Deputy Head of the Office of the President Pham Thanh Ha; Lieutenant General Le Quoc Hung, Deputy Minister of Public Security; Deputy Minister of Foreign Affairs Ha Kim Ngoc; Permanent Deputy Chief Justice of the Supreme People's Court Nguyen Tri Tue chaired the press conference.

Also attending were representatives of a number of relevant ministries and branches, along with a large number of reporters from domestic and foreign press agencies stationed in Vietnam.

Humanistic imprint

Deputy Head of the Office of the President Pham Thanh Ha said that amnesty is one of the legal institutions stipulated in Article 88 of the Constitution of the Socialist Republic of Vietnam, institutionalized by the 2018 Amnesty Law (formerly the 2007 Amnesty Law).

From 2009 to present, the Socialist Republic of Vietnam has carried out 9 amnesties on important events and national holidays, amnestying more than 92,000 prisoners who have had good reform, work and study processes and returned to the community and society.

The results of the amnesty rounds have ensured political, legal, professional and foreign affairs requirements; received the support of the people at home and high appreciation from international public opinion; and continued to affirm the consistent policy of the Party and State of Vietnam in promoting and protecting human rights in a fair and equal manner for all citizens, including those serving prison sentences.

"With the President's amnesty decisions, tens of thousands of people have enjoyed the joy of clemency, soon returned to reunite with their families, and are ready to rebuild their lives. Most of the amnestied people have returned to their places of residence, stabilized their lives, and worked honestly. The rate of amnestied people reoffending is very low. That is the greatest humane mark of the amnesty policy, clearly reflecting the priority of ensuring and promoting human rights in all policies of the Party and State of the Socialist Republic of Vietnam," Mr. Pham Thanh Ha emphasized.

Based on the humane tradition of the nation and the lenient policy of the Party and State of Vietnam towards criminals as well as the results of the implementation of amnesty work, the actual situation of the execution of prison sentences in the past time; at the request of the Government, on July 30, 2024, President of the Socialist Republic of Vietnam To Lam signed Decision No. 758/2024/QD-CTN on amnesty in 2024, on the occasion of the 79th anniversary of the National Day of the Socialist Republic of Vietnam (September 2, 2024) and the 70th anniversary of the Liberation of the Capital (October 10, 2024).

The Deputy Head of the Office of the President announced Decision No. 758/2024/QD-CTN on amnesty in 2024. Accordingly, the time served in prison for consideration of amnesty is calculated up to September 30, 2024. The subjects eligible for amnesty include: People serving a fixed-term prison sentence, people sentenced to life imprisonment that has been reduced to a fixed-term prison sentence, and people whose prison sentence is temporarily suspended.

Regarding the conditions for being proposed for amnesty, a person who is serving a fixed-term prison sentence or has been sentenced to life imprisonment which has been reduced to a fixed-term prison sentence and is proposed for amnesty must meet the following conditions: Have made progress, have a good sense of reform, and be classified as having served the prison sentence fairly or well according to regulations; have served at least half of the prison sentence for a fixed-term prison sentence; have completed the additional penalty of a fine, have paid court fees; have completed the obligation to return property, compensate for damages, and other civil obligations for people sentenced to prison for corruption crimes...

People sentenced to a fixed-term prison sentence who have served at least one-third of the time, people sentenced to life imprisonment that has been reduced to a fixed-term prison sentence and have served at least 13 years can also be proposed for amnesty when: They have made great contributions during the time of serving their prison sentence; people who have contributed to the revolution; people who are suffering from serious illnesses or are frequently ill; people who are 70 years old or older; people whose family circumstances are especially difficult and who are the sole breadwinner in their family...

The President's decision also clearly states that 15 cases are not eligible for amnesty, such as: Being sentenced to prison for treason; activities aimed at overthrowing the people's government; espionage; violating territorial security; rioting; terrorism against the people's government; having been previously granted amnesty; having 2 or more criminal records...

Regarding amnesty in special cases, the Government shall preside over and coordinate with the Supreme People's Court, the Supreme People's Procuracy and relevant agencies and organizations to prepare dossiers of persons proposed for amnesty in special cases to submit to the President for consideration and decision.

Comply with the principles of implementing amnesty

At the press conference, answering questions from the press, Deputy Minister of Foreign Affairs Ha Kim Ngoc said that according to the announcement of the authorities, there are currently 643 prisoners of foreign nationality serving their sentences in detention facilities in Vietnam. After reviewing the records, the Vietnamese authorities will have a specific announcement on the number of prisoners of foreign nationality to be pardoned this time.

Deputy Minister Ha Kim Ngoc added that in the 2022 amnesty, 16 prisoners of foreign nationality were granted amnesty. Previously, in 2021, 21 prisoners of foreign nationality were granted amnesty.

Regarding this content, Lieutenant General Le Quoc Hung, Deputy Minister of Public Security, said: "After the authorities, specifically the detention facilities nationwide, review and apply the conditions and standards for amnesty according to the President's Decision in 2024, the specific number will be announced on the mass media. At the same time, reporters can also contact the Department of Police for management of detention camps, compulsory education facilities, and reform schools of the Ministry of Public Security to get specific numbers," Lieutenant General Le Quoc Hung said; at the same time, he confirmed that there are currently 643 prisoners of foreign nationality serving their sentences at the detention facilities of the Ministry of Public Security.

Regarding the question of whether "former Chairman of Hanoi People's Committee Chu Ngoc Anh is eligible for amnesty this time or not," the Deputy Minister of Public Security said that Mr. Chu Ngoc Anh is a prisoner serving his sentence at the Ministry of Public Security's detention facility; is treated equally like all other prisoners; is considered, and if eligible, will be granted amnesty.

"The President's Decision was just announced today. Only after reviewing each prisoner's rehabilitation records will we know whether or not they are eligible for amnesty," said the Deputy Minister of Public Security.

Responding to reporters' questions about the number and conditions for corruption criminals to be granted amnesty, Deputy Minister Le Quoc Hung said that according to the President's Decision on amnesty in 2024, one of the principles for implementing amnesty is to comply with the Constitution and laws, ensuring fairness, objectivity, publicity and transparency.

"All those sentenced to prison for corruption must have completed the additional penalty of a fine, paid court fees, fulfilled their obligations to return property and compensate for damages, and other civil obligations, and meet the conditions under Decision No. 758/2024/QD-CTN on amnesty in 2024, and are eligible for amnesty this time. The specific number will be announced on the occasion of National Day this year," said the Deputy Minister of Public Security.
