Ministry of Finance: Old land price list will be applied until the end of 2025

The information was provided by the Ministry of Finance in a document on the implementation of the provisions of the 2024 Land Law, which has just been sent to ministries, ministerial-level agencies, government agencies, other central agencies and People's Committees of provinces and centrally run cities.

Apply old land price list, adjust when necessary

Regarding the issue of handling the transition to apply the land price list, the Ministry of Finance affirmed: The land price list issued by the Provincial People's Committee according to the provisions of the 2013 Land Law will continue to be applied until December 31, 2025.

If necessary, the Provincial People's Committee shall decide to adjust the land price list according to the provisions of this law to suit the actual situation of land prices in the locality.

The procedure for adjusting the land price list, if any, will be implemented according to the provisions of Article 17, Decree No. 71/2024/ND-CP regulating land prices (Decree 71).

Accordingly, the Department of Natural Resources and Environment selects an organization to conduct land valuation to develop a land price list in accordance with the provisions of the law on bidding.

In case at the time of bidding, no bidder participates, the deadline will be extended once. After the deadline is extended but no bidder is selected, the Department of Natural Resources and Environment will assign the task to a public service unit that is qualified to provide consultancy on land valuation.

Next, the organization conducting land valuation adjusts the land price list according to Article 14 of Decree 71.

Steps to perform land valuation:

Step 1: Investigate, survey, and collect information to serve the construction of land price tables by area and location; construction of land price tables for each plot of land based on value areas and standard plots of land.

Step 2: Determine land type, area, land location in each commune, ward, and town for the area to build land price list by area and location; determine land type, total number of land plots, number of land plots of each land type for the area to build land price list for each land plot based on value area, standard land plot.

Step 3: Synthesize and complete the records of investigation results, surveys, and information collection at commune, district, and provincial levels; analyze and evaluate the results of implementing the current land price list for the construction of land price lists by area and location.

Step 4: Synthesize the results of investigation, survey, information collection; establish value zones; select standard land plots and determine prices for standard land plots; create a comparison ratio table for building land price tables for each land plot based on value zones and standard land plots.

Step 5: Develop a draft land price list and a draft report explaining the development of the land price list.

After that, the Department of Natural Resources and Environment is responsible for drafting a submission on the issuance of the land price list and collecting opinions from relevant agencies, organizations and individuals.

Receive and complete the submission on the issuance of land price list, complete the draft land price list and explanatory report on the construction of the land price list, and submit it to the land price list appraisal council.

The Land Price Appraisal Council conducts the appraisal of the land price list and sends the appraisal document to the Department of Natural Resources and Environment.

The Department of Natural Resources and Environment shall receive, explain, edit and complete the draft land price list, and submit it to the Provincial People's Committee for decision on adjusting the land price list.

Removing obstacles for land allocation projects before August 1

The Ministry of Finance also said that up to now, the Government has issued Decree 103/2024/ND-CP regulating land use fees and land rents, and Decree 104/2024/ND-CP regulating land development funds.

Including regulations on calculation, collection, payment, exemption and reduction of land use fees, land rent, organization, operation and financial mechanism of land development funds; transitional handling of land use fees, land rent for cases that have been allocated land before the effective date of the 2024 Land Law (August 1, 2024).

Previously, Article 257 of the 2024 Land Law stipulated: The land price list issued by the Provincial People's Committee in accordance with the provisions of the 2013 Land Law shall continue to be applied until December 31, 2025. If necessary, the Provincial People's Committee shall decide to adjust the land price list in accordance with the provisions of this law to suit the actual situation of land prices in the locality.
