The court’s order comes after Apple asked for a temporary halt to the ban on sales of the Apple Watch Series 9 and Apple Watch Ultra 2 at least until U.S. Customs determines whether the changes the company has made are sufficient to escape the copyright dispute. The decision is expected to be announced by U.S. Customs on January 12.

Apple previously released a software update for the Apple Watch and submitted the design of the update to the US Customs and Border Protection to see if the redesigned version would fall outside the US International Trade Commission (ITC) ban.
Apple is in trouble with the Apple Watch Series 9 and Apple Watch Ultra 2 duo when the ITC discovered that the company had infringed two patents of medical technology company Masimo related to blood oxygen sensors.
In a 2021 filing with the ITC, Masimo accused Apple of 103 instances of infringement across five different patents. The ITC later found Apple infringed on two patents.
Previously, on December 25, the administration of US President Joe Biden refused to suspend the ITC's ban. Therefore, Apple filed a petition with the Court of Appeals on December 26.
