Ha Tinh issues regulations on organization and operation of "one-stop department"

The "One-stop shop" has the function of acting as a focal point to guide, digitize, receive, monitor, urge, and return administrative procedure settlement results to organizations and individuals according to the regulations issued by the People's Committee of Ha Tinh province and relevant legal regulations.

The People's Committee of Ha Tinh province has just issued a decision to promulgate regulations on the organization and operation of "one-stop-shop departments" at all levels in the province.

This regulation stipulates the organization and operation of “one-stop-shops” at all levels in Ha Tinh. The process of implementing the one-stop-shop mechanism and the inter-connected one-stop-shop mechanism in handling administrative procedures of “one-stop-shops” at all levels in the province. The authority and responsibility of relevant agencies, units, organizations and individuals in handling administrative procedures under the one-stop-shop mechanism and the inter-connected one-stop-shop mechanism in the province. The authority and duties of cadres, civil servants and public employees of state administrative agencies assigned to work at “one-stop-shops” at all levels and employees of public postal service providers working at “one-stop-shops” at all levels in the province (collectively referred to as “persons working at one-stop-shops”).

Contents not specified in this regulation shall be implemented in accordance with the provisions of Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on implementing the one-stop, one-stop mechanism in handling administrative procedures, Decree No. 107/2021/ND-CP dated December 6, 2021 of the Government amending and supplementing a number of articles of Decree No. 61/2018/ND-CP, Decree No. 45/2020/ND-CP dated April 8, 2020 of the Government on performing administrative procedures in the electronic environment, Circular No. 01/2018/TT-VPCP dated November 23, 2018 of the Minister - Head of the Government Office guiding the implementation of a number of provisions of Decree No. 61/2018/ND-CP and other relevant provisions of current law.

The principle of implementing the one-stop mechanism and the interconnected one-stop mechanism in receiving and handling administrative procedures is to take the satisfaction of organizations and individuals as a measure of the quality and effectiveness of service provided by officials, civil servants, public employees and competent agencies. The handling of administrative procedures for organizations and individuals under the one-stop mechanism and the interconnected one-stop mechanism is managed centrally and uniformly.

Resolve administrative procedures promptly, quickly, conveniently, in accordance with the law, fairly, equally, objectively, publicly, transparently and with close coordination between competent agencies. The process of resolving administrative procedures is urged, inspected, monitored, supervised and evaluated by various methods on the basis of promoting the application of information technology and with the participation of organizations and individuals. Do not incur costs for implementing administrative procedures for organizations and individuals other than those prescribed by law.

Officials, civil servants, and public employees of competent agencies shall be accountable for the performance of their duties in handling administrative procedures in accordance with the provisions of law; shall be subject to direct control of the administrative procedure handling activities of the Provincial People's Committee Office and supervision, inspection, and examination by competent agencies and individuals in accordance with the provisions of law. Comply with the provisions of Vietnamese law and relevant international treaties on the implementation of the one-stop shop and inter-connected one-stop shop mechanisms in handling administrative procedures that the Socialist Republic of Vietnam has signed or acceded to.

Administrative procedures under the jurisdiction of agencies, units, localities and establishments must be publicly posted, fully, promptly, and in accordance with the decisions of the Chairman of the Provincial People's Committee that have been announced and are currently in effect. Guidance, reception, requests for additional information, and return of documents during the process of handling administrative procedures must be made in a form issued with this regulation.

Regarding organization, the provincial “one-stop shop” is called the Ha Tinh Provincial Public Administration Service Center, a special administrative unit under the Provincial People’s Committee Office, with its own seal and account to perform assigned tasks and powers. The facilities, headquarters, equipment, machinery, and techniques of the Provincial Public Administration Service Center are guaranteed and managed by the Provincial People’s Committee Office.

The district-level “one-stop shop” is called the District Public Administration Center under the Office of the People’s Council and People’s Committee at the district level. The Office of the People’s Council and People’s Committee at the district level ensures and manages the headquarters, equipment, machinery, application software, and network systems.

The "one-stop-shop" of the People's Committee at the commune level is called the "Reception and Results Delivery Department" at the commune level .

The head of the Central agency organized according to the vertical system at the local level directs the arrangement of cadres, civil servants, and public employees to the Provincial Public Administration Service Center, the district-level public administration center, and the commune-level receiving and returning results department to receive and handle administrative procedures for administrative procedures prescribed by the Prime Minister to be received and returned at the "one-stop department" at all levels.

The “one-stop shop” is responsible for fully and promptly publicizing by electronic means, QR code or in writing the list of administrative procedures performed at the “one-stop shop”; the contents of administrative procedures are publicized according to the provisions of law on administrative procedure control; supporting cases that are unable to access administrative procedures publicized by electronic means;

Guiding the implementation of administrative procedures; receiving and digitizing administrative procedure records; resolving or transferring administrative procedure settlement records; returning administrative procedure settlement results; monitoring, supervising and evaluating the settlement and returning of administrative procedure settlement results to organizations and individuals; collecting fees and charges (if any) according to regulations;

Coordinate with relevant agencies and units to resolve and return resolution results to organizations and individuals in cases where administrative procedures require same-day resolution or administrative procedures are assigned or authorized to civil servants and public employees at the "one-stop shop" to resolve; support organizations and individuals in using online public services;

Coordinate with competent authorities and other relevant agencies to organize training and improve professional qualifications for people working at the "one-stop department" assigned to guide, receive and return results of administrative procedure settlement under the one-stop and inter-connected one-stop mechanism;

Receive, process or report to competent authorities to handle reflections, recommendations, complaints and denunciations of organizations and individuals towards people working at the "one-stop department", competent authorities related to guidance, reception, resolution, transfer of settlement records and return of results of administrative procedure settlement; transfer of explanatory opinions of competent authorities on reflections, recommendations, complaints and denunciations to organizations and individuals...
