According to Mr. Le Minh Ngan, Deputy Minister of Natural Resources and Environment (TN-MT), land without documents will be granted a land use right certificate (red book) if it meets the conditions prescribed in Clause 3, Article 138 of the 2024 Land Law.
Households and individuals using land from October 15, 1993 to before July 1, 2014 without documents on land use rights without violating land laws, and not in cases where land was allocated without proper authority will be granted a red book if they meet the conditions, if the People's Committee (PC) of the commune where the land is located confirms that there is no dispute.
Mr. Le Minh Ngan said that this provision was included in the law based on practical grounds, meeting the requirements of land management. The Deputy Minister of Natural Resources and Environment emphasized that when issuing red books, it is necessary to ensure that "there are no disputes".
To do this, Mr. Le Minh Ngan said the role of officials in charge of land management in localities is very important, as they clearly understand the changes, land use status or whether there are any disputes.
In response to concerns from the press about how to facilitate people when applying for red books for land without documents, Deputy Minister Le Minh Ngan said that the provisions in the law are the first step, the implementation process is very important, along with people's awareness of complying with the law.
Regarding the requirement to determine that the land is not in dispute, Mr. Ngan said that local authorities need to consider this matter carefully. In the coming time, the Ministry of Natural Resources and Environment will draft a Decree, including regulations on the procedures for granting red books for land without documents, in order to minimize inconvenience to people.
"In addition, people also need to improve compliance with the law and propose issuing red books in accordance with regulations and policies," Mr. Le Minh Ngan stated.
The Land Law takes effect from January 1, 2025.
