Hotel says no re-renting Nha Trang beach

"In our hotel chain, if guests have a need, we will support them to use the beach opposite the hotel," said the male receptionist.

According to this person, hotels must have a negotiated plan approved by the Nha Trang City People's Committee before the Public Service Management Board can sign a beach lease contract, and the rental price is calculated according to the land price issued by the Provincial People's Committee.
The leader of the Nha Trang City Public Service Management Board also admitted to facing many difficulties in managing hotels operating tourism businesses on the beach.
"When the inspection team came to check, the hotels said this person was an employee and paid a salary. All the hotels said that, so it was very difficult to check," he said.
To closely monitor beach rentals, the leader of the Nha Trang City Public Service Management Board said that in addition to increasing inspections, in the coming time, the unit will attach logos of hotels renting beaches and the logo of Nha Trang City to umbrellas for monitoring, and will also add some content to the contract to bind hotels if there are violations.
Lawyer Tran Thi Thanh Thao (Ho Chi Minh City Bar Association) said that in terms of legal nature, beach leasing and subleasing of beach usage rights are classified as non-transferable rights.
According to lawyers, legally, the certificate of land use rights is not transferred, but only the right to exploit and use the land use rights of the lessor or sub-lessee to the lessee or sub-lessee for a period of time. The lessee or sub-lessee must use the land use rights for the right purpose, pay the rent and return the land use rights when the land use term expires.
"If the contract between the government and the hotel has a clause allowing the hotel (lessee) to sublease the beach to another individual, then it is in accordance with the regulations. If it is not in the contract and is implemented, it is wrong," said the lawyer.
