People, businesses and the state are all "suffering"

In addition, the decisions propose to temporarily suspend the settlement of administrative procedures on land due to the review of the process of land allocation, transfer, capital contribution for project implementation, change of land use purpose, review of land use plans when equitizing enterprises, and re-determination of financial obligations.

According to the Department, there are currently many real estate projects in the area that have changed the purpose of land use with the land source being allocated or leased by the State and have completed construction investment. Many projects have even sold houses, completed construction acceptance and put into use, and people have moved in and settled down. However, up to now, the project has not yet approved the land price to calculate land use fees.
This leads to people buying houses without being granted pink books, the government cannot collect land use fees, taxes, and fees, and businesses have to pay more interest on bank loans...
Proposal to issue pink books to home buyers
Recently, there have been many recommendations on the issuance of pink books to home buyers in projects under inspection. In particular, the Department of Natural Resources and Environment has sent a document asking for opinions on whether the issuance of pink books to home buyers in the above project will affect the results of the investigation and settlement of the case. In case there is an opinion on temporary suspension, it is recommended to notify the Department of Natural Resources and Environment of Ho Chi Minh City for implementation according to regulations. In cases where the project has been temporarily suspended due to being tried by the court, has a blockade document from the investigation agency, or a decision to temporarily suspend by the enforcement agency, the Department of Natural Resources and Environment shall temporarily suspend the issuance of pink books.
According to the Ho Chi Minh City Real Estate Association, customers are honest people. In many places, customers have paid up to 95% of the apartment value. Therefore, projects with violations in investment, construction, business, and property mortgage, but the apartments that customers buy are still in accordance with the design planning, the investor's violations will be separated to be handled according to the law and the pink book will be issued to the home buyer.
For projects that must fulfill financial obligations and pay additional land use fees (if any), this is the relationship between the project investor and the state agency, not related to the responsibilities and obligations of home buyers. It is recommended to separate and handle this separately and also prioritize the issuance of pink books to home buyers first.
The leaders of the City People's Committee also share the same opinion when they think that priority should be given to granting pink books first to customers who have fully fulfilled their obligations under the home purchase contract, because customers are innocent and honest parties.
