Change many investors
In 2012, the People's Committee of Quang Ngai province had a policy to invest in the Chu Van An road project (section from Hung Vuong to Hai Ba Trung) and Nam Hai Ba Trung residential area with a total investment of about 320 billion VND.
The two projects are being implemented in parallel because the province wants to build an administrative center along the Tra Khuc river, so it is necessary to plan the Nam Hai Ba Trung residential area to serve resettlement and open roads for convenient traffic, creating land funds.
In 2013, the province assigned Quang Ngai City to develop a 1/500 construction plan for the above area and implement two projects. However, in 2015, the province assigned Quang Ngai Investment, Construction and Service Trading Company Limited (QISC) as the investor.
In 2016, the province approved the investment decision for the extended Chu Van An road and residential area with a total capital of more than 300 billion VND, 876m long. 3 years later, the Chairman of the Provincial People's Committee agreed to let the investor split the project into 2 parts.
Specifically, the southern section is nearly 500m long and the residential area is nearly 1ha (from Hung Vuong Street to Ngo Sy Lien Street), with a total capital of nearly 100 billion VND, invested by the People's Committee of Quang Ngai City; the northern section is 376m long and the residential area is 6.7ha (from Ngo Sy Lien Street to Hai Ba Trung Street) invested by QISC; with a total capital of more than 220 billion VND, from land fund capital.
However, due to lack of resources, the investor has not yet built the southern section. For the northern section, QISC has only been able to carry out part of the compensation, support and resettlement work.
In 2020, Quang Ngai province once again transferred the project to Quang Ngai City as the investor (construction of the section from Ngo Sy Lien to Hai Ba Trung). The Nam Hai Ba Trung residential area project was assigned to the Department of Natural Resources and Environment as the investor, then transferred to the People's Committee of Quang Ngai City.
For the road project, Quang Ngai City divided the project into 10 packages, including 2 construction packages. By the end of 2023, the contractor had only completed about 150m of road surface. After reviewing the compensation records, many problems were discovered, so the People's Committee of Quang Ngai City stopped implementing the project on site.
For a long time, the project was left unfinished, people in the project area and traffic participants had to endure the sun, dust, rain and mud. Many households that were to be relocated have not been given resettlement land or compensation.
Because only a small part of the construction has been completed, the extended Chu Van An road has been completed with a width of 27m, but when entering the residential area, the road surface is only 3m, creating a bottleneck. This has limited the ability to move from Thach Bich bridge (across Tra Khuc river) to the center of Quang Ngai city.
Worried about the risk of traffic safety, people bought iron to make barriers to prevent large trucks from passing and put up warning signs. At the same time, they hoped that the relevant agencies would soon restart and complete the project because they had waited too long.
"This road has been planned since my grandchild was a child. Now he is in college and it is not finished yet. It is dusty in the dry season and flooded in the rainy season" - Ms. Nguyen Thi Du (a resident living near the project) was upset.
According to the People's Committee of Quang Ngai province, the goal of the Chu Van An extended road project is to connect the core area of Quang Ngai city with the northern bank of Tra Khuc river, especially promoting the effectiveness of the Thach Bich bridge project. However, after nearly 12 years since the policy was issued and 9 years of launching, the project has not yet reached its completion date.
The reason for the project's delay is due to problems with compensation, site clearance and some other reasons. Up to now, the project has only established and approved 5 compensation, support and resettlement plans, paying money to 56/90 households with a value of more than 23.5/33.7 billion VND.
Many households have problems with the agricultural land support coefficient, land use fee payment unit price (the land allocation decision is not at the same time as the approval of the compensation, support and resettlement plan)...
A series of violations
According to the conclusion of the Quang Ngai Provincial Inspectorate issued in March 2024, the transfer of the project from the Quang Ngai City People's Committee to QISC Company as the investor of the residential area project in the South of Hai Ba Trung and the Chu Van An road project (section from Hung Vuong to Hai Ba Trung) by the Chairman of the Provincial People's Committee is without legal basis and is not in accordance with the functions and tasks of the Company.
Because, according to the organization and operation charter, there is no regulation allowing QISC Company to be assigned to manage and use State budget capital to invest in and construct works and residential areas that the Company will later manage and exploit.
QISC organized the compensation plan itself but lacked experience and expertise, leading to delays in compensation work, so the project progress was not on schedule and had to be adjusted.
At the same time, QISC Company, the investor from 2015 to 2020, did not have the capacity to manage and implement the project; did not have the expertise in preparing compensation and resettlement plans to implement the project, leading to many violations.
For the southern project of nearly 500m and the residential area of nearly 1ha (from Hung Vuong Street to Ngo Sy Lien Street), the results of the inspection team's actual site inspection showed that, previously, QISC carried out the work of preparing compensation and resettlement support plans not in the form of each area but in a discrete form within the total planning area.
The area of land recovered by households has received compensation, the investor has not yet received the land handover. The entire area of land recovered by households is being managed and used.
QISC Company, Provincial Land Fund Development Center, Quang Ngai City Land Fund Development and Investment Management Board lacked coordination and were not determined in implementing the project, leading to the project not being completed.
The conclusion of the Quang Ngai Provincial Inspectorate also pointed out many other reasons for the delay of the project such as: the project is located in an urban area, there is no separate resettlement construction, but during the implementation process, the investor did not demarcate the resettlement area on site, to focus on building infrastructure.
At the same time, the violation of not handing over resettlement land at the same time as land recovery caused shortcomings in law enforcement under the responsibility of QISC and the People's Committee of Quang Ngai City, leaving behind both legal and practical consequences that must be overcome in the coming time for 99 plots of land that were previously handed over to people on the subdivision planning map, without a land allocation decision issued.
Quang Ngai Provincial Inspectorate has proposed applying measures to correct violations in compensation, support and resettlement work to ensure accuracy and avoid budget loss; at the same time, organizing reviews and handling responsibilities of related organizations and individuals.
As for the Nam Hai Ba Trung residential area project, up to now, it has only established a plan for compensation, support, resettlement and recovery for 7 hectares out of nearly 11.5 hectares and has not been implemented in the field because violations were discovered.
