According to Decision 935/QD-BCT dated April 2, 2025 (replacing Decision No. 515/QD-BCT dated February 28, 2025), the Electricity Authority has 8 functional departments including: Office, departments: Legal; Planning and Planning; Hydropower and Renewable Energy; Thermal Power and Nuclear Power; Electricity Market and Power System; Electricity Price Management; Licensing and 01 public service unit, the Center for Energy Information and Electricity Market Development.
The Electricity Department has the following duties and powers:
1. Develop and submit to the Minister of Industry and Trade for promulgation under his authority or for the Minister of Industry and Trade to submit to competent authority for promulgation:
a) Legal documents and projects in assigned state management fields;
b) Power development planning, adjusting power development planning according to legal provisions on planning, plans, adjusting plans to implement power development planning, programs; list of power projects exclusively invested in construction and operation by the State, including nuclear power plant projects, multi-purpose strategic hydropower plants, important transmission grids from 220 kV voltage level and above; list of emergency power projects and works according to legal provisions on electricity; strategies and policies on electricity trading with foreign countries, list of priority power projects for investment by enterprises in which the State holds 100% of charter capital or enterprises in which this enterprise holds 100% of charter capital for investment and construction;
c) Mechanisms and policies to encourage and ensure the development of electricity and renewable energy; mechanism and time for adjusting average retail electricity prices; price framework of average retail electricity prices and structure of retail electricity price tables; organization of implementation of mechanisms and policies;
d) Method of determining electricity generation service price, wholesale electricity price, electricity generation cost of power plants in the period before participating in the competitive electricity market; method of establishing electricity import price framework; method of establishing, dossier, order and procedures for approving electricity generation price framework, wholesale electricity price framework, electricity transmission service price, electricity distribution service price, electricity system auxiliary service price, electricity system operation dispatch service price and electricity market transaction management service price;
d) Approve the electricity generation price framework, electricity import price framework, electricity wholesale price framework, electricity transmission service price, electricity distribution service price, electricity system auxiliary service price, electricity system operation and dispatch service price and electricity market transaction management service price;
e) Regulations on conditions, restructuring projects of the electricity sector, operating principles, roadmaps, overall and detailed design projects for the formation and development of competitive electricity market levels; regulations for the operation, management of transactions and supervision of the operation of competitive electricity markets at all levels; direct electricity trading mechanism; regulations on conditions, roadmap for the formation and development, and operating mechanism of the forward electricity market in accordance with requirements for ensuring security of electricity supply, competitive electricity market levels and other relevant legal provisions; regulations on the main contents of electricity forward contracts, electricity purchase or sale option contracts and electricity futures contracts;
g) Regulations on power system dispatching and operation, including: dispatching, operation, troubleshooting, black start and power system restoration; regulations on power transmission, power distribution and power metering systems; regulations on foreign electricity purchase and sale; regulations on stopping reduction of power supply and other regulations;
h) Regulations on electricity operation licenses;
i) Prescribe violations and forms of handling violations of legal provisions in the assigned state management field;
k) Solutions to improve the effectiveness of state management in implementing electricity development planning; investing in construction of electricity projects; developing renewable energy and new energy electricity; electricity operation licenses; developing competitive electricity markets and term electricity markets; electricity prices and electricity trading activities; dispatching and operating the national electricity system;
l) Digital transformation activities; develop plans and annual regular expenditure resources to establish, maintain the management, administration, operation and development of the Vietnam Energy Information System.
2. Develop and submit to competent authorities for promulgation or recognition for application of technical regulations, national technical standards and regulations, economic and technical norms applicable to power construction works according to the provisions of law on technical standards and regulations; promulgate under authority professional and technical guidance documents on assigned fields; individual documents; internal normative documents according to the provisions of law.
3. Guide, inspect the implementation, propose amendments, supplements or abolish inappropriate contents of legal documents, strategies, planning, plans, programs, projects and proposals on electricity and electricity regulation after they are approved or issued; guide, inspect the implementation of legal provisions and handle violations of the law on electricity and electricity regulation in accordance with the law.
4. Advise and assist the Minister of Industry and Trade and perform state management of construction investment under the authority of the Ministry of Industry and Trade for projects in the field of electricity development (including: thermal power, nuclear power, hydropower, power transmission, power distribution, rural electricity, new energy electricity and renewable energy electricity):
a) Appraise and submit for approval investment policies; appraise feasibility study reports; appraise construction designs implemented after basic designs; appraise investment capital settlements for completed projects; organize inspections of acceptance of power projects and works under the management authority of the Ministry of Industry and Trade in accordance with the provisions of the law on investment, the law on public investment, the law on investment under the public-private partnership method and guiding documents;
b) Organize the selection of investors for BOT power projects under its authority according to the provisions of law on investment in the form of public-private partnership, negotiate, complete and submit to the Minister of Industry and Trade for signing of project contracts (BOT contracts, Government guarantees), manage and inspect the implementation of projects, resolve problems related to power source projects invested in the form of BOT according to the provisions of law;
c) Submit to the Minister of Industry and Trade a proposal for investment policies to be submitted to competent authorities for approval of renewable energy and new energy power projects in inter-regional sea areas under the Prime Minister's authority to approve investment policies; submit to the Minister of Industry and Trade a document giving opinions on investment conditions, project transfer, shares, and capital contributions of foreign investors for renewable energy and new energy power projects in accordance with the law on investment in the electricity sector (if any);
d) Synthesize information and data on monitoring parameters of primary energy sources and statistics on electricity output of renewable energy and new energy power plants approved by the National Assembly or the Prime Minister or decided on investment policy.
5. Perform tasks on electricity regulation:
a) Appraisal, issuance of new, amendment, supplementation, re-issuance, extension and revocation of electricity operation licenses under the authority of the Ministry of Industry and Trade according to decentralization:
electricity generation price framework, electricity import price framework, electricity wholesale price framework, average retail electricity price framework, electricity transmission service price, electricity distribution service price, electricity system auxiliary service price, electricity system operation and dispatch service price and electricity market transaction management service price, avoidable cost price list for small renewable energy power plants, other types of prices as prescribed by law;
c) Inspect the implementation of electricity price adjustment by Vietnam Electricity Group and power units; implement transparency in electricity prices;
d) Appraise and submit to the Ministry of Industry and Trade for approval the power system operation method and annual competitive electricity market operation plan; appraise and approve monthly competitive electricity market operation plan;
d) Propose a smart grid development program and a national program on electricity demand management to ensure balance between electricity supply and demand, improve reliability and quality of electricity supply; policy mechanisms to implement these programs;
e) Perform state management tasks according to authority over the command and operation of the production, transmission, distribution and allocation system of electricity in the national power system; electricity prices; management and operation of electricity market transactions; and issuance of electricity operation licenses.
6. Perform the functions of a specialized construction agency under the Ministry of Industry and Trade for works and projects in the electricity sector according to the provisions of the law on construction.
7. Perform specialized inspection tasks on contents under assigned state management functions according to law provisions.
8. Take charge in the assigned field of managing the implementation of rights, responsibilities and obligations of the state owner towards the National Electricity System and Market Operation Company Limited (NSMO). Monitor the production, business and investment activities of NSMO. Synthesize reports on all aspects of NSMO's activities.
9. Carry out international cooperation and manage, organize and implement cooperation projects, sponsorship and support from international organizations and foreign governments in assigned fields; carry out the work of mobilizing, receiving and managing official development assistance (ODA) capital and preferential loans from foreign donors in assigned fields according to regulations of the Government and the Ministry of Industry and Trade.
10. Review and systematize legal documents; consolidate and codify the legal system; inspect and process legal documents in assigned state management fields.
11. Organize propaganda, dissemination and implementation of communication of legal documents, guidelines and policies on power development planning, investment in construction of power projects; development of renewable energy and new energy; activities of power regulation, development of competitive electricity market, term electricity market, national programs on electricity demand management and smart grid.
12. Build, operate, and manage information systems, data, multimedia communication documents, electronic information portals, electronic information pages of the Department and communication tools on social networks in accordance with the provisions of law to serve state management work according to the functions of the Department.
13. Research and apply scientific and technological advances in the field of electricity and electricity regulation; develop the electricity market, develop the electricity system, develop new energy and renewable energy; manage electricity demand and save electricity and energy; energy transition and other permitted fields according to the provisions of law.
14. Request organizations and individuals related to the electricity sector to provide information and documents necessary for the performance of assigned tasks; use domestic and foreign consultants when necessary in accordance with the provisions of law.
15. Organize consultancy, training, and human resource development in the fields related to electricity operations, electricity regulation; electricity market development, new energy and renewable energy development; energy transition; electricity demand management and electricity saving; other fields within the scope and management functions of the Department.
16. Carry out legal work and administrative reform in assigned areas and according to the administrative reform plan of the Ministry of Industry and Trade.
17. Manage the organizational structure and staffing; implement salary regimes and policies on remuneration, rewards, discipline, training, and professional development for cadres, civil servants, and public employees according to the management decentralization of the Ministry of Industry and Trade and regulations of law.
18. Manage finance and assets assigned according to the decentralization of the Ministry of Industry and Trade and regulations of law; use allocated state budget and other fees according to regulations of law.
19. Advise on state management and monitor the activities of Associations and professional associations operating within the assigned industry and field.
20. Coordinate with the Office of the National Steering Committee on Electricity Development to perform advisory and assistance tasks to the National Steering Committee on Electricity Development.
21. Perform other tasks assigned by the Minister of Industry and Trade.
