Quang Ninh voters propose 8 groups of issues after the 7th session of the 15th National Assembly

Immediately after the 7th Session of the 15th National Assembly, the National Assembly Delegation of Quang Ninh province organized a meeting with voters to report on the results of the session and the country's development in the first 6 months of 2024. Voters in the province highly appreciated the sense of responsibility of the National Assembly Delegation of the province in paying attention to listening, receiving and proposing solutions and legitimate recommendations of voters to the session; actively contributing opinions to important draft laws. In particular, voters highly appreciated the National Assembly's passing of many important laws and policies that are practically related to people's lives.

At the meetings with voters after the 7th Session, voters of Quang Ninh province made recommendations to National Assembly deputies on 8 groups of issues, specifically:

1. Recommendations to the National Assembly Standing Committee

(1) Currently, there are no specific regulations or guidelines on voter contact activities of People's Council deputies at all levels, especially regulations and guidelines on voter contact activities of People's Council deputies at the commune level; in reality, People's Council deputies at the commune level do not organize delegation groups, so the voter contact activities of People's Council deputies at the commune level encounter many difficulties and are not implemented consistently in different localities. It is recommended that the National Assembly Standing Committee consider and soon issue specific regulations and guidelines on voter contact activities of People's Council deputies at all levels.

2. Recommendations to the State Auditor General

(2) The Van Don - Mong Cai Expressway project under the public-private partnership (PPP) method, Build - Operate - Transfer (BOT) contract was approved by the People's Committee of Quang Ninh province in Decision No. 418/QD-UBND dated February 9, 2018 and approved for adjustment in Decision No. 4852/QD-UBND dated December 30, 2020. Accordingly, the expressway project invested under the public-private partnership method has its starting point at Km87+080 in Dong Ngu commune, Tien Yen district. The project has been completed and put into operation since September 1, 2022.

In order to have a basis for finalizing completed projects, it is recommended that the State Audit Office pay attention to and direct the State Audit Office Region VI to organize and conduct an audit of the remaining project implementation value from November 1, 2021 to August 31, 2022, to be carried out in the third quarter of 2024 to strengthen management and accelerate the finalization of completed projects, ensuring effective use of project investment capital.

3. Recommendation to the Ministry of Culture, Sports and Tourism

(3) Decree 166/2018/ND-CP dated October 25, 2018 of the Government regulating the authority, order, procedures for establishing, appraising, and approving plans and projects for preserving, repairing, and restoring historical-cultural relics and scenic spots (effective from December 15, 2019). The content includes establishing, appraising, and approving master plans (detailed plans) of component projects according to the master plan of the relic approved by the competent authority, in line with the provisions on authority, order, and procedures for establishing and approving detailed plans according to the provisions of the Law on Planning. However, some provisions of the current Decree are no longer suitable for local state management practices. It is recommended that the Ministry of Culture, Sports and Tourism pay attention to reviewing, evaluating, and promptly advising the Government to issue a Decree amending or replacing the above Decree.

(4) Ha Long Bay Heritage has a buffer zone boundary (protection zone 2) covering both Ngoc Vung and Thang Loi communes of Van Don district and according to regulations, constructions in the above communes (including public construction works and residential construction works of the people) must have the consent of the Ministry of Culture - Sports and Tourism before construction; this is inappropriate. It is recommended that the Ministry of Culture - Sports and Tourism consider, review, and report to the competent authority to adjust the buffer zone boundary of Ha Long Bay World Natural Heritage in the direction of removing Ngoc Vung and Thang Loi communes of Van Don district, Quang Ninh province from the buffer zone boundary of the heritage.

4. Recommendations to the Ministry of Home Affairs

(5) On September 6, 2021, the Government issued Resolution No. 101/NQ-CP on resolving difficulties in implementing compulsory social insurance for Deputy Military Commanders, Deputy Chiefs of Commune-level Police and people working under labor contracts at Commune-level People's Committees. However, to date, there has been no specific and detailed guidance document to deploy and implement the provisions under the above Resolution of the Government. It is recommended that the Ministry of Home Affairs preside over, together with relevant ministries and branches, review and assess the situation and results of the implementation of Resolution No. 101 of the Government to provide guidance on the organization, implementation, and ensuring rights and policies for relevant subjects.

(6) Clause 2, Article 8 of Decree No. 33/2023/ND-CP dated June 10, 2023 of the Government on commune-level cadres, civil servants and non-professional workers at the commune, village and residential group levels, effective from August 10, 2023, stipulates that the Secretary of the Ho Chi Minh Communist Youth Union and the Chairman of the Vietnam Veterans Association at the commune level must have a university degree or higher in professional qualifications and skills; have graduated from intermediate level political theory or equivalent or higher. However, in reality, there are difficulties in implementing and applying the above standards. It is recommended that the Ministry of Home Affairs preside over and coordinate with relevant ministries and branches to review and report to the Government for consideration and amendment of the above standards, ensuring that they are consistent with the realities at the grassroots level.

5. Recommendations to the Ministry of Agriculture and Rural Development

(7) Pursuant to Decision 318/QD-TTg dated March 8, 2022 of the Prime Minister promulgating the National Criteria for New Rural Communes and the National Criteria for Advanced New Rural Communes for the period 2021-2025. Regulation content: The rate of schools at all levels (preschool, primary school, secondary school, or general schools with multiple levels of education with the highest level of education being secondary school) meeting level 1 facility standards and at least 01 school meeting level 2 facility standards.

In 2018, the Ministry of Education and Training issued a number of regulations and guidelines on the assessment of educational quality and the construction of national standard schools for kindergartens, primary schools, secondary schools, high schools and multi-level general schools. However, the above regulations are suitable for schools with large classes and students, but for special schools in island communes with small classes and students, they are not suitable, requiring investment in large projects with high investment costs but low efficiency and functionality, causing waste.

It is recommended that the Ministry of Agriculture and Rural Development take the lead, together with the Ministry of Education and Training, in researching and assessing the situation and results of implementing Decision No. 318/QD-TTg dated March 8, 2022 of the Prime Minister and related regulations; at the same time, research and propose suitable solutions for areas with specific factors such as island communes.

6. Recommendations to the Ministry of Defense

(8) The regimes, policies and support levels as prescribed in Decree No. 72/2020/ND-CP dated June 30, 2020 of the Government detailing a number of Articles of the Law on Militia and Self-Defense Forces on force organization and building and regimes and policies for militia and self-defense forces are specified in specific monetary amounts. However, according to the new basic salary policy, the basic salary has increased from VND 1,800,000 to VND 2,340,000, but the regimes and policies under Decree No. 72 still apply the specific monetary levels established at the time of the old basic salary; the application will no longer be appropriate and outdated. It is recommended that the Ministry of National Defense study and report to the Government to promptly amend and supplement the provisions in Decree 72/2020/ND-CP dated June 30, 2020 of the Government so that the current support levels must be consistent with the new basic salary policy; At the same time, improve the quality of policy making, accordingly, policies and regimes need to be built using coefficients based on basic salary instead of stipulating a specific amount of money.

(9) According to Resolution No. 837/NQ-UBTVQH14 dated December 17, 2019 of the Standing Committee of the 14th National Assembly on the arrangement of district and commune-level administrative units in Quang Ninh province. Accordingly, Tinh Huc commune was merged into Binh Lieu town (named Binh Lieu town). Before the merger, Tinh Huc commune was a commune in the land border area according to the provisions of Decree No. 34/2014/ND-CP dated April 29, 2014 of the Government on the regulations of the land border area of ​​the Socialist Republic of Vietnam. Thus, in reality, Binh Lieu town is currently a commune-level administrative unit in the land border area. However, it has not been recognized by a competent state agency. It is recommended that the Ministry of National Defense review and report to the Government for consideration of regulating Binh Lieu town as a town in the land border area.

(10) Currently, many soldiers who joined the army after April 30, 1975 to participate in border protection, have difficult living conditions but have not yet enjoyed health insurance; at the same time, those who joined and were discharged after December 1988 are not currently enjoying the same allowances as those who are subject to the provisions of Decision No. 62/2011/QD-TTg dated November 9, 2012 of the Prime Minister on the regime and policies for those who participated in the war to protect the Fatherland, performed international missions in Cambodia, and helped Laos after April 30, 1975 and have been demobilized, discharged, or quit their jobs. It is recommended that the Ministry of National Defense preside over and, together with relevant ministries and branches, review the list of subjects mentioned above, and at the same time study and consider proposing to competent authorities to regulate the health insurance regime for soldiers who enlisted after April 30, 1975 to participate in border protection; expand the subjects entitled to enjoy the regimes and policies according to Decision No. 62/2011/QD-TTg dated November 9, 2012 of the Prime Minister.

7. Recommendations to the Ministry of Education and Training

(11) On March 9, 2010, the Prime Minister issued Decision No. 15/2010/QD-TTg regulating allowances for teaching combined classes for teachers directly teaching primary school students in public educational institutions. Accordingly, Clause 2, Article 3 stipulates the allowance levels: “a) Teachers teaching combined classes of two levels will receive an additional 50% of the salary of the month of teaching each month; b) Teachers teaching combined classes of three or more levels will receive an additional 75% of the salary of the month of teaching each month”. Implementing the 2018 General Education Program to ensure the teaching of subjects and educational activities requires each class, including combined classes, to have many teachers teaching different subjects. Therefore, the instructions on payment for teachers according to Decision No. 15/2010/QD-TTg dated March 9, 2010 of the Prime Minister are no longer suitable to reality. It is recommended that the Ministry of Education and Training preside over, together with the Ministry of Home Affairs and the Ministry of Finance, research and advise on amending or replacing Decision No. 15/2010/QD-TTg dated March 9, 2010 of the Prime Minister.

8. Recommendations to the Ministry of Health

(12) From July 1, 2024, the basic salary will increase to VND 2.34 million/month. Therefore, the family health insurance premium will also increase, while the lives of the majority of people in many places are still difficult. It is recommended that the Ministry of Health study and evaluate to find support solutions or propose to competent authorities to consider and decide to reduce or maintain the health insurance premium for family health insurance participants.
