Regarding social housing policy, the draft Law on Housing (amended) stipulates the subjects eligible for social housing support policies.
Notably, there are 3 subjects: Low-income people in urban areas; Workers and laborers working at enterprises in industrial zones; Cadres, civil servants and public employees according to the provisions of the law on cadres, civil servants and public employees.
Regarding the conditions for purchasing and hire-purchasing social housing, including the income condition, the draft Law stipulates that the above 3 subjects, in order to be eligible to purchase or hire-purchasing social housing, must not be subject to income tax on income from wages and salaries according to the provisions of the law on personal income tax.
Meanwhile, in terms of housing conditions, the draft Law stipulates that some subjects who are eligible to buy or rent social housing must not own a house, have not purchased or rented a social house, have not enjoyed any form of housing support policy at their place of residence or work, or have a house owned by themselves but the average housing area per capita in the household is lower than the minimum housing area prescribed by the Government for each period and each region.
Examining this content, the Law Committee said that some opinions suggested considering not applying this policy to the group of "workers with income subject to income tax according to the provisions of the law on personal income tax" to ensure the implementation of the policy towards low-income people with housing difficulties.
Regarding this issue, in the discussion group, delegate Van Thi Bach Tuyet (Ho Chi Minh City delegation) proposed to review the regulation that workers working at companies in industrial parks are eligible to buy social housing if it is ensured that they are not subject to personal income tax.
"It is necessary to review the current regulations on personal income taxable income levels, because according to the opinions of many workers and laborers, this regulation is outdated at present. Workers' income may exceed the level required to pay personal income tax. But with that income, they have to raise 2 more children. And the current cost of essential goods to ensure their lives is not enough. If this regulation is maintained, they will not have money to buy a house.
Therefore, it is necessary to consider appropriate adjustments to create conditions for workers and laborers to have the opportunity to own their own homes," Ms. Tuyet suggested.
Also related to this issue, delegate Tran Hoang Ngan (Ho Chi Minh City delegation) said that it is reasonable to open the scope for workers who are subject to personal income tax to buy social housing because the current income tax threshold is low, while they have to pay family deductions (wife and children), which should be commended in society.
Meanwhile, delegate Ta Thi Yen (Dien Bien delegation) suggested that when building the framework, salary table, and income for workers and salaried employees in all economic sectors, it is necessary to calculate the ability to buy/rent/rent social housing.
"I suggest that enterprises developing infrastructure for concentrated industrial parks and clusters and economic zones must definitely have social housing projects providing accommodation for workers for non-profit purposes.
It is even possible to establish a social housing development fund in urban areas with many large-scale industrial parks and clusters so that businesses with many workers who do not have accommodation can contribute to the fund to develop social housing for workers," Ms. Yen suggested.
Delegate Yen also said that there should be more specific and detailed regulations in social housing policies for easy implementation in practice, especially regarding investment and distribution processes and procedures.
In addition, there are standards and technical norms for social housing, land allocation for social housing development right from the planning stage, land use plans, regulations on allocating a certain percentage of land area (according to current law, 20%) in commercial housing projects, urban areas for social housing construction...
The delegates also agreed with the provisions in Article 84 on determining the selling price, rental price, and hire-purchase price of social housing not invested in and built by the State. On the basis of fully calculating the investor's costs and a reasonable profit rate in the selling price to recover the investment capital of the enterprise, ensuring the legitimate rights and interests of the enterprise.
However, due to the ability to secure land funds, the price of raw materials and human resources for social housing projects in each locality is also different. Therefore, delegate Yen supports the inclusion in the law to increase the locality's initiative in financial support for social housing, because only then can the subjects of social housing access or choose housing with reasonable area, construction quality and affordable prices.
Proposal to add more subjects to benefit from social housing support policies
Commenting on the draft Law, delegate Bui Sy Hoan (Hai Duong delegation) said that regarding the subjects entitled to social housing support policies, Clause 6, Article 73 stipulates that workers and laborers working at enterprises in industrial parks are entitled to social housing support policies.
The delegate said that currently, many business clusters are appearing, developing rapidly, attracting many workers. To ensure sufficient conditions to meet the demand for social housing, it is necessary to add more workers, laborers, and experts working at businesses in industrial clusters.
Delegates reflected that currently, the housing needs of workers in industrial parks are being met, attracting investment in building social housing according to the 2014 Housing Law. Meeting the rental needs of businesses and workers is very important.
