Agree to submit the Law amending and supplementing a number of articles of the Advertising Law at the next session of the National Assembly

On the afternoon of March 26, at the National Assembly House, under the direction of Vice Chairwoman of the National Assembly Nguyen Thi Thanh, delegates highly agreed on the content of accepting and revising the draft Law amending and supplementing a number of articles of the Law on Advertising.

Vice Chairwoman of the National Assembly Nguyen Thi Thanh said that at the 8th Session, the 15th National Assembly discussed the draft Law amending and supplementing a number of articles of the Law on Advertising. According to statistics, there were 103 opinions expressed by delegates, including 86 opinions expressed in the Group and 17 opinions expressed in the Assembly Hall, and 1 opinion expressed in debate. The Secretary General of the National Assembly has reported a full synthesis of the opinions of the National Assembly delegates discussing in the Group and the Hall on the draft Law.

Next, at the 41st Session, the National Assembly Standing Committee gave opinions on a number of major issues to explain, absorb and revise the draft Law. After the Session, the Standing Committee of the Committee for Culture and Social Affairs held many meetings with the drafting agency, relevant agencies and experts to absorb, complete the dossier and report at the Conference of full-time National Assembly deputies.

Based on the opinions of National Assembly deputies and the orientation for innovation and improvement of the law-making process according to Conclusion No. 119 of the Politburo, the draft law after being reviewed, absorbed, revised and completed includes 3 articles, amends and supplements 23 articles, abolishes 1 article and 10 points and clauses of the 2012 Advertising Law, clarifies many issues compared to the draft law submitted to the National Assembly for comments at the 8th Session, such as: Some terms related to the person transmitting advertising products; providing cross-border advertising services; rights and obligations of the person transmitting advertising products; requirements for advertising special products, goods and services; responsibilities of organizations and individuals participating in online advertising and cross-border advertising.

At the Conference, delegates highly agreed on the content of receiving and revising the draft Law amending and supplementing a number of articles of the Law on Advertising. The process of receiving and revising the draft law ensures that it meets the requirements and objectives set out; the content is regulated within the authority of the National Assembly, closely following reality, ensuring feasibility; increasing decentralization and delegation of power; not regulating in the law the contents of administrative procedures, order, and records but assigning the Government to regulate according to its authority to flexibly and promptly amend and supplement when necessary, in accordance with reality and meeting the requirements of administrative reform.

The representative of the drafting agency, Deputy Minister of Culture, Sports and Tourism Trinh Thi Thuy, provided further information on the process of receiving, explaining and completing the draft Law amending and supplementing a number of articles of the Law on Advertising. Accordingly, the drafting agency has had many comprehensive and in-depth working sessions, organized conferences and seminars to consult with experts, ministries, sectors, businesses and National Assembly deputies.

Deputy Minister Trinh Thi Thuy also said that the drafting agency continues to listen to and accept additional comments to continue perfecting the draft law. In particular, the drafting agency has been active and proactive in drafting a decree guiding a number of articles of the law in accordance with the provisions of the Law on Promulgation of Legal Documents.

In her concluding remarks, Vice Chairwoman of the National Assembly Nguyen Thi Thanh stated that at the 8th Session, the draft Law amending and supplementing a number of articles of the Law on Advertising received many comments from National Assembly deputies, and is one of the draft laws with high topicality, with elements of predicting fluctuations in the field of advertising, especially advertising on cyberspace and cross-border advertising. The Vice Chairwoman of the National Assembly noted that in the context of a strong shift to a digital society, scientific, technological, artificial intelligence activities, and forms of advertising also need attention.

Emphasizing that the 7th Conference of National Assembly Deputies working full-time reached a high consensus on receiving, revising and perfecting the draft law, Vice Chairwoman of the National Assembly Nguyen Thi Thanh requested the Ministry of Culture, Sports and Tourism to report to the Government to submit to the 9th Session of the 15th National Assembly. In particular, the Ministry of Culture, Sports and Tourism and the Committee for Culture and Social Affairs will continue to research and review, especially issues related to state management of advertising; update new developments in the process of implementing the policy of merging and streamlining the apparatus and organization of two-level local governments. At the same time, the Committee for Culture and Social Affairs will continue to closely coordinate with the Ministry of Culture, Sports and Tourism to complete the dossier to ensure strictness and quality according to regulations to submit to the National Assembly for consideration and approval at the upcoming 9th Session.

In his closing speech at the Conference, Vice Chairman of the National Assembly Tran Quang Phuong said that the 7th Conference of full-time National Assembly deputies, term XV, took place in an urgent, exciting and highly responsible atmosphere.

A total of 61/73 National Assembly deputies expressed their opinions on 10 draft laws considered at the 9th Session, of which 8 draft laws were first commented on at the 8th Session and 2 draft laws were submitted to the National Assembly for consideration and approval according to the procedure at a session (Law amending and supplementing a number of articles of the Law on Product and Goods Quality and the Law on Personal Data Protection). At the Conference, the drafting agencies also participated in explaining and reporting to clarify the contents of interest to National Assembly deputies.

The Vice Chairman of the National Assembly requested that agencies closely follow the Conclusion and Resolution of the 11th Central Conference to coordinate to urgently update and complete other contents to submit to the National Assembly Standing Committee for comments before submitting to the National Assembly, especially amending the Constitution, laws, and resolutions on organizational structure.

Vice Chairman of the National Assembly Tran Quang Phuong said that currently, the Government and agencies continue to prepare contents to be presented at the session. The National Assembly Standing Committee will continue to direct agencies to send documents as soon as possible; at the same time, request National Assembly deputies to proactively study as soon as documents are sent on the National Assembly application (App) to prepare thoroughly, participate when the National Assembly presents; inform voters and people about the content of the 9th Session at voter contact conferences before and after the session so that people and voters can share and support the contents that the National Assembly considers and decides...
