On November 25, informing reporters of Giao thong Newspaper, Chairman of Hai Duong City People's Committee Nguyen Van Kien said that Chairman of the Provincial People's Committee Le Ngoc Chau has just directed and assigned the City People's Committee to preside over, coordinate, urge and supervise Dai Son One Member Co., Ltd. to dismantle the illegal construction on the land of Hai Duong Traditional Medicine Hospital before December 31, 2024.

Accordingly, the Chairman of Hai Duong Provincial People's Committee requested Hai Duong City People's Committee to focus on thoroughly handling violations at Hai Duong Traditional Medicine Hospital.
If this Company does not dismantle the illegal construction itself, the People's Committee of Hai Duong City will organize the implementation in accordance with regulations, to be completed before January 15, 2025.
At the same time, the leaders of Hai Duong Provincial People's Committee also assigned the Department of Natural Resources and Environment of this province to guide and support Hai Duong Traditional Medicine Hospital to complete the procedures for registering land changes. The provincial police proactively grasp the situation, promptly detect and handle violations according to regulations (if any).
Recently, Giao Thong Newspaper has published many articles related to Dai Son One Member Co., Ltd.'s construction of a cluster of works on the land rented from the Traditional Medicine Hospital (Hai Tan Ward, Hai Duong City) with an area of thousands of square meters.
Hai Duong Traditional Medicine Hospital was assigned by the State without collecting land use fees since 1968, and was granted a land use right certificate in 2001 for 24,409.4m2. During the process of use, the State partially reclaimed the land to build Thanh Nien Street and Yet Kieu Street, so the remaining area is 16,161m2 (including about 4,000m2 of lotus pond).
In late 2011 and early 2012, this hospital submitted a request to the Hai Duong Provincial People's Committee for permission to build and add a number of construction items to better serve the people's medical examination and treatment needs. This request was approved by the Provincial People's Committee with the requirement to use the land for the right purpose, and if joint venture capital is used, the implementation time shall not exceed 2020.
The series of illegal constructions on the land of Hai Duong Traditional Medicine Hospital of Dai Son Company Limited still exists in defiance of legal regulations.
However, in reality, thousands of square meters of land assigned by the Provincial People's Committee, Hai Duong Traditional Medicine Hospital has cut and leased to many organizations and individuals, unrelated to the medical field, and built many projects in violation of state regulations on land management. These violations were pointed out by the Department of Natural Resources and Environment (TN&MT) of Hai Duong province in the inspection conclusion from 2016.
When violations have been pointed out, the correction of violations is very slow. In March 2023, after the Steering Committee for Anti-Corruption and Negativity of Hai Duong province and related departments and branches investigated and issued specific instructions, by August 31, 2023, Hai Duong Traditional Medicine Hospital terminated the contract with 9 individuals and businesses renting at the location adjacent to the sidewalk of Thanh Nien Street. These units complied and dismantled the kiosks and rebuilt the hospital's surrounding wall.
On August 31, 2023, the People's Committee of Hai Duong City issued a decision to enforce remedial measures against Dai Son One Member Co., Ltd. In particular, the company is required to demolish all violating works; the deadline for implementing remedial measures is 15 days, starting from September 1, 2023. If the Company does not demolish them, from October 11 to 20, 2023, the People's Committee of Hai Duong City will organize the forced demolition of violating works.
In December 2023, due to the procrastination of Dai Son LLC, the Hai Duong City People's Committee issued an order to enforce the demolition of the violating constructions against this unit. However, Dai Son LLC continued to request an extension to voluntarily dismantle until February 29, 2024.
After many delays and not voluntarily dismantling the illegal construction cluster that had been on the land of Hai Duong Traditional Medicine Hospital for 10 years, in March 2024, Dai Son One Member Co., Ltd. suddenly submitted a request to the Hai Duong Provincial Party Committee to donate the illegal construction to the hospital for management and use.
On April 4, 2024, departments and branches in Hai Duong sent a document to the People's Committee of this province expressing their views and proposals on the content of the proposal to donate the violating construction of Dai Son One Member Co., Ltd.
Specifically, the Department of Justice and the Department of Planning and Investment clearly affirmed their viewpoint: "The received property must be legal property".
Two units, the Department of Construction and the Inspectorate of Hai Duong province, both have the same opinion of not accepting the proposal of Dai Son Company, requesting the urgent dismantling of the violating construction, ensuring strict implementation of legal regulations and instructions of the Provincial Party Committee and Provincial People's Committee.
The Department of Natural Resources and Environment of Hai Duong stated that, based on current legal regulations and opinions from departments and branches, the Department found that the content proposed by Dai Son Company did not ensure legal basis and was not consistent with the instructions of the Provincial Party Committee and Provincial People's Committee.
From there, the Department of Natural Resources and Environment requested the Provincial People's Committee not to accept the proposal of Dai Son Company, and requested the Hai Duong City People's Committee to urgently direct the dismantling of illegal constructions on the land of the Traditional Medicine Hospital.
