A series of leaders of Vietnam Rare Earth Company were prosecuted.

The Chairman of the Board of Directors, Deputy Director and employees of the Vietnam Rare Earth Company were prosecuted for investigation of the crime of "Smuggling". This is an expansion of the mineral exploitation case in Yen Bai province recently.

On the afternoon of December 1, the Ministry of Public Security's Investigation Police Agency announced that, expanding the investigation into the case of "Violating regulations on research, exploration, and exploitation of natural resources" and "Violating regulations on accounting causing serious consequences" occurring at Thai Duong Group Joint Stock Company (Thai Duong Company) and related units, the unit has issued a decision to supplement the decision to prosecute the criminal case for the crime of "Smuggling".

Along with the decision to supplement the decision to prosecute the case, the Investigation Police Agency also applied procedural measures against a number of defendants. Specifically, the defendant was prosecuted, prohibited from leaving his place of residence, and searched for Mr. Nguyen Quang Manh (Executive Director of Yen Phu Mine) for the crime of "Violating regulations on research, exploration, and exploitation of natural resources".

Mr. Manh was determined to have helped Doan Van Huan (Chairman of the Board of Directors and General Director of Thai Duong Company) direct and organize the illegal exploitation and sale of over 160,000 tons of rare earth and iron ore, illegally profiting more than 632 billion VND.

At the same time, the Investigation Police Agency prosecuted Luu Anh Tuan (Chairman of the Board of Directors of Vietnam Rare Earth Company); prosecuted, arrested and detained Do Hanh Huong (Deputy Director of Vietnam Rare Earth Company); prosecuted, banned from leaving their place of residence and searched Pham Xuan Hau and Pham Thi Yen (both import-export staff of Vietnam Rare Earth Company) for the crime of "Smuggling".

These people were accused of making false customs declarations to illegally export and sell to foreign partners over 470 tons of rare earth worth over VND380 billion in the period 2019 - 2023, causing a loss of export tax (provisional) to the State of more than VND82 billion.

Previously, as reported by SGGP Newspaper, on October 20, the defendants at Thai Duong Company, including: Doan Van Huan (Chairman of the Board of Directors), Nguyen Van Chinh (Deputy General Director), Dang Tran Chi (Director) were prosecuted and temporarily detained to investigate the crimes of "Violating regulations on exploration and exploitation of natural resources" and "Violating regulations on accounting causing serious consequences".

After a period of investigation to clarify violations in the illegal exploitation, processing and consumption of rare earth ore and iron ore at Yen Phu mine, Yen Phu commune, Van Yen district, Yen Bai province by Thai Duong Company, on October 9, the Department of Investigation Police on crimes of corruption, economy and smuggling (Ministry of Public Security) simultaneously searched 21 locations of exploitation, gathering, trading and private homes of related subjects in Yen Bai province and 3 other related provinces and cities; temporarily seized an estimated 13,700 tons of rare earth ore and 1,400 tons of iron ore.

The initial investigation determined that: Doan Van Huan and Nguyen Van Chinh directed and organized the illegal exploitation and consumption of more than 11,200 tons of rare earth ore worth about 440 billion VND and more than 152,000 tons of iron ore worth about 192 billion VND, illegally profiting about 632 billion VND; violating Directive No. 02/CT-TTg dated February 9, 2012 of the Prime Minister, Clauses 3, 5, 7, Article 2 and Article 3 of Mineral Exploitation License No. 927/GP-BTNMT.

In addition, Doan Van Huan and Nguyen Van Chinh also agreed with Vietnam Rare Earth Joint Stock Company and Hop Thanh Phat Company in the process of buying and selling rare earth and iron ore, issuing VAT invoices to reduce the quantity and actual selling price; helping Thai Duong Group Joint Stock Company to leave over 28 billion VND from the sale of rare earth and iron ore off the accounting books, not fulfilling the obligation to declare and pay taxes, causing damage to the State.
