In addition, additional regulations on search and rescue activities for incidents and accidents occurring in daily life that have direct impacts, limit human rights, civil rights and according to the provisions of the 2013 Constitution must be stipulated in legal documents. Thereby, ensuring the legal basis in accordance with the provisions of the Constitution for the Fire Prevention and Rescue Police force to perform its duties, ensuring the rights and legitimate interests of the people, protecting human rights and civil rights.
At the same time, it meets objective practical requirements and overcomes limitations, difficulties and inadequacies of current laws, ensuring consistency and unity of the legal system; strengthening state management of fire prevention and fighting in the new situation.

The Draft Law consists of 9 chapters and 65 articles, of which Chapter II on fire prevention (including 9 articles) in addition to inheriting has added new regulations to overcome current difficulties and shortcomings and meet practical requirements on fire prevention activities; more specifically stipulates responsibilities and requirements in investment, production and business activities to ensure fire prevention safety conditions and further enhance requirements and responsibilities in the management, supply and use of electricity and electrical equipment related to fire and explosion.
"The draft Law has removed the contents that are currently stipulated in legal documents or in relevant technical standards and regulations to ensure consistency and unity of the legal system," Minister Luong Tam Quang added.

Chapter IV on Search and Rescue (consisting of 7 articles), stipulates: Scope of search and rescue activities of the fire prevention and rescue force; search and rescue organization; rights and responsibilities of the search and rescue commander; mobilization of forces, means and assets to participate in search and rescue; development and practice of search and rescue plans; responsibility for search and rescue; priority and ensuring priority for forces and means participating in search and rescue.
In Chapter V on the construction, arrangement of forces, and tasks of the fire prevention and fighting and search and rescue force (including 6 Articles), the draft Law, on the basis of inheriting the provisions of the current Fire Prevention and Fighting Law, still promotes its value to continue to regulate to meet practical requirements; at the same time, it has revised and supplemented the provisions related to the construction, arrangement of forces, and tasks of the fire prevention and fighting and search and rescue force to suit practical requirements, ensuring feasibility, synchronization, and unity of the legal system...
Through the examination, the National Defense and Security Committee (NDSC) basically agreed on the necessity of promulgating the Law on Fire Prevention and Fighting and Search and Rescue for the reasons stated by the Government in the Submission and believed that the development and promulgation of the Law aims to fully institutionalize the Party's policies and guidelines on fire prevention and fighting and search and rescue; legalize current regulations and supplement full and comprehensive regulations on search and rescue activities that the fire prevention and fighting and search and rescue forces are assigned to undertake, in order to create a solid legal basis to improve the effectiveness of this work in practice. At the same time, promptly overcome existing limitations and shortcomings, ensure the consistency and unity of the legal system and strengthen state management of fire prevention and fighting and search and rescue in the new situation.
"At the 32nd session (April 15, 2024), the National Assembly Standing Committee voted to pass Resolution No. 45, adding the Fire Prevention and Fighting and Rescue Law Project to the 2024 Law and Ordinance Development Program, to be submitted to the National Assembly at the 7th Session (May 2024). This is an important legal basis to affirm the necessity and the basis for the Government to develop this Law project" - Chairman of the National Assembly Standing Committee Le Tan Toi emphasized.
