The draft Law on Defense Industry, Security and Industrial Mobilization (DIC) has been submitted to the National Assembly for comments at the 6th Session of the 15th National Assembly. According to the program, the draft law will be submitted to the National Assembly for consideration and approval at the upcoming 7th Session.

Speaking at the meeting, National Assembly Chairman Vuong Dinh Hue stated that this is a very important Law project. The process of receiving and revising since the 6th Session has added many provisions, including many new, specific and outstanding policies to develop the defense industry and security. Therefore, the explanation, reception, revision and further completion of the draft Law must be very thorough.

“This is an opportunity for us to complete the legal corridor for the development of the defense industry and security in a dual-use direction, closely combining with civilian industry, becoming the spearhead of national industry as determined in Resolution No. 29-NQ/TW of the Central Committee on continuing to promote industrialization and modernization of the country by 2030. This draft law is not only meaningful for the defense industry and security but also for the socio-economic development of the country, especially the consolidation and enhancement of the potential of the defense industry and security in the context that our country is striving to achieve two 100-year development goals,” the National Assembly Chairman emphasized.

Reporting at the meeting, Chairman of the National Defense and Security Committee Le Tan Toi said that at the 6th Session, the bill received 102 comments from National Assembly deputies.

Immediately after the Session, based on the opinions of the National Assembly deputies, the direction of the National Assembly Standing Committee and Vice Chairman of the National Assembly Tran Quang Phuong, the Standing Committee of the National Defense and Security Committee chaired and closely coordinated with the Drafting Committee and relevant agencies to urgently focus on research, organize many working sessions, conduct 3 surveys, 3 in-depth discussions to consult experts, scientists, and practical activists to absorb, explain, and revise the draft Law.

To date, according to the Chairman of the National Defense and Security Committee, the latest draft law consists of 7 chapters and 86 articles. Compared to the draft law submitted to the National Assembly at the 6th Session, the current draft law has added 15 articles and removed 2 articles, added section 7 to Chapter II on the Defense Industry Complex; arranged new sections on the development of defense industry, dual-use security, and policies on science and technology; revised the content and legislative techniques in many articles, and rearranged and restructured a number of articles.

Regarding the newly added points, the Chairman of the National Assembly and Security Committee stated that the Standing Committee of the Committee has closely followed the Conclusion of the National Assembly Standing Committee, the Verification Report and opinions of National Assembly deputies as well as the results of surveys, researched documents, and carefully and thoroughly discussed with the drafting agency and relevant agencies to research and design the content.

At the meeting, delegates focused on discussing and giving specific opinions on new policies added during the process of receiving and revising the bill and on legislative techniques.

Accordingly, all opinions agreed that in order to specifically and fully institutionalize the Party's viewpoints, guidelines and policies on building and developing a self-reliant, dual-use defense and security industry to become the spearhead of national industry, it is necessary to have specific, breakthrough policies to create outstanding and feasible mechanisms to promote the development of defense and security industry.

However, opinions also suggest that it is necessary to continue to review, carefully evaluate, and properly select truly outstanding and feasible policies, especially policies on investment and taxes... to ensure both specificity and consistency in the legal system.

Concluding the meeting, National Assembly Chairman Vuong Dinh Hue highly appreciated the opinions of the delegates at the meeting; acknowledged the efforts, enthusiasm and high responsibility of the Standing Committee of the National Defense and Security Committee in explaining, receiving and revising the draft Law, in which it studied and proposed to add many new policies, surpassing the draft Law submitted to the National Assembly for comments at the 6th Session, in order to institutionalize the Party's viewpoints and policies on this field as well as on the strategy of building and protecting the Fatherland in the new situation.

The National Assembly Chairman agreed that this is a difficult bill because the “original” law on national industry does not yet exist; the two Ordinances on National Defense Industry and National Defense Forces have been issued for a long time, and many regulations are no longer suitable for practical requirements and the new viewpoints and policies of the Party. Therefore, this bill is unlikely to specify all the contents in detail, but it should be accepted that there will be regulations of a principled and framework nature to serve as a basis for more specific regulations in related laws or detailed instructions in sub-law documents.

In that spirit, the National Assembly Chairman requested the National Defense and Security Committee to preside over and continue to closely coordinate with the Ministry of National Defense, the Ministry of Public Security, the National Assembly Committees and relevant ministries and branches to fully absorb opinions at the meeting, explain satisfactorily, and select the optimal solution to continue perfecting the draft Law.
