No discipline for party members having third child

(NLDO) - According to new guidelines from the Central Inspection Commission, party members who have a third child or more will no longer be subject to disciplinary action.


The Central Inspection Commission recently issued Instruction 15 amending and supplementing Instruction 05 on implementing Regulation 69 of the Politburo, regarding disciplinary action against violating party organizations and party members. This instruction takes effect from March 20.

According to the new instructions of the Central Inspection Commission, points 8.1 and 8.2, section III in Instruction 05 have been removed. These are the points regulating the consideration and disciplinary action for violations of population policy, including having a third child or more.

The new guidance also adds point 8.3, which states: "Do not consider handling the behavior specified in Clause 2, Article 1 of Ordinance No. 08/2008/PL-UBTVQH12 dated December 27, 2008 amending Article 10 of the 2003 Population Ordinance "Giving birth to one or two children, except in special cases prescribed by the Government".

With this change, from March 20, Party members who have a third child or more will no longer be subject to disciplinary action. Having a third child is also no longer a violation subject to Party disciplinary action.

This is a step to concretize the direction of the Politburo in Official Dispatch No. 13421 dated February 17, after summarizing 7 years of implementing Resolution No. 21 on population work in the new situation.

Previously, at the meeting on February 14, the Politburo considered the proposal of the Central Inspection Commission on reviewing Party regulations related to handling violations of population policy, and the report of the Party Executive Committee of the Health Department on 7 years of implementing Resolution 21 of the 12th Central Committee.

The Politburo assigned the Central Inspection Commission to advise and amend the regulations of the Central Committee, the Politburo, and the Secretariat related to handling violations of population policy and proactively amend Instruction No. 05 dated November 22, 2022 of the Central Inspection Commission, in the direction of not disciplining cases of giving birth to a third child or more.

Not retroactively applying disciplinary measures to cases that have been handled is also a policy agreed upon by the Politburo.

Previously, the Ministry of Health submitted to competent authorities for approval the policy of abolishing regulations on handling violations of population policies that are no longer appropriate, initially abolishing the handling of violations of regulations on the number of children.

According to the Ministry of Health, Vietnam's fertility rate is among the top 5 lowest in Southeast Asia. Specifically, the national fertility rate is trending down below the replacement level, from 2.11 children/woman in 2021 to 2.01 in 2022.

This index continues to decline to 1.96 children/woman in 2023 and 1.91 in 2024 - the lowest in history and is forecast to continue to decline in the following years.
