On the afternoon of May 22, 2024, continuing the 7th Session Program, under the chairmanship of National Assembly Chairman Tran Thanh Man, the National Assembly discussed in plenary session in the hall on a number of contents with different opinions of the draft Law on Road Traffic Order and Safety (TTATGT).
The draft law consists of 9 chapters and 89 articles.
Presenting the Report at the meeting hall, Chairman of the National Defense and Security Committee (NDSC) of the National Assembly Le Tan Toi affirmed: At the 6th Session of the 15th National Assembly, National Assembly Deputies (NADs) discussed and gave opinions on the draft Law on Road Traffic Safety. Based on the opinions of the NADs, the National Assembly Standing Committee (NASC) directed the Standing Committee of the NDSC to coordinate with the drafting agency, the NA agencies and relevant agencies to study, explain, receive, and revise the draft Law and develop a draft Report on explanation, reception and revision.
Compared to the draft Law submitted to the National Assembly at the 6th Session, the draft Law that has been accepted and revised has 9 chapters and 89 articles, the number of chapters remains the same and increases by 8 articles due to the addition of 5 new articles, merging 4 articles into 2 articles, separating the content of some articles into 5 other articles; the Standing Committee of the National Assembly has directed the revision of the content of 79 articles, keeping the content of 2 articles unchanged (Article 33 and Article 54). The draft Law after being accepted and revised achieved high consensus between the Standing Committee of the National Assembly and the Government.
Regarding the prohibition of driving a vehicle on the road with alcohol in the blood or breath, the majority of National Assembly deputies agreed with the draft Law; some National Assembly deputies proposed to set a minimum limit for alcohol in the blood and breath for drivers.

Regarding this content, the Standing Committee of the National Assembly has specifically and clearly analyzed the advantages and limitations of each option to report to the Conference of full-time National Assembly Deputies and sent it to request opinions from National Assembly Delegations, National Assembly agencies, and relevant agencies.
"Most opinions agreed and had specific comments on the Proposal to prohibit "driving a vehicle on the road with alcohol concentration in the blood or breath". The Standing Committee of the National Assembly agreed with the draft Law and most of the above opinions to protect the lives, health, and property of the people, protect resources for society, and protect the longevity of the race" - Chairman of the National Defense and Security Committee Le Tan Toi explained and proposed that the National Assembly keep this provision in Clause 2, Article 10 of the draft Law that has been accepted and revised.
Legalizing the regulation of vehicle license plate auction is very necessary.
Regarding the auction of license plates, the Standing Committee of the National Assembly found that, after the initial period of implementing Resolution No. 73 of the National Assembly on piloting the auction of license plates of automobiles, important results have been achieved, meeting the needs of the people, increasing revenue for the State budget, creating publicity and transparency in the registration and management of license plates of automobiles, and receiving great attention, agreement and support from public opinion.
"The legalization of the provisions of Resolution No. 73 into the draft Law on Road Traffic Safety is very necessary, combined with the issuance and management of license plates according to the vehicle owner's identification code, contributing to reforming administrative procedures, reducing the number of documents when registering, vehicle registration work, meeting the goals of digital citizens and digital government. Expanding the auction of license plates for transport business vehicles and motorbikes is suitable for the needs of a large number of people who want to have license plates of their choice," the Chairman of the National Traffic Safety Committee analyzed.

However, because the draft Law on Road Traffic Safety and the draft Law amending and supplementing a number of articles of the Law on Property Auction will be passed by the National Assembly in the same 7th Session, the Standing Committee of the National Assembly has directed the development of 2 options to send to the National Assembly delegations, agencies of the National Assembly, and relevant agencies for comments. "The majority of opinions agree and have specific comments on the option of adding one article to this draft Law to ensure compliance with the scope of regulation, which will fully and specifically regulate the contents of vehicle license plate auctions and create consistency with other provisions in the draft Law on Road Traffic Safety," he informed.
A driver's license has 12 points. If all points are deducted, a road traffic safety knowledge test must be taken to restore them.
Regarding driving license classes, according to the Chairman of the National Defense and Security Committee, some National Assembly deputies proposed to specify the driving license classes in the Law, not assigning the Government to specify the details; at the same time, they proposed to specify the classes in accordance with the international treaties of which Vietnam is a member.

In response to the opinions of the National Assembly Deputies, the National Assembly Standing Committee directed the development of regulations on driving license categories in Clause 1, Article 57 in the direction of inheriting the current regulations of the 2008 Road Traffic Law, classifying them to ensure compliance with the provisions of the 1968 Vienna Convention on Road Traffic; at the same time, adding a transitional provision stipulating that types of driving licenses issued under the 2008 Road Traffic Law that are still valid are still valid; in case of re-issuance, they will be issued according to the provisions of this Law, so as not to disrupt and affect the rights of those who have been granted a driving license.
Regarding driving license points, many National Assembly deputies proposed adding regulations on points and deductions from driving licenses to raise drivers' awareness.
In response to the opinions of the National Assembly Deputies, the Standing Committee of the National Assembly has directed the development of Article 58 on points for driving licenses. Adding regulations on points and deduction of points for driving licenses is a civilized and modern management measure, in line with the policy of developing the digital economy and digital society of our country. This regulation will impact behavior, raise awareness of traffic participants, and help management agencies comprehensively monitor the driver's compliance process after violations.

"Drivers who violate the law, depending on the nature and severity of the violation, may have their driving license points deducted, and within 12 months, no points will be deducted. While they still have points, all 12 points will be restored. In case all points are deducted, the person granted a driving license must participate in a test of knowledge of road traffic safety laws.
