Strengthening anti-negativity in asset auctions

Speaking at the conference, Deputy Secretary of the Provincial Party Committee, Head of the National Assembly Delegation of Dong Nai Province, Quan Minh Cuong, emphasized that the Capital Law is of great significance, because Hanoi is not only the political, cultural, scientific and educational center but also the economic center of the whole country, when domestic tax collection in 2023 of this city is the highest in the country.

Regarding the Law on Property Auction, whether it is necessary to establish a national or regional auction center or maintain the current auction system in each province; measures to prevent and combat negativity in property auctions; subjects, objects, and forms of participation in property auctions are issues that need to be further clarified.

For Dong Nai, some of the violations that have occurred in the province in recent times are partly due to incorrect application of legal regulations; at the same time, there are also overlapping legal regulations, causing incorrect application, leading to many violations that must be handled criminally. Therefore, from the practical activities in agencies, units, and localities, the Head of the National Assembly Delegation of Dong Nai province requested that delegates actively contribute opinions to the draft Law amending and supplementing a number of articles of the Law on Property Auction.

According to Ngo Duc Thang, Deputy Director of the Department of Finance of Dong Nai province, there are currently 5 property auction organizations and 5 branches of property auction enterprises operating in Dong Nai province with 18 auctioneers in practice. In 2023, 185 auctions will be held in the province. The auctioned assets are mainly real estate, liquidated assets, tools, equipment and other types of assets.

Deputy Director of Dong Nai Department of Finance Ngo Duc Thang contributed comments to the draft Law amending and supplementing a number of articles of the Law on Property Auction.

Property auction activities in Dong Nai have had many positive changes, contributing to protecting the rights and legitimate interests of auction participants, increasing local budget revenue. However, after more than 5 years of implementing the Property Auction Law, it is recognized that there are shortcomings in the legal system, including the Land Law and regulations on management and use of public assets, and regulations on auctioning mineral exploitation rights.

At the conference, delegates from a number of departments, branches and localities contributed their opinions to the draft Law on the Capital; Law on Archives (amended); Law on amending and supplementing a number of articles of the Law on Property Auction. Based on the results of the comments, the National Assembly Delegation of Dong Nai province will synthesize and filter them to make recommendations to the National Assembly and relevant agencies.
