On July 11, 2023, the Department of Trade Defense, Ministry of Industry and Trade held a conference to review the work of the first 6 months of the year and plan to deploy tasks for the last 6 months of 2023.
Reporting at the Conference, Director of the Department of Trade Defense, Ministry of Industry and Trade - Mr. Trinh Anh Tuan said that in the first 6 months of the year, in the context of economic and social difficulties, however, overcoming the challenges, the Department of Trade Defense proactively implemented the tasks and expertise according to the functions assigned by the Ministry of Industry and Trade.

Specifically, regarding the drafting of legal documents, the Trade Defense Department has advised and proposed to amend and supplement Circular 37/2019/TT-BCT dated November 29, 2019 of the Minister of Industry and Trade detailing a number of contents on trade defense measures. " Up to now, the Department has submitted to the Ministry's leaders a decision to establish a drafting team. It is expected that by the end of September 2023, the Department will submit to the Ministry's leaders to issue an amended and supplemented Circular, " said Mr. Trinh Anh Tuan.
In addition, according to the leader of the Trade Defense Department, the Department has continued to implement 3 level 4 administrative procedures according to Decision No. 1573/QD-BCT dated June 15, 2021 of the Ministry of Industry and Trade, including: Procedures for declaring imports of goods subject to investigation and application of trade defense measures to serve the investigation; Procedures for exemption from application of trade defense measures; Procedures for supplementing the quantity of goods exempted from application of trade defense measures.
In the first 6 months of the year, the Trade Defense Department has been consulting and coordinating with the lead unit to develop a plan for negotiating Free Trade Agreements (FTAs). Regarding the investigation and application of trade defense measures, the Department has received and processed 4 dossiers of requests for investigation and application of trade defense measures.
Regarding the investigation into the application of anti-dumping measures, on February 13, 2023, the Department of Trade Defense submitted to the Ministry of Industry and Trade to issue Decision 235/QD-BCT to officially apply anti-dumping measures to furniture products from China and Malaysia. " At the same time, the Department continues to conduct annual reviews of new exporters and exporters, including submitting to the leaders of the Ministry 3 decisions to review new importers... " - Mr. Trinh Anh Tuan said.

Regarding the response to foreign investigations, Mr. Trinh Anh Tuan emphasized that in the first 6 months of 2023, the Trade Defense Department has coordinated with units under relevant ministries and branches to systematically deploy a series of activities such as: Early warning of goods at risk of being investigated by foreign countries for trade defense, preventing evasion of trade defense; supporting manufacturing and exporting enterprises in handling and responding to specific trade defense cases; participating in providing and explaining policies of the Vietnamese Government accused of subsidizing; participating in legal responses to violations and potential violations of international commitments by foreign investigation agencies; conducting dispute resolution activities at the WTO; implementing international cooperation activities to contribute to improving the capacity to resist trade defense lawsuits.
In addition, the Department continues to support businesses in handling cases initiated in previous years. Some cases have had preliminary or final conclusions in the first 6 months of 2023.
According to Mr. Trinh Anh Tuan, the above activities have brought about some positive results such as: Vietnam proved that exporting enterprises did not have acts of evading trade defense measures being applied to third countries in the case of the US anti-evasion investigation on round stainless steel wire, Australia ended the anti-dumping investigation on ammonium nitrate, solar cell exporting enterprises to the US were temporarily exempted from trade defense tax, the official anti-dumping tax rate applied by Mexico on galvanized steel was reduced compared to the preliminary one...
“ In the first 6 months of 2023, the Department paid special attention to and promoted the dissemination of trade defense laws to businesses and industry associations, ” Mr. Trinh Anh Tuan added. In particular, the Department organized 15 seminars and conferences on trade defense in localities (Hai Duong, Cao Bang, Lao Cai, Quang Ngai, Binh Dinh, Phu Yen, Lam Dong, Ho Chi Minh City, Dong Nai, Can Tho, An); organized 10 seminars to exchange expertise with businesses and associations that were investigated by foreign countries for trade defense.

Reporting on the plan to implement tasks for the last 6 months of 2023, Mr. Trinh Anh Tuan said that the Trade Defense Department will continue to promote the specialized tasks assigned by the Ministry of Industry and Trade, focusing on continuing to reform and control administrative procedures; continue to advise on developing plans to negotiate Free Trade Agreements; continue to monitor and develop a comprehensive report on Vietnam's market economy to submit to the Ministry's leaders in October 2023 and send to the United States in November 2023.
In addition, the Trade Defense Department will continue to implement the law on trade defense; handle cases of investigation and anti-avoidance of trade defense initiated by foreign countries in the past and newly arising cases (if any), focusing on anti-avoidance cases in industries with large export turnover such as wood, solar panels, steel... due to the large impact and the applied anti-avoidance tax rate is often at a high level.
Recognizing and evaluating the work of trade defense, speaking at the Conference, Deputy Minister of Industry and Trade Nguyen Sinh Nhat Tan emphasized that in the first 6 months of 2023, the Department of Trade Defense had some changes in the organization while there were many new and complicated trade defense cases, the requirements of tasks on implementing international commitments were deeper, requiring faster handling... " Despite many difficulties, the effectiveness of trade defense work has been very positive " - Deputy Minister Nguyen Sinh Nhat Tan clearly stated.
Based on the achieved results, in the coming time, Deputy Minister Nguyen Sinh Nhat Tan requested the Trade Defense Department to make efforts to remove difficulties and obstacles, in which the Department needs to proactively improve and overcome limitations in implementing trade defense tasks; improve the effectiveness of law enforcement, and effectively implement administrative procedures in the field of trade defense. In particular, the Department needs to step up the assessment of impacts and damages from trade defense cases for each industry.
Deputy Minister Nguyen Sinh Nhat Tan especially noted that the Trade Defense Department must have close connections and cooperation with relevant units in the Ministry of Industry and Trade as well as regularly coordinate with other ministries and branches such as Customs and Finance in the process of performing tasks and work on trade defense.
“ In addition, the Department needs to review facilities, supplement human resources and management staff to promptly meet the requirements and tasks assigned by the Ministry of Industry and Trade in the field of trade defense in the context of deep international economic integration as well as implementing FTA commitments” - Deputy Minister Nguyen Sinh Nhat Tan requested.
