Decentralize the right to recruit teachers to the principal?

The draft Law on Teachers decentralizes power to the education sector, thoroughly decentralizing in the direction of authorizing heads of public educational institutions to take the initiative in recruiting teachers.

The assignment of authority to the education sector to take the lead in advising and organizing the recruitment of teachers in the draft Law on Teachers is one of the new policies that has attracted public attention. This has long been the responsibility of the internal affairs sector.

Although there was a lot of consensus, there were opinions suggesting clarifying the agency that is decentralized and authorized to recruit teachers instead of the general regulation that it is the education sector.

The right to recruit teachers will be completely decentralized to the heads of public educational institutions.

The report of the Standing Committee of the National Assembly's Committee on Culture and Society said that, based on practical requirements and the implementation of the policy of decentralization, delegation of power, and acceptance of opinions, the draft law was revised in the direction of decentralizing power to the education sector to take the initiative in recruiting teachers; at the same time, thoroughly decentralizing in the direction of authorizing heads of public educational institutions at all levels of general education, vocational education, and higher education to proactively recruit teachers.

For public general education institutions that do not have the conditions and capacity to conduct recruitment, the education management agency shall conduct recruitment.

For preschool education institutions, due to the scale, conditions and capacity that are difficult to ensure, the authority to recruit preschool teachers is assigned to the local authorities. In cases where the conditions are met, the head of the preschool education institution shall recruit under authorization.

For public educational institutions belonging to the armed forces, the recruitment of teachers is assigned to the Minister of Public Security and the Minister of National Defense to regulate in accordance with the specific nature of the field.

The recruitment of teachers in schools of state agencies, political organizations, and socio-political organizations to carry out the task of teaching training and fostering programs will be decided and guided by the competent authority managing the educational institution.

For non-public educational institutions, the recruitment of teachers is conducted by the head of the educational institution in accordance with the regulations on organization and operation of the educational institution.

The draft law also assigns the Government to specify in detail the authority and contents related to the recruitment of teachers in public educational institutions; and specifies the recruitment of foreign teachers.

Priority and special treatment in teacher recruitment

The draft law clearly stipulates the subjects that are given priority in teacher recruitment in Clause 3, Article 14; and stipulates the subjects that are entitled to policies to attract and promote teachers, including preferential policies in recruitment in Clause 1 and Clause 2, Article 27.

At the same time, the draft law amends the regulations on receiving teachers in public educational institutions in the direction of considering the reception of teachers as a special case in recruitment (not going through the normal recruitment process) to be consistent with the legal regulations on special recruitment for civil servants; assigning the Government to specify in detail the conditions, subjects, procedures, and documents for receiving teachers.

The agency drafting the Teachers Law believes that if this regulation is passed, the education sector will be proactive in recruiting, using, and developing the teaching staff because there will be strong enough legal sanctions to remove bottlenecks in the recruitment and use of teachers in the past; there will be a mechanism to attract good people to the teaching profession, and retain good teachers in the profession. From there, the quality of the education system will be improved on the basis of standardizing the quality of the teaching staff.
