Ensure progress of tasks in the first 6 months of the year

Reporting at the Conference, Ms. Bui Thi Mai Lan, Deputy Chief of Office of the Vietnam Minerals Department, said: In the first 6 months of 2023, the Vietnam Minerals Department has seriously implemented the Resolutions, Directives; directions of the Government, the Prime Minister and the leaders of the Ministry of Natural Resources and Environment to successfully complete assigned tasks, meeting the requirements and state management tasks of the Industry.

Accordingly, the leaders of the Vietnam Minerals Department have assigned specific and drastic tasks in the direction and operation, focusing on key issues such as: Drafting legal documents, granting licenses for mineral activities; receiving, appraising and approving mineral activity dossiers to ensure strict compliance with procedures and progress.

Regarding the development of legal documents, in 2023, the Vietnam Minerals Department was assigned to preside over the development of a Decree amending and supplementing a number of articles of the Decrees detailing the Law on Minerals and co-preside over the development of the Law on Geology and Minerals.

Currently, the Department is coordinating with relevant units to complete the draft Submission, draft reports in the Document submitted to the Government in February 2024, and submit to the National Assembly Standing Committee in March 2024 to prepare for collecting comments on the Draft Law.

Regarding the Decree amending and supplementing a number of articles of the Decrees detailing the Law on Minerals, on July 3, 2023, the Ministry of Justice held a meeting of the Council for Appraisal of the draft Decree. The Vietnam Minerals Administration reported to the Party Committee on the draft Decree and the issue of mineral exploitation for common construction materials. At the same time, the Administration is urgently completing the draft Decree according to the comments of the Appraisal Council for submission to the Government for promulgation.

Regarding the appraisal and settlement of mineral license applications, the Vietnam Minerals Department always closely follows and complies with the provisions of the Mineral Law, Decrees guiding the implementation of the Mineral Law and the direction of the Prime Minister in Directive 38/CT-TTg dated September 29, 2020 on strengthening the effectiveness of the implementation of policies and laws on minerals; ensuring strict compliance with the provisions of the law.

Specifically, by the end of June, the Department had submitted to the Ministry 13 Mineral Exploitation Licenses; 2 Mineral Exploration Licenses; 10 Decisions to adjust mineral exploitation licenses, and 12 Decisions related to mineral mine closure.

Regarding the task of removing difficulties in licensing the exploitation of earth fill mines serving key national traffic projects, the Department has advised the Ministry to report to the Government to issue 2 Resolutions, including Resolution No. 31/NQ-CP Resolution of the regular Government meeting in February 2023; Resolution No. 47/NQ-CP piloting the removal of difficulties in licensing the exploitation of earth fill mines serving the North-South expressway project, Vinh Hao - Phan Thiet section.

According to Ms. Bui Thi Mai Lan, the Department has also advised the Ministry of Natural Resources and Environment to send a document to the People's Committees of provinces and cities on instructions for exploiting minerals as common construction materials for expressway construction projects that apply special mechanisms.

In addition, based on opinions from localities and data from specialized agencies under the Ministry of Transport, the Department has compiled and submitted to the Ministry a report to the Prime Minister on the coordination of sand materials for filling in the provinces of the Mekong Delta region.

The Department has also conducted 27 surprise inspections related to requests for: granting exploration licenses, transferring mineral exploitation rights, extending mineral exploitation licenses, closing mines... at the request of localities and enterprises. Currently, the Department is conducting 6 planned inspections of Licenses issued by the Ministry of Natural Resources and Environment in the provinces of Quang Tri, Thua Thien - Hue, Quang Nam, Binh Thuan, Yen Bai, Gia Lai.

In addition, the Vietnam Minerals Department has inspected the work of calculating fees for granting mineral exploitation rights; auctioning mineral exploitation rights; determining costs for assessing mineral potential, and costs for mineral exploration that must be reimbursed due to state investment in mineral exploitation licenses under the licensing authority (period 2014 - 2022) of the People's Committee of Tien Giang province...

Speaking at the Conference, Director of the Vietnam Minerals Department, Mr. Nguyen Truong Giang said that in order to complete the tasks and plans set out in the last 6 months of 2023, the Department will continue to implement the Resolutions and Conclusions of the Central Committee, the National Assembly, the Government, the Prime Minister and the directives of the leaders of the Ministry of Natural Resources and Environment; carry out administrative reforms, apply information technology, and apply Vietnamese technical standards to perform the tasks of the Department.

The Department will strengthen and improve the effectiveness of coordination between the Department and units under the Ministry; coordinate between the Department and the Department of Natural Resources and Environment of localities in state management of minerals; regularly review, urge, remove obstacles in performing tasks and identify key tasks that need to be resolved weekly, monthly, quarterly, etc.

At the same time, to ensure the progress of the implementation of the Law on Geology and Minerals (submitted to the Government in October 2023), Director Nguyen Truong Giang proposed that the Ministry of Natural Resources and Environment direct relevant units to promptly arrange funding sources to implement the above tasks and approve new tasks in 2023 using environmental career funds to organize the implementation. This is an urgent task that needs to be implemented to ensure the progress of drafting the Law on Geology and Minerals.

In the context of increasingly complex and heavy tasks, Director Nguyen Truong Giang requested that the officers and employees of the Department continue to unite and work together to overcome difficulties to successfully complete the tasks in the last 6 months of the year.
