Assign the Government to prescribe procedures and order
National Assembly Delegate Nguyen Minh Tam (Quang Binh) said that the Law on Technical Standards and Regulations, issued in 2006, has revealed a number of shortcomings and limitations after nearly 20 years of implementation. In particular, in recent terms, due to many changes in practice, the National Assembly has promoted the work of law-making, focusing on amending and supplementing many laws to meet requirements, many of which also have provisions on standards and regulations.

Delegate Nguyen Minh Tam also found that this draft Law only focuses on amending and supplementing a number of articles related to innovations in the field of standards and regulations to meet the requirements in the international integration period, especially when Vietnam participates in many new-generation free trade agreements; he suggested that the drafting agencies continue to review the contents of the draft Law to ensure the consistency and synchronization of the legal system.
At point a, clause 13, Article 1 of the draft Law stipulates amendments to points d, dd, e, clause 1, Article 17 of the current Law, which stipulates: The Ministry of Science and Technology shall organize the appraisal of draft national standards according to the provisions of Article 18 of this Law. The appraisal period shall not exceed 30 working days from the date of receipt of valid dossiers.

Commenting on this content, National Assembly Deputy Le Thi Thanh Lam (Hau Giang) said that the regulations on administrative procedures in the draft Law are not suitable to the reality and conditions of socio-economic development; therefore, she proposed that the Government regulate the order and procedures in a decree or circular of the Ministry after the law is passed to ensure greater feasibility.
Delegate Le Thi Thanh Lam proposed to study the reduction of appraisal time to shorten procedures and time to create favorable conditions for businesses to soon circulate goods to the market.
Delimitation of the scope of national technical regulations and local technical regulations
Currently, there are a number of national technical regulations that allow the implementation of conformity declaration based on the conformity assessment of a certification or inspection organization to register the field of operation.

Given this reality, National Assembly Delegate Le Huu Tri (Khanh Hoa) proposed adding the phrase "or registered according to the provisions of the corresponding technical regulations" to Clause 30, Article 1 of the draft Law amending and supplementing Point a, Clause 1, Article 48 to "results of conformity certification by a designated conformity certification organization or registered according to the provisions of the corresponding technical regulations". The delegate said that expanding the subjects certified for conformity with technical regulations will create more favorable conditions for organizations conducting conformity assessment activities.
In addition, delegate Le Huu Tri also pointed out the fact that there are currently many typical and valuable local products but there are no specific standards. Products and goods of group 2 do not have standards in Vietnam, leading to many difficulties in quality management according to legal documents.

Reality also shows that many valuable local products are exported to many other countries in the world, but if we want to build Vietnamese standards, there are no standards, and if we want to build local standards, they have not been approved by competent authorities, so it is very difficult to create competitive advantages for local products.
Based on that reality, delegate Le Huu Tri proposed to supplement Article 26a to stipulate the content of criteria to determine the scope of developing national technical regulations and local technical regulations.
Vice Chairman of the National Assembly Le Minh Hoan requested Minister of Science and Technology Nguyen Manh Hung and the presiding agency to absorb the opinions of National Assembly deputies to perfect the draft Law.
