NTO - Reviewing provincial planning for the 2021 period

On May 9, the Government issued Official Dispatch No. 46/CD-TTg on reviewing approved provincial planning for the 2021-2030 period, with a vision to 2050.

Accordingly, the Prime Minister sends telegrams to Ministers and Heads of ministerial-level agencies; Chairmen of People's Committees of provinces and centrally run cities, implementing the Law on Planning, Resolution No. 61/2022/QH15 dated June 16, 2022 of the National Assembly on continuing to strengthen the effectiveness and efficiency of implementing policies and laws on planning and a number of solutions to remove difficulties and obstacles, speeding up the progress of planning and improving the quality of planning for the period 2021 - 2030 and Resolution No. 108/NQ-CP dated August 26, 2022 of the Government on implementing Resolution No. 61/2022/QH15 of the National Assembly on continuing to strengthen the effectiveness and efficiency of implementing policies and laws on planning and a number of solutions to remove difficulties and obstacles, speeding up the progress of planning and improving the quality of planning for the period 2021 - 2030, People's Committees of provinces and centrally run cities and ministries and agencies have seriously and urgently implemented Currently, the organization of establishment, appraisal, review, completion and submission for approval of provincial planning. Up to now, 58 provincial and municipal plannings for the period 2021 - 2030, with a vision to 2050, have been approved by the Prime Minister, actively contributing to economic restructuring, growth model innovation, investment attraction and sustainable development of localities and the country.

In the process of organizing the establishment, appraisal, review, completion and submission for approval of the Provincial Planning for the period 2021 - 2030, with a vision to 2050, the Government leaders have directed the People's Committees of the provinces and centrally-run cities to review, ensure and take responsibility for the accuracy of information, data, figures, documents and the consistency and consistency (no overlap or conflict) between the Provincial Planning and other planning approved by competent authorities in accordance with the provisions of the law on planning; all localities have made written commitments to ensure this content when completing and submitting for approval the Provincial Planning.

However, according to the feedback of some localities and enterprises, some approved Provincial Plannings are not consistent with the National Planning, Regional Planning, Technical and Specialized Planning that have been approved by the Prime Minister or are under the Prime Minister's approval authority. Information, data, figures and documents in the planning dossier are not accurate enough, which can cause difficulties and obstacles in the implementation of Provincial Plannings. The progress of developing and submitting the implementation plan for Provincial Planning is very slow.

To promptly detect and handle shortcomings in the implementation of provincial planning, the Prime Minister requests:

Provincial People's Committees are responsible for regularly reviewing and promptly reporting on inaccurate information; information that is not consistent with national planning, regional planning, technical and specialized planning that has been approved by the Prime Minister or is under the approval authority of the Prime Minister; and on other problems and inadequacies (if any).

For inaccurate information, data, figures and documents: The Provincial People's Committee is responsible for reviewing and editing the dossier, ensuring consistency with the approved decision (including the Planning Report, system of diagrams, maps, planning database), sending 1 set of planning dossiers to the Ministry of Planning and Investment for storage according to the provisions of Article 38b of Decree No. 58/2023/ND-CP dated August 12, 2023 of the Government amending and supplementing a number of articles of Decree No. 37/2019/ND-CP dated May 7, 2019 of the Government detailing a number of articles of the Law on Planning; updating the National Planning Information System and Database; publishing and providing planning adjustment information according to regulations.

The Chairman of the Provincial People's Committee is responsible before the law, the Government and the Prime Minister for reviewing and editing planning records and documents and ensuring the accuracy of the content, information, data, documents, diagrams, maps and databases in the Provincial Planning records for the period 2021 - 2030, with a vision to 2050, when updating them into the National Planning Information System and Database.

For contents that are inconsistent or different from the national planning, regional planning, technical and specialized planning that have been approved by the Prime Minister or are under the approval authority of the Prime Minister, the Provincial People's Committee shall adjust the Provincial Planning according to the provisions of Point c, Clause 1, Article 2 of Resolution No. 61/2022/QH15 dated June 16, 2022 of the National Assembly on continuing to enhance the effectiveness and efficiency of implementing policies and laws on planning and a number of solutions to remove difficulties and obstacles, speed up the progress of planning and improve the quality of planning for the period 2021 - 2030. Upon receiving a request for comments from the Provincial People's Committee on the dossier for adjusting the Provincial Planning, the Ministry in charge of the sector shall give specific opinions on the handling plan; reply in writing to the Provincial People's Committee and send it to the Ministry of Planning and Investment.

The Provincial People's Committee is responsible for receiving and explaining the opinions of relevant ministries and agencies, completing the dossier for adjusting the Provincial Planning and taking responsibility for the adjusted content; submitting it to the competent authority for decision or approval of the planning adjustment, and sending it to the Ministry of Planning and Investment. The Ministry of Planning and Investment is assigned to be responsible for synthesizing the reports of the locality and the sector management ministry, reporting to the Prime Minister for consideration and decision.

Regarding the implementation of projects after the Provincial Planning is approved, the Provincial People's Committee is responsible for simultaneously reviewing the project's conformity with the Provincial Planning and relevant national planning, regional planning, and technical and specialized planning approved by competent authorities when considering approval or deciding on project investment policies.

For projects related to national planning, regional planning, technical and specialized planning under the approval authority of the Prime Minister but not yet approved by competent authorities, the Provincial People's Committee is responsible for seeking written opinions from the planning agency before considering approval or deciding on the project investment policy.

Regarding the plan to implement the Provincial Planning, localities that have had the Provincial Planning approved shall urgently develop and submit for promulgation the plan to implement the Provincial Planning in accordance with the provisions of Clause 4, Article 38c of Decree No. 58/2023/ND-CP dated August 12, 2023 of the Government and the guidance of the Ministry of Planning and Investment in Document No. 2540/BKHDT-QLQH dated April 5, 2024 on the development of the plan to implement the Provincial Planning. After the Provincial Planning is approved, the order and procedures for implementing projects shall comply with the provisions of the law on investment, construction, bidding and other relevant laws.

For other problems and shortcomings (if any) arising during the implementation of the Provincial Planning, the Provincial People's Committee shall promptly send a report to the Ministry of Planning and Investment to preside over and coordinate with relevant ministries and agencies to provide guidance according to their authority or synthesize and report to competent authorities on handling plans.

The Prime Minister assigned the Ministry of Planning and Investment to study regulations on maximum decentralization to the provincial level along with clearly defining decentralized responsibilities; reducing administrative procedures in planning activities and designing tools to inspect and monitor planning activities during the process of presiding over the research and development of the Law amending and supplementing a number of articles of the Law on Planning.
