Ministry of Industry and Trade, therefore, the Ministry of Industry and Trade amends information related to residents (name, ID card number, date of issue) with personal identification numbers in Appendix II issued with Circular No. 05/2018/TT-BCT.
Pursuant to Decree No. 34/2016/ND-CP dated May 14, 2016 of the Government detailing a number of articles and measures to implement the Law on Promulgation of Legal Documents and Circular No. 08/2021/TT-BCT dated September 30, 2021 of the Ministry of Industry and Trade regulating the development and promulgation of legal documents of the Ministry of Industry and Trade, the Import-Export Department organizes to seek opinions from ministries, branches, associations, enterprises as well as related organizations and individuals to study and give opinions on the content of the draft circular.

QND - Currently, the situation of goods with fraudulent origin of Vietnam for export to foreign countries to enjoy tariff incentives or evade trade defense measures (TMS) is increasing and becoming more complicated. Preventing fraudulent origin of goods and evading TMS is an urgent requirement to protect the reputation of Vietnamese goods and domestic manufacturing enterprises.
