On the morning of January 18, at the People's Committee of Quang Hung Commune, Sam Son City, Thanh Hoa, an auction took place for the entire land area of ​​28,038.0m2 in Quang Hung Commune, Sam Son City with a starting price of more than 17.2 billion VND.

At the auction, the auctioneer announced that there were 6 businesses eligible to participate in the auction. Of these, 4 businesses were headquartered in Thanh Hoa city, 1 business was headquartered in Hanoi and 1 business was headquartered in Sam Son city.

After 5 rounds of bidding, Hung Son Investment Company Limited (headquartered in Quang Hung Commune, Sam Son City) was the successful bidder with the announced winning price of more than 20 billion VND, equivalent to the average price for the entire land of more than 720,000 VND per square meter.

In a quick exchange with Nguoi Dua Tin, a leader of the Department of Natural Resources and Environment of Sam Son City said that the auction was successful with the winning bid being over 20 billion VND. Sam Son City is waiting for the document sent from the auction organizer.

According to the reporter's investigation, the auctioned land has a total area of ​​28,038.0m2 (in which, specifically, the land area for land use fee calculation for commercial and service land is 10,204m2; the land area without land use fee is 17,834m2; including: 6,888m2 of residential green land and 10,946m2 of technical infrastructure land). On the land, it is expected to form a 5-star hotel, commercial services and a sea square,... creating a central highlight of the southern area of ​​Sam Son city.

This is considered "golden land" in Sam Son City because of its location near the sea. With a starting price (only about 600 thousand/m2) is considered attractive, suitable in the difficult period of the real estate market. Therefore, the auction has attracted much attention from the people and the business community, contributing to stimulating the vibrant development of the local real estate market.

Previously, on December 13, 2023, the People's Committee of Sam Son City issued Notice No. 6211/TB-UBND on the selection of an organization to auction land use rights for the land area to implement the project of Hotel Complex, Commercial Services and Sea Square in Quang Hung Commune, Sam Son City.

On December 21, 2023, the People's Committee of Sam Son City issued Decision No. 4562/QD-UBND dated December 21, 2023 on announcing the selection of an organization to organize the auction of land use rights for the land area to implement the project of Hotel Complex, Commercial Services and Sea Square in Quang Hung Commune, Sam Son City.

Accordingly, the unit selected to participate in the auction for this project is Nhat An Phu Joint Stock Auction Company, address: 5th Floor - Silver Wings Building, No. 137 Nguyen Van Cu, Ngoc Lam Ward, Long Bien District, Hanoi City. Thanh Hoa Branch, 4th Floor, VCCL Building, No. 91 Nguyen Chi Thanh, Dong Tho Ward, Thanh Hoa City.

The current status of the auctioned land has completed compensation and site clearance. The winner of the auction for land use rights must complete the investment in synchronous construction of technical infrastructure works, ensuring connection with technical infrastructure outside the scope of the auctioned land in accordance with the planning and investment project approved according to regulations.

The starting price for the auction of land use rights to implement the project with a 50-year land lease term, one-time land collection for the entire lease term, after deducting costs excluding site clearance costs, is more than 17.2 billion VND.

The form of auction for the entire area of ​​28,038.0 m2 is by direct voting at the auction. The auction is conducted in rounds, continuously until there are no more people requesting to continue the auction, then the person with the highest bid in that round is the winner.

Auction participants must meet the financial capacity requirements to ensure land use according to the progress of the investment project as prescribed as follows: have their own capital to implement the project not less than 20% of the total project investment; have the ability to mobilize capital to implement the project from credit institutions, foreign bank branches and other organizations and individuals.

At the same time, the auction participants do not violate the provisions of the law on land in the case of using land allocated or leased by the State to implement other investment projects determined based on the following bases: the results of handling violations of the law on land for local projects are archived at the Department of Natural Resources and Environment; the content of the announcement of the status of violations of the law on land and the results of handling violations of the law on land on the electronic information page of the Ministry of Natural Resources and Environment, the General Department of Land Management for projects in other localities.

The deposit is equal to 20% of the starting price for the auction of land use rights in the land area for the project of Hotel Complex, Commercial Services and Sea Square in Quang Hung Commune, Sam Son City, approved by competent authorities.

The step price for the auction is the difference between the price announced by the land use rights auction unit for the next round and the highest bid price of the previous round. The step price for each subsequent round is 1% (one percent) of the highest bid price of the previous round. The auction ends when no one else bids. The auctioneer announces the highest bidder and declares that person the winner of the auction.

In case two or more people offer the highest price, the auctioneer will organize a further auction among the highest bidders to select the winning bidder. If the highest bidder does not agree to continue the auction or there is no higher bidder, the auctioneer will organize a draw to select the winning bidder.

The person whose property is being auctioned and the property auction organization agree on the voting method and the number of auction rounds.

No later than 30 (thirty) days from the date of issuance of the notice of land rent payment by the tax authority, the auction winner shall pay 50% of the land rent as per the notice. No later than 90 (ninety) days from the date of issuance of the notice of land rent payment, the auction winner shall pay the remaining 50% of the land rent as per the notice.

If the auction winner fails to pay the full land rent within the deadline notified by the Tax Authority, the auction winner must pay late payment fees in accordance with the provisions of the Law on Tax Administration and its implementing guidelines. Late payments will only be charged for late payment fees up to the 120th (one hundred and twenty) day from the date of issuance of the decision recognizing the auction results.

In case when handing over land to the winning organization or individual, if the actual land area increases or decreases compared to the area announced in the auction documents, a decision must be made to supplement and adjust the Auction Winning Decision. The amount to be paid increased or decreased is calculated by (=) the auction winning land price per square meter multiplied (x) by the increased or decreased area.

In case after winning the auction, the auction winner requests to change the detailed construction planning which is decided by the competent State agency to be adjusted, leading to an increase in the land use coefficient (construction density, height of the building) or due to management requirements, the competent State agency decides to adjust the detailed construction planning, leading to a decrease in the land use coefficient (construction density, height of the building), the financial obligations related to the planning adjustment (if any) shall be determined according to regulations.
