Deputy Prime Minister Tran Hong Ha stated that over the past time, the Prime Minister, Deputy Prime Ministers, ministries, branches, localities, associations, together with the Ministry of Natural Resources and Environment, have researched and absorbed to perfect legal policies and land management, "the key is land valuation", to remove difficulties and obstacles; including the work of reviewing and perfecting the Draft Decree amending and supplementing a number of articles of Decree 44/2014/ND-CP (Draft Decree).
"This is a document that will be implemented in localities, so you must contribute frankly, point out the shortcomings, so that the Ministry of Natural Resources and Environment can promptly, fully, and practically absorb it, creating favorable conditions during the implementation process, not causing new difficulties or problems. This is the responsibility and right of localities," said the Deputy Prime Minister.
If the locality can do it, the decree will be feasible.
Director of the Department of Planning and Land Resources Development Dao Trung Chinh (Ministry of Natural Resources and Environment) said that after receiving the direction of the Prime Minister, Deputy Prime Minister Tran Hong Ha, and opinions of ministries, branches, and localities, the drafting agency has reviewed and completed the concepts, procedures, and contents of land valuation methods; conditions for applying each land valuation method: Comparison, income, surplus, and land price adjustment coefficient.
The Draft Decree has added detailed regulations on factors affecting land prices to ensure transparency, avoid subjective factors of valuers when applying the comparison method; information sources and priority order, conditions for applying land valuation methods; responsibilities of land valuation units in collecting information, agencies and units in providing information...

Contributing specifically to each article and clause, Vice Chairman of Binh Duong Provincial People's Committee Mai Hung Dung suggested individualizing the responsibilities of individuals and organizations in each stage of the process of determining, appraising, and approving specific land prices. "Should there be regulations allowing localities to decide on specific land prices, more flexibly than the initial land valuation results to attract investors?", Mr. Mai Hung Dung suggested.
Meanwhile, Vice Chairman of Hoa Binh Provincial People's Committee Quach Tat Liem proposed that there should be regulations for an independent appraisal agency to assess the development costs of investors in projects applying the surplus method to calculate land prices.
In addition, leaders of Hoa Binh, Quang Binh and Kien Giang provinces also suggested prioritizing the collection and use of input information from state agencies; methods and adjustment ratio frameworks for each factor affecting land prices to serve the work of determining land prices in the province or for each project; unifying the difference ratio for land prices in the valuation and appraisal stages...
One of the issues that localities are very interested in is the provision on transitional handling for projects that have had decisions on land allocation, land lease, permission to change land use purposes, etc. but have not had decisions approving land prices before and after July 1, 2014 (when the 2013 Land Law takes effect).

Vice Chairman of Hanoi People's Committee Nguyen Trong Dong said that currently, for large projects with long implementation periods, the city and enterprises determine land prices and allocate land according to investment phases, entire blocks, and entire plots.
Agreeing with this opinion, leaders of Quang Binh and Kien Giang provinces pointed out that in practice, when implementing a project, it is impossible to clear the entire site to hand over land at once to investors, especially large projects. However, strict regulations must be put in place on the area and number of times land is handed over, otherwise there will be a situation of fragmented project implementation, even taking advantage of policies such as deliberately slowing down project progress to keep land.
Expressing new perspectives and thinking about land resources
Concluding the meeting, Deputy Prime Minister Tran Hong Ha emphasized that all obstacles to using land resources for economic development, even violations of the law, are mainly due to the issue of valuation. Although the National Assembly is considering the Draft Law amending and supplementing the 2013 Land Law, the Draft Decree needs to continue to provide "close, accurate, correct, and consistent with reality" guidance on land valuation according to the 2013 Land Law; at the same time, it must demonstrate the new viewpoints and thinking of the Draft Law amending and supplementing the 2013 Land Law.
"The methods, procedures, and contents of land price determination must be feasible, realistic, suitable to implementation capacity, scientific, objective, transparent, and ensure fair benefits among people, businesses, and the State. Do not push difficult tasks down to localities," the Deputy Prime Minister requested.
Commenting on a number of specific issues, the Deputy Prime Minister requested the Ministry of Natural Resources and Environment to ensure the accuracy and consistency of calculation formulas; revise the conditions for applying the comparison method; supplement information, data, and land valuation indexes from official sources; responsibilities, authorities, and forms of units and organizations providing and using information; quantify project development costs; and responsibilities of each agency and unit in the entire process of determining, appraising, and approving land prices...

Regarding the proposals of localities on land allocation and land use fee collection according to investment phases, the Deputy Prime Minister stated that competent State agencies must determine investment phases and land use plans when approving projects as a basis for implementation.
The Deputy Prime Minister also assigned localities to urgently discuss, coordinate and work with the Ministry of Natural Resources and Environment to study plans to determine coefficients and sub-indices to be applied in combination with the coefficients for adjusting land prices of land plots and land areas according to land prices in the land price table for areas subject to land use fees and land rents of less than VND 30 billion (centrally-run cities), VND 10 billion (mountainous and highland provinces), VND 20 billion (remaining provinces).
“The Decree must clearly specify specialized legal documents regulating relevant regulations to ensure the connectivity and consistency of the legal system,” the Deputy Prime Minister noted.
