A Facebook account named NCT posted: “100% new house source in Tan Uyen, need to sell 2 houses with shared title, 1st floor, 1st ground floor in the center of Thai Hoa ward, Tan Uyen city. Small house area 40m², large house area 53m², 100% residential land. All are designed with 1st floor, 3 bedrooms, 2 bathrooms, price from 1.1 billion to 1.3 billion VND/house”.

Similarly, many other accounts posted the same way as above and said that this house with a shared title is located near Ong Cu Temple Intersection, 3km from An Phu Roundabout, in Thai Hoa Ward. To better understand the type of house being advertised for sale, the group of reporters went into the real world, posing as customers, and were introduced by the broker: These are houses with a shared title and bought and sold by handwritten documents, notarized documents, many people jointly own a title and naturally, the investor will own this title.

In an interview with Nguoi Dua Tin reporter, a customer named TNT (residing in Binh Duong province) said: "After looking up some information on Facebook about the above-mentioned house for sale, I contacted and was introduced to a house under construction in Thai Hoa ward.

I asked about the related documents, and the broker provided me with the red book and construction permit. When I looked through the documents, I discovered many suspicious and unusual points. The construction was not the same as the construction permit provided by the investor. When I asked about the above difference, the investor affirmed that it was okay, when buying, they would make a handwritten paper and a notarized rental contract at the ward to make the documents.

These people even boasted: “Don’t worry, we know all the authorities here, it’s okay,” when talking about the legality of this type of house with a shared title. On the other hand, the selling price of 1.1 – 1.3 billion VND/unit for this type of house is very high, because it is for rent.

Circumventing the law to build "shared house"

In fact, on the license issued (No. 39) dated January 17, 2023 signed by Vice Chairman of Tan Uyen Town People's Committee (now Tan Uyen City) Huynh Van Loi, this is the land area located on plots No. 346, 351, 394, 395, 396, 437, 438, 439, 440 on map No. 6, Phuoc Hai Quarter, Thai Hoa Ward, under the name of Mr. Nguyen Sy Thang, born in 1972, permanent residence in Khang Village, Thach Liem Commune, Thach Ha District, Ha Tinh Province. The purpose of these plots of land is to grow perennial trees, recently converted to residential land, with permission to build 59-room townhouses - level 3, for the purpose of renting houses.

According to this construction permit, Mr. Thang is allowed to build 6 items: Room Block A (13 rooms), Room Block B (3 rooms), Room Block C (7 rooms), Room Block B (8 rooms), Room Block E (14 rooms), Room Block F (14 rooms). All are built including the 1st floor and mezzanine.

As can be seen, each licensed room block consists of 1 ground floor and 1 mezzanine, with different areas. Typically, Room Block A consists of 13 rooms, with a first floor area of ​​556m², a mezzanine of 320m², a total floor area of ​​more than 880m². Or Block B has a first floor construction area of ​​116m², a mezzanine of nearly 7m², a total floor area of ​​nearly 187m². Similarly, Block C has a first floor construction area of ​​336m², a mezzanine of 193.4m², and the other blocks are similar.

These are actually rental rooms, in accordance with the approved license and the land use purpose on the red book issued to Mr. Thang on December 27, 2022, with a total area of ​​more than 4,000m². Thus, compared to the approved construction permit (building a house with 1 ground floor and 1 mezzanine), Mr. Thang now deliberately built 1 ground floor and 1 upper floor.

If customers buy this type of "shared house", the risk is very high, especially the legal penalty of the project - when the construction permit is for building rooms for rent, but absolutely not for building houses. Buying a house but signing a rental contract is no different than the customer holding a "knife blade". Second, buying a house with shared ownership is actually buying a room for rent, while the book is in Mr. Thang's name. If Mr. Thang mortgages it to the bank or for some other reason, the customer who buys the house can only... cry.

Regarding these contents, the group of reporters is contacting the authorities to get answers. Is there or is there not an investor who blatantly turns "rental houses" into houses for sale to customers, posing many potential risks and consequences later?

Will the functional sectors and especially the People's Committee of Tan Uyen City legalize the violations at these "shared houses"? If so, it will form "slum" residential areas right in Tan Uyen City, which will be very complicated and difficult to handle the consequences later.
