On the morning of June 26, under the direction of Vice Chairman of the National Assembly Nguyen Duc Hai, the National Assembly voted to pass the Resolution of the National Assembly on piloting the addition of a number of specific mechanisms and policies for the development of Nghe An province; Voting to pass the Resolution of the National Assembly on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city.
The National Assembly voted to pass the National Assembly Resolution on the organization of urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city.
As a result, 93% of delegates voted in favor (452/459) of passing the Resolution on organizing urban government and piloting a number of specific mechanisms and policies for the development of Da Nang city.
Presenting the Report at the Session, Chairman of the National Assembly's Finance and Budget Committee Le Quang Manh said that on May 31, 2024 and June 7, 2024, the National Assembly discussed in Groups and Halls the draft Resolution of the National Assembly on the organization of urban government and piloting a number of mechanisms and policies for the development of Da Nang City. Based on the opinions of National Assembly deputies, the National Assembly Standing Committee issued Report No. 890/BC-UBTVQH15 explaining, accepting and revising the draft Resolution and sending it to National Assembly deputies.
Regarding the scope of the Resolution, taking into account the opinions of National Assembly deputies, the National Assembly Standing Committee directed the reviewing agency to coordinate with the Drafting Committee to carefully review the policies in the draft Resolution, avoiding creating legal conflicts and difficulties in implementation.
The Standing Committee of the National Assembly also believes that policy formulation must be cautious, only regulating "ripe and clear" contents, not regulating issues that have not been thoroughly evaluated. Therefore, at the present time, the Standing Committee of the National Assembly believes that the scope of policy expressed in the draft Resolution is appropriate.
Regarding the content on investment management (Article 9), Chairman of the National Assembly's Finance and Budget Committee Le Quang Manh said that in order to promptly remove difficulties and obstacles for localities and increase resources for local budgets, the National Assembly Standing Committee believes that the provisions in the draft Resolution are appropriate.
Regarding financial management - State budget (Article 10), accepting the opinions of many National Assembly deputies, the National Assembly Standing Committee revised in the direction of stipulating that the total outstanding loan balance shall not exceed 80% of the City's budget revenue according to decentralization.
Regarding the pilot establishment of a Free Trade Zone (Article 13), the Standing Committee of the National Assembly found that the pilot establishment of a Free Trade Zone is a major policy with sufficient political and legal basis; if successfully implemented, it will create a premise to promote the socio-economic development of Da Nang city and the whole region.
However, this is a new policy that has not been implemented in Vietnam. The Resolution is of a pilot nature; the policies are a trial step, and we will learn from experience while doing it to gradually improve it. Therefore, we need to be cautious, take firm steps, and not regulate issues that have not been thoroughly evaluated and are highly risky. Furthermore, the policies need to be researched and developed based on the implementation capacity, financial resources, and meeting conditions of Da Nang city. Therefore, at present, the National Assembly Standing Committee maintains the policy scope as in the draft Resolution.
Regarding investment in the development of microchips, semiconductors, artificial intelligence, and innovation (Article 14), the Standing Committee of the National Assembly believes that, in order to encourage individuals and organizations to participate in controlled testing, it is necessary to have regulations on exemption from liability in controlled testing, ensuring the feasibility of implementing the policy on controlled testing in practice.
However, to ensure specificity, reasonableness and benefits for other organizations and individuals when they suffer damage, the National Assembly Standing Committee supplements the content in Clause 5, Article 14 in the direction of clearly stipulating that civil liability in controlled testing is only exempted when damage or risk occurs to the State due to objective reasons and when the testing procedures and regulations have been fully implemented. For damage or risk caused to other organizations and individuals, the testing organization, enterprise or individual must compensate according to the provisions of law.
Based on the practical situation, the City People's Council shall consider and support a part of the compensation cost from the city budget based on the nature, extent of damage, and the ability to balance the local budget. Regarding the addition of provisions on exemption from criminal liability, it shall be implemented in accordance with the provisions of relevant current laws.
In addition to the above issues, the National Assembly Standing Committee also directed the Verification Agency and the Drafting Agency to seriously and fully absorb the valid opinions of National Assembly deputies on both content and legislative techniques, specifically reflected in the draft Resolution to submit to the National Assembly for consideration and approval at this Session.
