Latest conditions for land subdivision and separation in Lam Dong

Lam Dong Provincial People's Committee issued Decision No. 27 stipulating the conditions and minimum area for land division and consolidation for each type of land in the area. The Decision takes effect from October 15.

According to the decision, for urban residential land, the minimum area allowed to be divided into plots of townhouses is 40m2, the side adjacent to the road is 4m or more. Townhouses with gardens need a minimum residential land area of ​​72m2, the side adjacent to the road is 4.5m or more for named roads (or unnamed roads with a road clearance of 10m or more). In the remaining roads and alleys, the minimum residential land area must be 64m2, the side adjacent to the road is 4m or more.

For detached houses, the minimum residential land area is 250m2, the side adjacent to the road must be 10m or more for named roads (or unnamed roads with a road width of 10m or more). For the remaining roads and alleys, the minimum residential land area is 200m2, the side adjacent to the road must be 10m or more.

For villas, the minimum residential land area is 400m2, the side adjacent to the road is 12m or more for named roads (or unnamed roads with a road width of 10m or more). For the remaining roads and alleys, the minimum residential land area is 250m2 and the side adjacent to the road is 10m or more.

For rural residential land, in case there are regulations on housing architectural forms in the approved rural residential area construction planning or commune construction master plan, the area of ​​land to be divided into plots shall comply with the regulations on housing architectural forms of that planning. In case the construction planning period has expired, the planning shall continue to be applied until a new planning is approved.

In case there are no regulations on residential architecture, the residential land area must be at least 72m2, the size of one side of this residential land and the size of the side of the land adjacent to an existing public traffic road or walkway must be 4.5m or more.

For agricultural production land and other agricultural land, the minimum area for subdivision is 500m2 in urban areas (wards and towns) and 1,000m2 in rural areas (communes). The plots of land after subdivision must have a minimum width of 10m adjacent to existing public transport roads or walkways.

For production forest land which is planted forest, the minimum land area for division is 10,000 m2.

The locality also stipulates 3 cases where land plots cannot be divided or merged. The first is land for protection forests, special-use forests, and production forests that are natural forests. The second is land that violates land laws and has not yet complied with the handling of violations. The third is land leased by the State (except for land leases for small, narrow, and interspersed plots managed by the State).

Recently, Lam Dong Department of Justice reported on the transaction volume and transaction prices of real estate types through notarized contracts in the province in the third quarter.

Specifically, the province had nearly 5,500 transactions including land, individual houses and apartments, down 4.3% compared to the second quarter. Of which, 5,151 land lots were transacted with a value of nearly VND4,908 billion; 325 transactions of individual houses with a total value of nearly VND1,356 billion; 17 transactions of apartments with a total value of more than VND35 billion.

Regarding land transactions, Da Lat and Bao Loc cities both saw a decrease in land transactions, 16% and 22% respectively compared to the previous quarter. Da Lat had more than 340 lots with a total value of VND1,475 billion. Compared to the same period last year, transactions in the city decreased by nearly 20%. Meanwhile, Bao Loc had 390 lots transacted with a total value of nearly VND300 billion.

Regarding individual housing transactions, in Da Lat City there were 164 units, worth more than VND1,176 billion, Bao Loc City had 39 units, worth more than VND51 billion, Duc Trong District had 121 units, worth nearly VND128 billion. Regarding apartment buildings, in the third quarter, Lam Dong province had 17 transactions.
