At the online conference to announce and implement the Government's Resolution on policies and directions to remove obstacles and difficulties for renewable energy projects on December 12 in Hanoi, Prime Minister Pham Minh Chinh said that in recent times, there have been bright spots and lessons learned in electricity development such as the rapid deployment of the 500 kV line 3, the fastest, with good quality and no capital increase.
By the end of 2023, the total capacity of renewable energy sources (wind power, solar power) in the power system will be 21,664 MW, accounting for about 27%; the cumulative annual electricity output of power sources (wind, ground-mounted solar, rooftop solar) will be about 27,317 million kWh, accounting for nearly 13% of the power system. These results contribute to implementing the orientation in the Power Plan VIII, Vietnam's commitment at the COP26 Conference to achieve "0" net emissions by 2050 and ensure energy security.
However, according to the head of the Government, there are still renewable energy projects that have been suspended, delayed, and put into operation. This resource is also very large, and needs to be quickly deployed and put into operation in the spirit of harmonizing the interests of the State, investors and people. With an incomplete legal system, the implementation of renewable energy projects has new points, complicated issues, and practical situations that are ahead of legal documents. The development of solar and wind power is being implemented quickly, positively, but also has difficulties, obstacles, and even violations.
Delays in putting projects into operation will cause huge waste of social resources, failure to take advantage of available power sources to compensate, ensure power supply, and meet growth needs; consequences can cause risks of collapse, insolvency, inability to repay bank loans, leading to bankruptcy, businesses and people losing money, affecting the investment and business environment.
Recently, the Government and the Prime Minister have resolutely directed to remove difficulties and obstacles for renewable energy projects. On December 7, 2024, the Government met and unanimously issued a Resolution on policies and directions to remove difficulties and obstacles for renewable energy projects.
With the determination to resolve and remove difficulties and obstacles that occur in renewable energy projects, the Prime Minister emphasized: "The removal of difficulties and obstacles with renewable energy projects must be public and transparent, without causing difficulties, inconveniences, or harassment. The Government has issued a policy to remove difficulties, localities must work with businesses to remove difficulties and obstacles, no one has to lobby for anything. In particular, lobbying, negativity, corruption and then having to deal with it, losing people, losing money, losing time, losing trust, losing opportunities. If anyone lobbys, the authorities will handle it strictly."
Regarding violations and problems, Minister of Industry and Trade Nguyen Hong Dien said that implementing the policy of developing renewable energy is a new solution, without precedent, lacking experience, and the legal system is not yet complete, so the implementation process still has some violations that have been specifically concluded by the Government Inspectorate in Conclusion No. 1027.
The main violations include enjoying the incentive price mechanism for the wrong subjects; recognizing the commercial operation date and enjoying the FIT price without written approval from the competent state agency; overlapping mineral planning...
Minister of Industry and Trade Nguyen Hong Dien proposed many solutions to remove difficulties for renewable energy projects.
The Minister of Industry and Trade emphasized that removing difficulties for renewable energy projects must ensure the utilization of invested resources, effectively implement Resolution 55-NQ/TW, Power Plan VIII, commitments at COP26 and attract investment, thereby contributing to strengthening energy security. The solution must be selected on the basis of optimizing socio-economic benefits, limiting disputes and ensuring the harmony of interests between the state and investors.
At the same time, violations or acts of corruption will continue to be strictly handled according to the law, and criminalization will only be considered as a last resort when economic solutions cannot be resolved, or when current laws do not allow and do not detect acts of corruption.
The Ministry also affirmed its stance of not legalizing violations or exempting responsibility for violations that have caused damage, and at the same time required the resolution process to be transparent and not generate negativity. Protecting the rights and legitimate interests of the parties involved is also a consistent principle in resolving problems.
To implement this, the Ministry of Industry and Trade proposed a series of solutions, including allowing additional planning for projects that do not violate national security or key planning, while creating conditions for legal completion for projects with violations of land and construction procedures. In case of overlapping planning, it is necessary to assess socio-economic efficiency to integrate or adjust related planning for effective land use.
For projects that violate the conditions for enjoying FIT prices, it is necessary to re-determine the electricity price according to regulations and revoke incorrect incentives through compensation. For solar power projects on agricultural and forestry land, investors must complete all farm procedures, fulfill financial obligations and comply with initial commitments; if there are violations, the FIT price will be revoked. In particular, the Ministry requires the issuance of clear regulations on electricity purchase and sale to serve as a basis for payment compensation, ensuring transparency in the process of handling these problems.
