From early morning, many people were present in front of the gate of Nghe An Provincial People's Court on Pham Dinh Toai Street, Vinh City to follow the trial. However, people were restricted from entering the courtroom. At 8:15, the trial began.
Overview of the trial
Mr. Hoang Ngoc Anh, Judge of the People's Court of Nghe An Province, presided over the trial. The representative of the People's Procuracy of Nghe An Province who held the right to prosecute at the court was Mr. Nguyen Duy Viet. The court also summoned Mr. Tran Vo Tung, investigator of Hung Nguyen District Police; summoned staff and appraisers of the Nghe An Department of Finance, representatives of the Hung Nguyen District Finance Department, Hung Nguyen District Treasury, and representatives of the Nghe An Department of Education and Training.
As Thanh Nien reported, on April 24, the People's Court of Hung Nguyen District held a first-instance trial and sentenced Ms. Le Thi Dung (51 years old, former Director of Hung Nguyen District Continuing Education Center) to 5 years in prison for the crime of abusing her position and power while performing official duties.
The two defendants Le Thi Dung and Nguyen Thi Huong (former accountants of Hung Nguyen District Continuing Education Center) at the trial.
According to the indictment of the People's Procuracy of Hung Nguyen District, from 2012 to 2017, Ms. Dung was the Party cell secretary and account holder of the Hung Nguyen District Continuing Education Center. She took advantage of her position and authority to make multiple illegal payments to embezzle nearly 45 million VND from the state budget.
Specifically, in the 2011-2012 school year, it was more than 3.3 million VND; in 2013-2014, it was more than 303,000 VND; in 2014-2015, it was more than 30.9 million VND and in 2015-2016, it was more than 13.8 million VND.
During her work, Ms. Dung presided over the development of internal spending regulations, including some expenditures that were not in accordance with legal regulations.
Some payments are made twice for the same content, such as having received a Party Committee allowance but still being counted as 3 periods/week for the position of Party cell secretary; having received support when going to graduate school but still being counted as 2 periods/week for payment.
According to the indictment, the total amount of damage caused to the Continuing Education Center was nearly 45 million VND. At the first instance trial, Ms. Dung did not plead guilty as charged in the indictment.
People came to watch the trial but were not allowed into the courtroom.
Hung Nguyen District People's Procuracy accused Ms. Dung of making multiple payments over many years, thus falling into the case of "repeated crime" and being prosecuted under the penalty range of 5 - 10 years in prison according to Clause 2, Article 356 of the Penal Code.
The case has caused a stir in public opinion as many people believe that the five-year prison sentence is too harsh. Ms. Dung has appealed the sentence.
On May 23, the People's Procuracy of Nghe An province decided to appeal this criminal judgment of the People's Court of Hung Nguyen district, requesting the People's Court of Nghe An province to try the case according to the appellate procedure, annul the first instance judgment for re-investigation and re-trial.
